and rejoining us now, ron klain and joyce vance, both back with us. ur experience, it's tricky dealing with leaked material, like from grand juries or testimony like this. but from what you hear in this, what is your reading of it? >> this sounds like a leak that was put out perhaps by someone who wanted to say, look, folks, nothing to see here. this gentleman's testimony is nothing burger because at the end of the day he says that the president didn't take advantage of the offer. of course, it doesn't read quite that way i don't think. >> and, ron klain, no one knows more about donald trump than keith schiller. probably knows more than donald trump's wives. he started working as a part time security guard for donald trump with the nypd and then full-time. and went right into the white house where eventually figured out that the secret service was in charge of security there. if there's a story to tell about donald trump, keith schillor knows that story. >> and the last person in the world to tell it. the loyalty to donald trump is unmatched and i have

joining us now, joyce vance, former u.s. attorney for the northern district of alabama. and a professor of at the university of alabama law school and with us, daniel dale, washington correspondent for the toronto star. and joyce vance, as a former prosecutor, i want you to first of all take us through this evidence package that "the washington post" revealed today and given that there's not going to be a trial between now and december 12th, how should alabama voters evaluate this? you being an alabama voter yourself. >> so the evidence we hear in this story is very distressing. in part it's distressing because of the age of the victim involved. she's 14 years old. the age of consent in alabama is 16. so she can't consent to any kind of sexual conduct. some alabama politicians have suggested today that the conduct is okay because she doesn't say that she was not agreeable. and as a matter of law, this conduct is wrong. but even more than that, this kind of conduct is a sexual assault. no, it's not rape but it is evidence of sexual assault, a very serious crime. a crime t

it is very unseemly. >> joyce vance and reverend al sharpton on roy moore in alabama. e, go. >> it certainly has been an interesting week in alabama politics. this is a former chief justice of the supreme court. twice he has been removed from office. both times it was just for an outrageous failure to follow the order of a federal court. roy moore has his own version of the law. what no one really saw coming were these allegations that roy moore was a child molester. we now have two very credible women, the details of their stories really have been -- >> you brought up a good point. he was already just an abominable failure on many levels. i'm curious what you make of this sort of known thing about roy moore never coming out before. >> i saw somebody say this morning this is one of those things that everybody knew about but that you don't talk about. and, mika, we've seen so much of that. we're having this cultural moment where women are finally coming forward. in gadsden, alabama, in 1980s, high school girls didn't come forward. they didn't talk about a powerful distri

howard fineman for the "huffington post," and joyce vance. joyce, by my reading, the nature of the potential charges here. they're investigating bribery, among other things, would be the most serious related abuses of government power that we know that he mueller has looked at yet. >> that's right. we would be looking at bribery of someone who had been selected to be a government official. it is an extremely serious charge. the fact situation is so convoluted that i think even tom clancy would have rejected it for a novel plot. it is too farfetched. the tentacles include not only this apparent $15 million deal or kidnapping the cleric and smuggling him out of the united states to turkey. but also a series of other meetings that may be potentially related. and even the effort to smear susan rice for having the whole, you'll remember the unmasking debate where susan rice was allegedly the source of those unmasking. now we hear there was a meeting between miss rice and general flynn in which he sought to have her withhold an action that would hav

attorney joyce vance, who spent 25 years as a federal prosecutor. counselor, how do you think it is the president's walking around telling people this will all be over and done with by new year's eve? >> it seems to fit in well with your overall theme tonight, which is the president's insistence on making statements that simply don't pass anyone's reality test. it's an aspirational statement at best, but i think everyone knows this investigation won't wrap up by the end of the year. >> he seems to be quoting his own lawyers, whom he called brilliant. he does have good lawyers. is there any piece of advice or guidance that perhaps is getting misconstrued? >> it's hard to imagine what it could be. and it's important to remember that ty cobb originally said that this investigation would wrap up by thanksgiving. of course we're past that date and now they've slid into this convenient fiction that it will wrap up by the end of the year, but when you think about just the work that we're aware of that's left, that's improbable if not impossible. manafort d

joyce vance is a former attorney, university of alabama law professor. what is it like down there right now? >> well, alabama certainly is not enjoying its moment in the public spotlight. this is in many ways a painful election. it's as painful for republicans as it is for democrats. there are new polls today that suggest that doug jones, the democrat, has fallen behind roy moore in the polls and it's beginning to sink in that alabama may actually send roy moore to the senate. >> yeah, we should say emerson poll has moore up by six points. there seems to be some movement back in moore's direction partly because it seems people have been able to be convinced that all of these women are liars. what do you hear when you talk to republicans down there? >> you know, republicans down here are simultaneously embarrassed by moore's conduct but very concerned about holding the majority in the united states senate. and it's safe to say that in alabama there are one-issue voters on both sides of the abortion issue. republicans tend to feel very strongly about the a

attorney joyce vance. it's so good to have you back here in new york where you belong, john. here's our leadoff question. have we entered the age of the rolling disclosure? >> i think we've been in the age of the rolling disclosure for a little while now. it's certainly the case that attorney general sessions high dujon i believe is the phrase you would want to apply to his affect now. he says "i have not lied, i have not lied" and even within the statement in which he is saying he has not lied, he asserts he has not changed his story. he's clearly changed his story if you go back from his confirmation hearings from today. if raises the question, even on the basic matter of the question of has my story changed and you're asserting it has not when it clearly has, doesn't that call into question whether or not you are, in fact, a liar? >> michael crowley, did we get any clarity today? >> not much, brian. we got a lot of lack of mental clarity. i do not recall, i can't recall. i guess that's standard for these kinds of hearings. i think one point of clarity is that you just can'

joining us now, joyce vance, professor of university of alabama school of law and a former federal prosecutor. also with us, david frum, senior editor for "the atlantic." professor vance, what do you make of the new report of michael flynn's counsel not cooperating with other defense counsel and the abc report indicating that michael flynn's counsel actually met today with special prosecutor mueller's team? >> so taken together and if true, those two reports would seem to signal that flynn has definitely withdrawn from a joint defense agreement. in fact, we hear from trump's lawyers that that joint defense agreement, which is an agreement that targets or subjects of an investigation, conspiracy, will form together so that they can share information but retain its shielding from disclosure to the prosecution via the attorney/client privilege, typically you have to withdraw from that type of an agreement once you begin to negotiate a plea deal, a cooperation deal, with prosecutors. it locks like that's what's going on here. it's just difficult to know whether it's still being negotiated or whet

attorney joyce vance. julia, let's start with you. what could robert mueller -- and we don't know whether the guy who is not in the jail he was in before, the incarceration of before, we don't know whether mueller has access to him right now but what do we think mueller could do to this guy if he's talking to him? >> if you had not heard of reza zarrab before today, i would not blame you. this is smaller than the big one. robert mueller's probe into russian meddling. why he is important to that case is he is a turkish-iranian businessman in incarceration in the u.s. for skirting iranian sanctions and someone that the turkish government is worried about and pressured fir his release because they're afraid he will cooperate and the information the turkish government doesn't want is influenced former national security adviser michael flynn. we have reported last week, of course, senior turkish officials who may have met with michael flynn and robert mueller is looking into that to see if they tried to bribe him to drop the case and force

joining me now, joyce vance, a former u.s. attorney for alabama. considerly a visiting professor at the university of alabama school of law. thank you for joining us. >> thanks for having me. >> let me start here, ms. vance. how much legal exposure does donald trump jr. right now have just based on what's out there? >> so this is i think the first information that we've seen that would tie trump more firmly to a potential conspiracy. but of course conspiracies are only illegal if they have an illegal objective. so the question is, what would these direct messages tend to prove? would it be hacking? would it be receipt of stolen property? coit possibly be a conspiracy to unlawfully involve a foreign government in a u.s. election? i think those are the possibility that are on the table although i don't think there is firm evident based just on these dms. >> can you prove that because there was publicly the government went public with its accusation that wikileaks was an arm of the russian government that donald trump jr. then should have known immedi

joyce vance is a former federal prosecutor. thank you both for joining us.hat i'm going to try do here is match the reporting up with the idea with what trade craft tells you about prosecution. so i'll start with ashley. this subjective worry. some people are worrywarts some aren't. how do you cities still out of that how far this thing is going to go? >> the only person who knows what they're talking about is mueller, and he's not talking. and everyone else is making their best guesses there are a number of staffers i spoke with who say and seem to mean they're not worried. they say ty cobb, who is the lawyer who is handling this has reassured us. originally said it would be over by thanksgiving. that's obviously not the case. look we did nothing wrong. we have nothing to worry about. and then there is other people in the president's inner circle, and certainly people close to the probe who say that's very naive. the way things like this work is it starts off less damning and you sort of work your way. in the fact that he went after people, gates and manafo

joyce vance, response from trump side. no one should draw the conclusion this means anything about general flynn cooperating. what was not entirely unexpected was that flynn may be discussing a plea with the especial counsel. as lawyers, you and i both note the use of the double negative and whether this was expected or not. issue is not who was expecting what, the issue is whether mike flynn, national security adviser, a high level post, has information that bob mueller believes is credible about crimes committed by other people at least equal if not higher level. >> the president and his team took a lot of steps to keep mike flynn in the fold. repeated comments from the president talking about what a good guy flynn was, perhaps hinting at pardon for flynn. but end of the day what weighed on flynn was liability not just for himself and for his son. they were both around. we were told that flynn was the trump whisperer, on the plane with trump every day flying around. had enormous opportunity to observe. whether his observ
