mr. mueller and that seems to have died away. expect that he at some point will give an interview? an interesting question. it certainly hasn't died away among the lawyers. sooner or later something's going to happen. either is going to get interviewed by mr. mueller or ift any preconditions, push comes to shove, a grand jury subpoena. i think that's extreme but i think one way or another, mr. mueller is going to want to talk to the president. and its not going to be done by simple question-and-answer. is probably going to be done in person and i imagine the lawyers are just figuring out the parameters of that interview. -- but i would imagine talks are still going on. david: we don't know the merits of this case one way or the other. does the fact that mr. mueller appears to be prepared to interview the present indicate anything about the timing, that its unlikely he's going to get more than one bite of that apple? and doesn't deck him at the end of the investigation? jeffrey: i think that's fair, maybe with a little cleanup alo

mr. mueller and mr. rosenstein swore an oath to the constitution. because they will not pledge their loyalty to him, he is bound and determined to stop the investigation into his potential wrongdoing. but the republican leader has delayed bringing forward bipartisan legislation to protect mr. mueller from arbitrary dismissal. in light of recent events, congress must act. the special counsel needs protection to do his job. he shouldn't have interference from the president and his partisan supporters. in the senate appropriations bill for the department of justice, i included language directing the department of justice to abide by its current regulations for the special counsel, but it's clear to me we must do a lot more. during the watergate investigation, eugene mccarthy said, and i quote here, this is the time for all good people not to go to the aid of their party but to come to the aid of their country, end quote. it is time for all members of congress to come to the aid of our country and ensure that mr. mueller and his team are able to gather

mr. mueller will tell us about all things russia.it is out there it's out there. >> sandra: let me give you the timeline here. pete king is suggesting we could see the democrats' memo by this weekend. that is the deadline saturday is the deadline by which the president has to make a decision as far as the immediate future, john kelly has given the white house lawyers until the end of day today to review that memo. >> yeah, it could come tomorrow or saturday. i think the president does have to release it. it will look too partisan if he says only the gop memo can be out there. it is smart to avoid the redaction war and let the f.b.i. do it as we said there. there is a greater problem here that there is underlying intelligence and the fisa application itself that a lot of people haven't read who are on these committees and that the american public might like to know more about. that's what this really is about here, the application process and how the warrants get granted. we hear a narrative from either side that totally doesn't match

mr. mueller and supervised by the acting attorney general for this investigation rod rosenstein, a proven professional and deputy attorney general. maria: well there's a lot of conflicts around the special prosecutor's team we know that but that's putting aside because i know you recused yourself but there are felonies apparently that have already taken place. we had on this program just last week the chairman of the intel committee devon nunes and he said there are felonies that are going not looked at at all they're going by over and over. listen to what he tells me just last sunday. >> the big felony in all of this that nobody talks about from the very beginning was the leak of highly classified information when they leaked the phone call of the russian ambassador talking to general mike flynn right before the inauguration. that was a felony, nothings ever been done about it. maria: is your office investigating this, sir? >> that is ava o legislation of the law to leak classified documents and it is being investigated. i will say this, there are last two years before i became attorney

mr. nunes and his staff right in the middle of mueller's investigation. if what they were doing was trying to impede the investigation and working with the white house to do so, that constitutes a conspiracy. at least it's a plausible argument that i think mr. mueller be investigating. >> it is the case that nunes has always been somewhat cagey about the fact that he, whether or not he was coordinating with the white house. do you think that's why he has been unclear on that point? >> well, he was asked by congressman quigley directly whether or not he had coordinated with the white house. he demurred to that. but when he was asked whether his staff had coordinated with the white house, he refused to answer. when mr. trump was asked about what the point of this memo was and whether or not it might be used as a basis to fire rod rosenstein or -- and otherwise interfere with the mueller investigation, he said basically, that's pretty likely. so i think all of these things point to a very important thread of mr. mueller's investigation in whether or not devi

mr. mueller should be fired?> no, i do not. >> has there been discussions in the white house about firing him? >> i would not tell you about discussions in the white house, but i will tell you nothing i ever heard like that. >> i never felt of all the things that we went through in the west wing, i never felt that the president was going to fire the special counsel. >> is he putting a lot of weight on the word feeling there? >> i want to turn this on you for a second. we talk a lot about constitutional crises. the fact of the matter, america really has not had many constitutional crises, in watergate, the supreme court did a ruling and nixon complied. george wallace stood in the courthouse, on the schoolhouse steps got a court order and allowed federal troops in. if i were robert mueller, this is my fear, this is a different america with a different president. he goes to subpoena donald trump, he doesn't go. they go to court, they get a court order and he doesn't go. american democracy and these institutions of l

mr. mueller. >> shepard: remind us what the beef is with gates. >> sure. hell, with gates and manafort, it's money laundering. mr. manafort was active overseas along with collecting money in the ukraine and other parts of the caucus states. set up companies overseas. the money was deposited in the companies and brought to the u.s. in the forms of property transactions and buying luxury items: there's a tax allegation that he didn't declare it. >> it's interesting the investigators have hired a number of prosecutors who specialize in money laundering. >> that's not a coincidence certainly. these guys have been down this road before. if you look at this case, the mueller team moved very quickly, this is a somewhat complicated case to put together. you have to get records from overseas. normally not an easy thing to do. you need to tie various companies to mr. manafort and mr. gates, which they did. you then need to follow the money to the u.s. and the property records in which that i did and did it very quickly. if you look at this case, it was done in a matt

mr. mueller found out about flynn's conversation with a russian. then apparently, he didn't say anything wrong. "the washington post" got ahold of that transcript and according to "the washington post," they're no friends of donald trump, they said mr. flynn said nothing inappropriate or nothing that was wrong but maybe flynn had been told differently by peter strzok when he was interviewed. >> that is possibly true. it is interesting once to see the information, potentially, cull paer to information is turned over to the defense we'll find out exactly what the judge has in mind here on that particular issue. on that issue. david: there was another charge today by the mueller team. this is an attorney who used to work with paul manafort and the charge was related to something that happened long before the election. it happened in 2012 when manafort was doing work for the ukrainians. the charge was he lied to the fbi. if in fact the flynn charge is reversed who will believe any charge from the mueller campaign regarding lying to the fbi? >> right. s

that as we learn mueller plans to speak to the former spokesman for mr. trump's legal team, mark corallo. >> it's a significant development considering news from the "times" that could bring long-time trump aide and white house communications director hope hicks into mueller's crosshairs. the "times" citing three people familiar with the situation writing mr. corallo is planning to tell mr. mueller about a previously undisclosed conference call with mr. trump and hope hicks. mr. corallo planned to tell investigators that miss hicks said during the call that e-mails written by donald trump jr. before the trump tower meeting in which the younger mr. trump said he was eager to receive political dirt about mrs. clinton from the russians will never get out. that left mr. corallo with concerns that miss hicks could be contemplating obstructing justice, the people said. while nbc has not independently verified the "times'" reporting, an attorney for hope hicks denies she ever said this, adding another layer to the investigation, cnn is reporting that the presiden

mr. mueller, the special counsel. we've given them documents, time.oney. >> joining me now, two of my favorite writers, good to see you guys. phillip, does the memo absolve the president of anything? >> i was wondering what you were going to say there. of anything? i don't think so. we saw a pretty impressive bit of goalpost moving by representative turner who said this was about using campaign information for an investigation. there were several layers between the campaign and what actually passed to the fbi but also a bad argument on its own merits. the memo itself essentially demonstrates, it misrepresents sort of the pathway for a certain set of information compiled by a former intelligence officer who had been a source to the fbi in the past, which is mentioned in the memo, that this was one part of one part of one part of the mueller investigation. it is a small subset. and it's hard to see, honestly, based on what came out yesterday, compared to what the news reports had been, it's hard to see what new information we got yesterday at all. >> se
