and blackburn's bill says that. second, they put all of the regulation over at the federal trade commission. so we're going to be in the same regulatory environment. one of the difficulties when you have an area like privacy if one agency is regulating over here and another agency's regulating over there, you can end up with disparate be treatment even if the general framework is relatively the same. so it's important to us, i think, that we're regulated in the same place. and third, the other thing and the final thing i think that blackburn's bill does is that it insures that we don't end up with 50 different state regimes around privacy. to there's a preemption, there's a federal rule, there's a rule that everybody has to live with. and it's not going to be a patchwork of a bunch of different rules in a bunch of different states. in the internet environment, that's very difficult to operationalize. believe me, we lived in this in the title ii world in terms of different regulations in different states. it gets mor

i think what chairman blackburn was doing was putting in legislation with the fcc. i think it is an appropriate inquiry whether all web browsing history should be sensitive information or whether web browsing history on particular topics, like personal finances, your kids, and things that the ftc had previously deemed to be sensitive information. i'm going to say that i agree with bob. this is a draft of the legislation. we will see how it plays out. but i think the discussion of whether all web browsing history belongs in the sensitive information category, or whether just certain web browsing history belongs in that category will be something that there could be a discussion about during the consideration of her bill. >> the groups that were out doing back flips over the fcc taking that position with respect to the isp's are either silent or opposing chairwoman blackburn's bill on the same topic when she takes that rule and applies it to the entire industry, which i find it -- which i find remarkable that companies or organizations that are supposedly privacy orga

greg: well, chair blackburn, as you know, has been -- she's chair of our subcommittee on technology. she's very bright, very capable, and very committed to the cause of data privacy. individual control over data. it's kind of unfortunate we're in -- part of the reason we're in this position is because the prior f.c.c. went too far the other way and decided the internet should be treated like old ma bell. and went into title 2 common carrier status which meant that the federal trade commission no longer had jurisdiction over those sorts of issues because they don't have jurisdiction over common carriers. only the f.c.c. did. which meant the f.c.c. had to come up with their own rule, then even though wheeler said they didn't need them, they created them, they were never enforced, we repealed them and we got blamed, including billboards in districts saying we're selling people's privacy. none of which is accate. there are other laws that supersede. but it really opened the door to this debate now on privacy. she's a very thoughtful and capable legislator and a determined one. so i would
