we are in chevron territory here. the question is whether the text on ambiguously forecloses hud 's interpretation. >> one concern about disparate impact is that it is difficult to decide what impact is good and bad. take two proposals. one is a proposal to build new housing in the low income area that would benefit primarily minorities. the other proposal is to build housing in more affluent areas that would help promote integration, also a good thing. which one gets credit for trying to decide the impact? the one that is revitalizing a low income area or the one that is integrating a high income area? >> they may be difficult questions. the agency here charged by congress expressly with interpreting and enforcing these provisions has concluded that disparate impact is the right policy judgment. >> which benefits? you are trying to see a benefit on minorities. that certainly benefits integration. if you give the proposal in the low income area, that certainly helps housing opportunities. >> i think you've got to do i

chevron for a smaller company, a company of 2/3 the size of chevron has been spending more dollars, up$40 billion annually recently to try to grow production really through australian lng, exxon has been more conservative and that's been a huge differentiation. the other thing exxon has is more refining much more chemicals. that obviously heavily affects its relative earnings power when oil and gas have fallen so hard. >> that chevron halting buybacks was somewhat of a surprise. will it be able to maintain the dividend that has been such a good draw for investors? >> yeah for these guys all of these companies, it's very very lasting. they have to keep increasing it because it would become a real decline. but if you don't beat inflation, your real dividend is falling. for chevron, let's say $30 billion of cash flow they've got 8 billion in dividends to pay. still spending over 30 billion of cap ex. so we do expect the cup to be required certainly if oil stays anywhere near where we are today. and these companies will become more and more dividend payout stories with essentially shrinkin

you talked about chef e chevron. fox is explaining change views. last year, the supreme court decided a case where the epa had tried to modernize and tailor the clean-air act by deciding that carbon emissions were a public school tant. something that congress pretty clearly did not intend back in the 1970s. but that's what 2 epa was going to use to regulate greenhouse gases. the spleem court said sorry, that's a decision that has to be made by congress. yet, it's the same thing to have a new hitle 2. not the old title 2 that we've expressed concern about, the one that involves price controls and broad band taxes and so on. but something light and easy to deal with. so isn't that a new hurdle to have to jump through in court? >> no. i just explained this before. and i think the chairman used it as an example yesterday and previously is that he said you know when he was the chief lobbyist for the wireless industry, they saugt this light-touch, hitle 2 regulation. congress had laid out to do that. and he said, you know the industry saugt that. it's wo
