mulvaney. washington post reports president trump is considering naming him to run the consumer financial protection bureau on an interim basis, possibly setting up a watchdog agency for a massive overhaul according to people briefed on the planning. that potentially set up a watchdog agency for a massive overhaul look like? guest: first of all there is some limit -- when you say overhaul, certain things would require legislation to actually change. culminating --r. mr. mulvaney. quite frankly there are other names being floated before then. i had not thought of mr. mulvaney. i think he is a perfect choice. he has gone on to the record saying harsh things about the agency, for the reason i think he is a perfect choice is first of all he does understand the agency and the issues. second of all, he is kind of the counterpart to elizabeth warren and that he does what he thinks, he's very straightforward and not intimidated. job forbe really hard republicans to fix what is wrong with the agency now

and gabby, nick mulvaney running both of these agencies. how is that allowed to work?> well first of all, poor nick mulvaney has a ton on his plate considering both of roles he's likely to play but the trump administration signaled early on they want to hollow out this agency. they didn't think that it was doing a good job or that it was really carrying out what they would like to be doing under this administration and so i think that was the primary reason and putting nick mulvaney in this role as interim director but it is causing controversy because there are conflicting statueutes here. one that directors that the director of the cfpb could appoint a acting director but another that allows the president to apoint somebody to fill a vacancy permitting that they are -- if they are actually confirmed by the senate in order to fill that vacancy during the interim. so there is a question here of who is going to play this role going forward until we have a permanent director and i'm eager to see how this plays out. >> interesting. and jonathan, what is mulvaney's history

mulvaney was not to be deterred. not just legal memos that show that president drum, not a leftover obama appointee has the executive power to install an acting voice, boss. he was also armed with doughnuts. a shopping bag. he marched back into the agency about 10:00 a.m. and issued a memo telling all staff to do two things, ignore all instructions from english and come get some doughnuts. here's what all this matters to our viewers. this agency created by then president obama, who initially installed elizabeth warren as the chief before she became a senator and the office quickly became a flash point. created by the frank act after the financial crisis, democrats insisted they were putting in safety valves for consumers while republicans charge regulations on auto lending actually made it harder for average americans to get auto loans. >> congress doesn't appropriate funds directly like it does for every other agency so you don't even have real accountability to congress. there are just no checks and balances on the

that was a reference that mick mulvaney made. she was too busy talking to them and not doing her job. do not show up for the job today. it is confusing for the workers, this is what is going on. they do not know who to answer to. again, it comes a time when the administration is going to try to force this issue that mick mulvaney said, i think reporting from the white house, you would he was never a fan of this institution in the first place. >> no, and you got three different things going on with the story. let me break it down the political intrigue of this in which you have the white house, department of justice, the cfpb's own attorney saint, mick mulvaney is the boss here. he should be the one in charge. then you have democrats and leandre english, they cite the 2010 dodd-frank law, she should be in charge, and i have two different people who think they should be the head of an agency with this now going to court. one of them showing up to work today, one night, sending emails, simply do not talk to the other, that is the fi
