greg craig, if you represented this president, how willing would you be to produce him to bob mueller? >> well, mike, i'd be very reluctant. president trump like every other american citizen has a right to remain silent and to weigh that right and go in to either testimony under oath or for an interview puts not only his personal freedom and future in jeopardy but puts the office in play. i think the factors that went into the decision and the advice that president clinton made in august of 1998 to testify in front of the grand jury are the same factors that are being considered by mr. trump's lawyers today. and i think any lawyer is going to be very, very concerned about exposing his client to examination of -- while he's the subject or the target of a grand jury investigation. >> so let me ask the direct question. do you anticipate that president trump at some point in the future will be invoking his fifth amendment rights? >> well, i think there's clearly going to be considering it. i don't know he'll invoke it, his constitutional rights. but they will clearly consider that and make a decis

is it that paul manafort is arguing that doesn't jive with what he's being charged with by bob mueller? >> well's arguing that mueller's mandate is too broad. that the order that was written instructing mueller how to proceed violates the special counsel rules. as the legal scholar kathleen clark has pointed out, the order did not cite the special counsel statute. it cited some other laws and appeared to give mueller very broad authority to investigate whatever he deems necessary. and rosenstein testified that mueller was well within his mandate. the other point he's making, he was investigated in 2014 for his work, consulting in ukraine and for his offshore banking. he was interviewed by the fbi and no charges resulted. and he's saying it's unfair that mueller came in and undied me on this. but we know that mueller's team learned a lot of new information from the searches of paul manafort's apartment and subpoenas and other forms of information. so most legal experts think this is not going anywhere. >> does manafort's lawsuit have any merit? or is this some kind of legal tactic on throw up ro

. >> the first one is if you believe that there is nothing, why wouldn't you sit down with bob mueller? >> well, again, that's a decision for the attorneys. but, you know, there's a reason we hire lawyers to know the ins and outs of things. >> he said he was 100% on it. what changed? >> well, no. i can tell you for myself who has been through more than one lawsuit, you do listen to your attorneys. they're the professionals. >> they don't keep you from doing something. let's look at it on the second level. he says there's no collusion. you, the president, you have every right to say that. that's your opinion. he also says it's been determined there has been no collusion. that is not true, congressman. >> well, there's no indication certainly that's come out that would suggest otherwise. >> we haven't heard anything yet. mueller has done nothing other than some indication of indictments and deals that may be going on, but he has not issued any kind of determination to make that statement true. the fact that he hasn't said there is collusion doesn't mean there is no collusion. do you understand wh

what's the significance of that to either the committee investigating russian ties or perhaps bob mueller? >> well, the mueller side of that is an easier question, which is i think that there is no significance to what he will or will not talk about to the committee to mueller because the committee and mueller are differently situated with respect to the witness. the claim of executive privilege has a lot more force with respect to congress than it does with respect to the special counsel. my understanding, as you reported, is that bannon has said that he will fully cooperate with mueller and not assert any privilege in that regard. and so i think the point there is pretty muted. with respect to the committee, it might be much more significant in the sense that if the committee decides to try to compel answers to the questions he's refused to answer, the fact that he alluded to or talked about certain conversations may undermine the white house's assertion of a broad claim of privilege there. it may not, but it really might. >> and, paul butler, how would you use someone like steve bannon as a wit
