richard walker is in missoula and sent us this report. >> missoula, montana. winter is setting in this university town of 70,000. an urban center and frontier state. it's a place where guns are a fact of life. that's not controversial in this land of hunting and fishing. what the whole town is debating now is what they are allowed to do with them. missoula has been gripped by the death of this young man. diren dede came here last year as an exchange student from hamburg. he never made it back home. this is where he died. late one saturday night, he snuck into this garage, maybe looking for alcohol, maybe just for a dare. the door was open. what happened next here in this small suburban street is now the subject of a criminal case that could put montana's gun laws to the test. local police file documents setting out the allegations against the homeowner, markus kaarma. they say he was alerted by motion sensors that someone was in the garage. he then went outside with a shotgun and fired four times into the garage. did that amount to a trap? at missoula county c

finally, he said i got to go back to missoula and he dropped the papers off with david. town happens to see the woman in her car, and starts following her. well, she calls the police and says this guy is stalking me. the police come, they pull him over, they ask him what he's doing. he calls david and says i need you to bring the papers down and prove that i am who i say i am. david arrives at the scene and his relationship being what it was with all members of law enforcement in flathead county, was told to get back in his car immediately. david refuses to get back in his car after he's told to do so and is pepper sprayed in the face. an officer puts him in handcuffs. >> i am real familiar with david. i don't want him with his history behind my back while i'm on a traffic stop, okay? >> this had to be a moment where david really snapped. >> it turned out they were members of this militia group known as project 7. the goal of this group was to assassinate people that had wronged them. >> nobody surrender your weapons to nobody. ♪ the mercedes-benz winter event is back, w

richard walker is at the trial in missoula. can you tell us what is going on at the moment?through the course of monday and tuesday, the court is selecting the jury members. potential members of the jury are being asked, for instance, if they have ever been burglarized, to test if they are prejudiced one way or the other. several people have been recused on that. it is expected to continue until the end of tuesday. this is an important issue. the defense has been pushing for this trial to be moved to a different county altogether. they say the locl media coverage in the area has been prejudicial and could influence members of the jury. the judge has rejected that and the trial is expected to proceed. >> give us background. some say the man in question lured the dead individual into his garage. what is that all about? >> obviously, this case is a tragedy for the relatives. the parents have been here in the courthouse, watching the proceedings. there is a lot of interest in the case as a test of the castle doctrine, that you can use deadly force if you find an intruder on your

that's the latest from missoula. let's go to our correspondent who joins us live from the courthouse. what's the latest, and what is the atmosphere at this trial? >> it was quite a businesslike atmosphere in the courtroom this morning as the two sights set out opening statements. there was a sense that both the jury and the victim's family were accustomed to the atmosphere in the courtroom after a couple of jury selection earlier in the week. there were a couple of moments of drama, both of them coming from the county attorney, the prosecuting side. at one point, the prosecutor held up the huge pump action shotgun that was used to kill the victim with the message essentially that this is not a weapon that you use lightly. one local veteran court reporter has been reporting for 37 years in events that he has only seen anything like that once before. the other moment was when we saw a photograph of the scene. there was a lot of blood, and obviously, that was a very difficult moment for the family. >> sounds like we cer
