a year ago it changed from michele bachmann herman cain rick santorum before finally settling on mitt think that 2016 will be different or do we see the changing poll numbers daily? >> whenever you have this large of a field of any size you're going to have the whack-a-mole game. whenever they're in the lead they'll get pounded by the media and critics. the key is to certainly a year from now when we're going into the primaries and the caucuses in iowa and that's important. these key -- key also are these polls done in the individual states. you had a poll out last week in iowa. governor huckabee leading in that poll. also in south carolina and new hampshire he's among the top in the field there. so as the governor has always said back in 2008 this is the marathon not a sprint. so this is a great place to start off. the key is to keep the momentum going this time next year. >> so is it safe to assume that he's going to participate in the iowa straw poll? some republicans were thinking not because they don't think it shows much and why waste your resources there. >> well, as we said he

and we were getting out materials to -- i rode with my friends, herman cain and kenneth davidson, one of the published cases on sex discrimination and the law. but we came to see -- by the way, i should say who the "we" were. a brilliant lawyer, marvin kilpack, he was one of the general counsel. he spotted in law week what he said is going to be the turning point -- gender discrimination case. the year is 1970 and the supreme court has never seen a gender classification that it thought was unconstitutional. this case was decided by the supreme court of idaho. it was about a woman named sally reid who was divorced when her son was what the law calls of tender years so sally got custody. when the boy got to be a teenager the father said he now needs to be prepared for a man's world, so i want him to live with me. sally thought that was a bad idea. i'll cut part of the story short, but the boy one day took out one of his father's mini rifles an killed himself. so sally wanted to be appointed administrator of his estate. not because it was any monetary gain gain. for sentimental reasons.
