josh: i'm josh mcelveen. this potentially press den setting fight stems from the lizzi marriott murder case. reporter: the supreme court is going to have to weigh the privacy rights of a teen-age murder victim against the defendant's right to openness during the appeals process. lawyers for the family of murder victim lizzi marriott and state prosecutors are asking that information about her sexual history private, just as the lower court did during the trial of seth mazzaglia. he was convicted of kill marriott in 2014 and is serving a life sentence without parole. his lawyers say certain privacy protections should not apply during the appeals process. but prosecutors say this is a unique case and are asking that oral arguments be closed and a transcript with certain >> if we have a criminal justice system that says the minute you're victimized everything about your prior sexual history is open for public interpretation, public smear, all of that, then we will have victims who do not come forward. reporter: a

i'm josh mcelveen. jean: i'm jean mackin. 25-year-old cody lafont was killed after a confrontation with police early sunday morning. josh wmur's andy hershberger is : live with what he's learning about the case. andy? andy: investigators are releasing little information about what led up to this officer involved shooting this past weekend, and they it is available. authorities say police were called to a residence early sunday morning where they were confronted by 25-year-old cody lafont. lafont was shot and killed by police. there were no officers hurt in the incident. lafont had a minor criminal history that included guilty pleas to charges of resisting arrest and criminal trespass. he also had an outstanding charge of misuse of the 911 system for allegedly calling the emergency system several times. officials say the shooting investigation could take some peter the interviews of various : witnesses is ongoing as wll as physical evidence and any forensic evidence, so that is an online process that star

in less than two hours from now with republican candidates for new hampshire's let's go now to josh mcelveen. josh: the last primary granite state debate could be an interesting one, we have the incumbent frank guinta and has his challenger rich ashooh. john, there's a lot of issues, but they've gone at each other quite a bit. >> it's gotten very hot. we're going to see more fireworks tonight than we've seen all week. guinta still having issues with thed questions of ashooh having a long career in lobbying. we have the north korea issue, there are some local issues in terms of opioid crisis, so there's a lot to talk about. and ashooh has to get people to know him. people know who guinta is because he's been around for a long time. rich ashooh is a relatively new face on the political scene. josh: frank guinta has to raise up the favorables, he's under unknown. >> he's been in the business community for a long time, but in terms of reaching out to the average voters, three quarters of the average voters don't know who he is yet. josh: it will be an interesting debate, it's tonight at 7:00. an

josh mcelveen, and andy smith sat down to discuss the results. >> first c.d. is down. looks like chris sununu is going to hand on. >> edelblut was the surprise of the entire campaign. whether he wins or loses. he was complete unknown. he didn't have the congressional support to speak of, other than what he put together himself. he ran a great campaign. he did well in the debates and really made himself the alternative candidate. if it wasn't ted gastas, it is the unknown frank edelblut. >> disappointing night. keep your eyes on the races that haven't been decided. we'll focus on the one >> two months to go. back to you. sean: thanks. new on "daybreak," a deadly crash in ossipee is under investigation. the accident happened shortly after 4:00 yesterday in the area of deer cap campground. state police say a pickup truck was heading north when it crossed the center line and slammed head on into a car. the truck rolled over. the driver of the car, 61-year-old janet bauman, wasro her passenger, 67-year-old gary bauman, was flown to the hospital with life-threatening injurie

employee accused of sexually assaulting an elderly woman in his care pleaded guilty to his i'm josh mcelveen. jean: and i'm jean mackin. timothy morrissey was caught in the act of assaulting his victim. today, he apologized for what he did while the judge called him a predator. wmur's andy hershberger was in court and joins us with what happened. reporter: prosecutors say the victim was one of the most vulnerable in our society, and this sentence needs to send a message that the law is here to protect them. >> i can't apologize enough. sorry. reporter: it was on halloween of last year that 46-year-old timothy morrissey was with a 79-year-old patient at the bel-air nursing home when a co-worker walked in and saw morrissey sexually assaulting the woman. >> the defendant immediately stood up, and when asked what he was doing, the defendant replied, you know what you saw. that staff member reported the incident to the head nurse. the head nurse spoke to the defendant, who stated, you know i have a problem. reporter: morrissey was fired on the spot. prosecutors say the victim suffered from alzhei

josh: i'm josh mcelveen. according to police, tiffany bellerose told her daughter that she'd be visiting but never jean: now her phone is going right to voice mail. police are involved. reporter: earlier this week police put on a be on the lookout for the 42-year-old and now they have reached out to the media. tiffany was last seen on september 16, the 42-year-old had recently moved to bethlehem and that's where police are now concerned about her safety. >> she hasn't shown up to receive her paycheck. also her friends are that it's not like her that she wouldn't at least call. reporter: bellerose had planned a trip to jaffrey to see her grandchildren. >> was supposed to come on wed and she never showed up and haven't talked to her since sunday. reporter: her family says she had a rocky past and recently met a man who is abusive and are worry she may be with him. >> we tried phone numbers that were given to us of the haven't, it just goes straight to voice mail. reporter: police say bellerose was living at a s

i'm josh mcelveen. jean: i'm jean mackin. in the wake a devastating drought, this heist is one more blow straining our local farmers. josh: as amy coveno reports, customers are rallying to help the farm out. reporter: the valley farm stand on hooksett road in hoob set, they grow it all, pick it and large scale theft operation took a big chunk out of their bottom line. >> all the cut corn is us, but this has been, the ears have been taken. reporter: 700 ears, growing on fenced land with a locked gate. it's at least a day of sales to wholesalers, lost. >> we can prove that they stole at least four to $450 worth of product, we can prove they took basedded on the you one lap of corn and the one basket of swiss are carrying his crops out of state for resale. he's heard from two other local farms who say they were hit too. >> we've got to deal with the drought, all the hardships of farming, and we can take it in stride and deal with it. but stuff like this this, this is a shot in the gut. reporter: the facebook post racking up thous

i'm josh mcelveen. jean: i'm jean mackin. this comes after a rock was thrown through a window just missing a pen mo was inside attending a service. wmur's suzanne roantree has the details. reporter: mohammed akbar says he was saddened sunday night when he got the phone call saying that someone had vandalized the akbar used to travel to lowell to pray, but three years ago when nashua became home to several hundred islamic refugees he volunteered to find a place for them here. people in just started to gather on sunday night for the 8:30 service. >> it was lighted up completely inside and people were sitting right beside the window. reporter: that's when a rock came through the one window that had an electronic sign advertising the mosque. it started -- >> he'sin by his ears it was very close to the ears, he thought the light bulb fell down from the top. he had some shredded glasses on his shoulder. reporter: outside the window, three people were seen running away. but police say this may not be an isolated incident. 20 minutes

josh: i'm josh mcelveen. we learned of the arrests in the last half-hour. jean: shelley walcott is joining us live with the details. shelley: manchester police tell us they have found the adults and children they were looking for in this case, so some good news this afternoon. today police have issued warrants for 33-year-old bobbie jo guyer and 35-year-old michael been missing since last wednesday, they were believed to be with guyer and macmaster, but the couple does not have legal custody of them. macmaster was found in awe separate location, both adults were taken into custody and the children appear to be in good health. they have been returned to their legal guardians. an amber alert was not issued in i'm shelley walcott, wmur news 9. jean: breaking news out of south carolina. police say two students and one teacher were wounded after a shooting at an elementary school. anderson county coroner says the students do not appear to have life threatening injuries. a motive isn't known at this point, but local media says a death reported on a nearby road is

first, josh mcelveen joins us with a look at the weekend forecast. a couple of things to navigate, right? >> absolutely. not a day on this weekend where we don't have at least the chance for shower, but plenty of drive times and nice part to the weekend, too. temperatures are in the 60's around the granite state right now. pretty much everywhere except north of the notches where you're in the 50's and let's take a look at the clouds. they've spawned a cpl showers during the overnight hours, but otherwise, right now, we're partly sunny, but we'll see the clouds taking over as we go through the morning hour. these clouds, part of a warm front will move in and bring the chance for a couple of scattered showers through the day today. much needed rainfall could be happening in a couple of spots today with highs in the 70's and an even better chance of a shower or even a thunderstorm tomorrow. we've got the timeline on that and show you on futurecast is remembering a woman found dead with a gunshot wound in her dunbarton home. they're looking for answers.
