>> there's the hastert rule in the republican cog, and he basically can't bring something to the floor unless it has majority support in his caucus. so it's not just those 50 guys who voted against this legislation. he must feel that he does not have a majority in favor of the senate bill the clean bill as they say. and if he doesn't have that and he brings the bill forward anyway, he's violated this cardinal principle and that would be the justification for them to have this sort of a coup and toss the speaker out of his job. now, you know as the congressman was saying he has democrats here certainly willing to back him up on this vote. so they'll certainly win the vote if he brings the senate bill up. and, of course everybody votes for the speaker of the house. and it's even theoretically possible that the democrats would help him keep his speakership, but that's completed uncharted territory here and that's not something he wants to rely on. >> we are now, congressmen, under six hours until the dhs funding expires. here's what a shutdown of homeland security would look like. 30,000

we've we've seen boehner be able to pull something out of the fire it's because he's ditched the hastertan't depend on the 40 members of the crazy caucus. mcconnell is trying to get things off the exit ramp. you get so close to the cliff. even if you want to turn away sometimes, you can't. >> that's the problem. they've got themselves into a pattern. you look at this in keystone obviously different, but in a very real way, the same. jim acosta was saying this morning in the old days they used to veto and they would have these, the veto fight. what would happen now. they don't even pass any legislation, so you never get to a veto. that's why veto is so unusual. they're playing a game of less is more and it's playing out on both of these fronts. >> i also got to say. i think democrats are playing a bit of a dangerous game if they're not helping keep the government open. if they think somehow they've got a political win and a shutdown so they're going to actively encourage it. >> it didn't work so good for the republicans the last time around. >> it did work bad. >> in terms of the ultimate

boehner is not going to try to do the hastert rule yet. that's the only way we'll get out of this folks. we'll get a continuing resolution we'll punt and do this again in three weeks, that will be the time where allegedly we're all going to have a great meeting of the mind. that's not going to end up. and when mcconnell tried to dot right thing, it passed 98-2. if you try to do the right thing, it's not controversial. >> the house and the senate are two totally different institutions john boehner is a weak speaker, he was challenged six weeks ago in terms of his speakership. a lot of people want to take him out. needs to be able to maintain some degree of leverage over his caucus so he can't be seen as folding to mitch mcconnell's deal in the senate. he needs to take it down to the bottom line for his caucus. >> he picked the wrong football this time. these threats all over the place. >> are you correct, but they are divorced from reality when it comes to that. it's all about the power within the caucus and for him to maintain leverage on
