and the argument that is being made by the plaintiff in ev evenwell is that it is eligible voters and the one person-one vote is designed to protect the strength of an individual's vote. and by definition, therefore you really have to look to people who can in fact participate in the election in order to determine whether the strength of that vote is diluted. the argument on the other side is complicated and all for a couple responsibilities. the argument the state is making is that the state has discretion to chose among the various possible alternative populations and that the one person one vote principle is designed to protect against discrimination and as long as the state is choosing a neutral measure, it is not acting invidiously and nazi the discretion to chose the various options. there is an argument the one person one vote represents a broader representation and you have to take into account that but that is a different argument. i think the challenger has the better view of the one person one vote principle as it was articulated by the supreme co t courtment -- court. but
