can you go deeper and explain what a stand alone pac is. in the past i thought we had regulation, you cannot exceed $500 support to candidates, but i have seen pacs where large amounts of money have been put into, what is the stand alone pacs before or against a candidate >> i think you are referring to the same thing a pac is really just a bank account, a group of people get together open up a bank account, and ask for money for political purposes, as a candidate, you do that third party, who are not candidates who want to be involved in the political process, can do that. it can be anyone from the chamber of commerce to a maul neighborhood group, this ruling and the subsequent rulings, have said, there is no coordination with a candidate. you cannot limit the amount of contributions, into that pac, if they're making expenditures saying, vote for or against >> so we have had a limit of $500? >> there had been correctly, the then the court said you cocannot enforce it it is unconstitutional >> that is citizens, united or mccuchn >> prior, t

or pacs. the super pac or pacs is supposed to be separate with no coordination between the kantd date and the super pac. but everyone understands they can get away with moving in the same direction even in lock step. carly fear ina decided to test one of the simplest clearest rules meant to separate the super pac from the candidate. the rule the superpac may not have the candidate's name as part of its name. rather than platitude like right to rise the name of jeb bush's superpac the carly fiorina super pac called itself carly for america. the sec informed that the super pac you must amend your statement of organization to change the name of your political committee so it does not include the candidate's name and/or provide further clarification regarding the nature of your committee. so the carly for america super pac said fine. they changed the name officially to the following acronym, conservative authentic, responsible leadership for america. the carly for america super pac went from this

party groups participating in elections any where from the small grass roots group, up to the larger pac. sort of the main gist of what we tried to do with this this has to do with candidate elections, what we're trying to do is consolidate, and streamline requirements, which i will show on the next slide. and really essentially, basically, adopt the state law requirement, which is very robust. and that requirement is 24-hour reporting, within 24 hours from anyone spending $1,000, for or against a candidate, before an election, and having copies of whatever is reported filed with the ethics commission so people can review that. just to tell you a little bit a lot of folks, may be familiar with this, what we're talking about in the types of expenditures and cfro breaks it down into four general groups, one is independent expenditures and those are things where they say "vote for candidate x, vote against candidate y", that is most election mailing. then there is something called election year communications which many years ago, people get around reporting, by not saying vote for, vote ag

bernie sanders does not have a super pac and says he will not have a super pac. there was a comment about negative ads -- reportedly, he has never run a negative ad in his entire life. that's what i heard. i'm interested to hear your response. guest: that is something that i want to fact check and look into. while bernie sanders himself might not sanction a super pac being active on his behalf, that doesn't stop anybody else from going out there to start a super pac. two years ago, there was a pro bernie sanders and super pac started called "ready for bernie ." they recently changed their name to "bet on bernie 2016." the candidates don't want to condone that type of behavior the way the law is written people can go out there and start these groups. go out with hopes of cashing in on a candidate, whether that's bernie sanders or hillary clinton. i wrote about pro-hillary super pacs that looked nothing more than an online store. the people who started it had a series of financial background problems, they were being sought in a judgment in a case in california. it

. >> this date will also mark the official separation of jeb bush from his pac which has raised more than $100 million. one of the closest confidentes. it will be the campaign that will do the advertising, it will be the pac with the theory that this guy mike murphy can help jeb bush take his campaign well into the primaries. michael how big a risk is this? >> you said it right there david. it's a huge risk, they knew it from the outset because you say this is separation of the two. it is also the day that all the scrutiny really begins in earnest. people are going to be watching, people in the media are going to be watching to see how they operate that superpac, right to rise it's never been done in a similar fashion. mike murphy has been a right-hand man to many republicans and he's not able to be consulted now that he's got a role in the pac. it could be risky but vs. successful in spending and raising money. all the tv spending coming out of the pac. >> jeb bush his record as florida governor what are the themes or doaks that anecdotes doaks anecdotes that you are looking for. >>

we're still waiting to see how it takes shape, but this super pac that is going to be supporting jeb bush's eventual candidacy, they're talking about doing fund-raising, doing direct mail potentially, polling, almost outsourcing the usual campaign function to this super pack pac. we're really in unchartered waters on that. it's not just bush. you hear candidates saying, look, you may think that's a problem, but i'm not going the be the one that's going to unilaterally disarm. >> let's listen to that one moment casey refers to where jeb bush slipped, told the truth and dropped back into the mode that he's in. >> i'm running for president in 2016 and the focus is going to be about how we -- if i run, how do you create high sustained economic growth. >> eric, there it was pep got the if i run back in there. the report in the "new york times" today, fred wertheimer certainly isn't the only person who thinks this is a violation of law. >> no w. i spoke with a bunch of campaign finance lawyers who believe he is if not pushing the line, perhaps even crossing it at this point. because it is

again, this doesn't include all of the other reports, most of these pacs are filing which is midyear, end of year report. there are two types of preelection reports files, one in san francisco, one in whatever is the home jurisdiction. and a noncoordinating, verification saying i'm not coordinating with the candidate, there are a lot of forms for example, somebody who sends out one mass mailer could trigger basically -- basically, there could be five reports that one mailer is reported on. at least they would have to consider five reports, that is the mass mailing the $5,000 expenditures, the 4,006 expenditureses, and -- report all saying the same thing, what we thought. the 90 day standard is the standard to go for. it's state law, it's very robust. and what we thought is that -- you can see we have a third party disclosure form, by the way for all of the local requirement, which the nettics, commission staff staff simplified it but it's eight pages long we basically consolidate the requirements streamline and make it one standard, so all of these groups that are engaging in this act

the super pac will play a big role getting his message out there. mike murphy is close with jeb bush but ultimately, that will hamper activities taking place at this point. host: what are the money totals right now? how much will he announced he has versus hillary clinton? guest: when you add up all the committees you will likely get close to an hundred million dollars. a sizable sum of money, more than hillary clinton at this point in the game. there have been reports that the fundraiser has not come quite as well as their high expectations previously. the $100 million figure may not solely be within the super pac itself but if you add up the campaign and other associated committees, it is likely he will get close to the $100 million mark. host: you were talking earlier about jeb bush, he has these challenges distancing himself. he has stumbled a little bit on the campaign trail so far. he has not been officially announced candidate here than there is news of him shaking up his campaign at this early start of his bid. guest: there have been a coupl
