the senate, there are three solid no votes including mike lee of utah saying they should not put it up for a vote but senate majority leader mitch mcconnell told the associated press, quote. so, joe, just for some context here. we talked about 27 no vote according to an nbc news count in the house. they can only afford to lose 22. as of this moment this cannot pass the house but there is still time as the vote is tomorrow. >> there is still a little time but this is a massive bill and, you know, for republicans who said that the affordable act was pushed through by barack obama, we were talking about that for six, nine months, maybe even a year. this is just -- they are doing this in an extraordinary speed and, you know, mark halpern, what is so surprising is this is an even a bill that donald trump, himself, promised his voters he was going to pass. he has one broken promise after another broken promise after another broken promise in here. and so for him to say promises made, promises kept, something that we also used in 1996, actually, that's probably going to fall on deaf ears with voters because this doesn't do anything, it

mitch mcconnell are not going to hold their republicans together. they won't make it a 51-vote threshold. i don't see that happening because we just saw senator ted cruz and mike lee both say they are willing to go nuclear. sow i think the republicans will be able to get this passed no matter what resentment the democrats have. uma: how much do you think this executive order will pick up steam. >> it's a big subject in the eisenhower building. tuesday with all those cameras in there, they will make it a referendum on the refugee ban. it didn't matter what they were suppose to be in charge of. if they were the secretary of education, global warming. the immigration ban. the democrats know this case is moving quickly toward the supreme court so they will try to nail judge gorsuch down on that. uma: do you expect judge gorsuch to give much detail in terms of the way he thinks and feels about these issues, or do you think he will be cautious in his answers to the senate. >> his career has shown he's a cautious man. i think what he will show about what he believe is he's a judicial conservative in the vein of scalia. what he's going to try and show is his ruling won't

mitch mcconnell. portman and shelley caputo of west virginia, lisa murkowski of alabam alaska, they're all concerned about losing medicaid funding in their states. then there is mike lee who we saw in sunlen's report. lindsey graham has said this is moving too fast. this morning, arkansas senator tom cotton said we should be taking time, we should not be voting in a couple of weeks. you now have eight republican senators who are coming out and saying, wait, stop, slow down, there are problems. can trump call them up, twist arms? let's see. but that's a lot of concern on the republican side. >> so kayleigh, if you're advising the president on this, you're sitting next to him, and you're reading him the report that jamie gangel just brought us about these eight senators, what do you tell them to do? >> look, i think president trump, despite the reporting, has written to be very confident. if you look at his first tweet about this bill, the interesting word he used was negotiation. this is why president trump was elected by the american people, because he can negotiate. this bill was intentionally put forth as less conservative than it will end up being. why can insuranc
