the case after conservative justice antonin scalia died suddenly. it's now expected that trump appointee justice neil gorsuch will break the tie. for more, we are joined by amanda shanor, staff attorney at the american civil liberties unionich filed an amicus brief in janus vs. afscme in support of afscme. she also is completing her ph.d. at yale law school. her recent piece in the nation is headlined "public-sector union fees don't violate the first amendment." why don't we start there. talk about the basics of the case, who is janus, and take it from there. >> i am excited to be here. janus is a public sector worker in illinois and he has brought a first amendment claim against an illinois law that authorizes unions to collect dues not only from members, but from people who are nonmembers, but employees the union was legally provide services to cost of for instance, if a nonunion employee has a grievance, the union still has to represent that person and grievance procedures. with illinois law does is permit the union to charge those fees to the nonmember workers, but a lower fee called an agency fee or fair share fee. is climbingas and first amendment rights that he does not have to provide payment for the services tha

conservatives were upset because they seemingly changed that under pressure. but a call for bipartisanship is a call you get in every state of the union. "a new american moment" captured it better. by the was a hugely successful speech. 75% of the country thought it was a good speech. when there is good coverage for trump, the press is eager to move on to what they are comfortable with, a lot of hostility for trump. howie: it strikes me as an example of the press judgingly giving this president -- grudgingly giving his president credit. jessica: it's difficult to grade people on both sides of the aisle. comments that today is the day he becomes president, and the next day he tweets something crazy. van jones instead of saying he did a great job, he read well from the teleprompter. he said he was delivering sweet-tasting candy with poison in it. and i agreed at that point. i think the coverage of the state of the union was quite fair. i didn't see a lot of people criticizing the democrats looking very sour. plenty conservatives looked sour with obama. howie: trump got a very big audience. more watched on fox news than any other network. then he said it

i think the gop lost its whole concept of financial restraint. matt schlapp with us, american conservative unionl right, matt, where am i going wrong here? because i have got to say i'm disappointed with the gop for all this spending. >> i agree with you, stuart. i think it was an unwise budget deal that they negotiated. in all candor the republicans had to negotiate with the democrats because they don't have those 60 votes in the senate it takes to run the table but i do think the republican party needs to realize they have to win these spending fights. we just had this shutdown showdown. it was trump versus schumer. the republican won. it turned around, seemed like we caved too many things to get a deal. too many republicans don't want to make the spending fight. stuart: i think what the gop did was to juice the economy any which way it could, on the ground that come november, prosperity will win them the election. so they sacrificed fiscal restraint for a whole bunch of spending which they think will win the election. is that a decent calculation? >> i think it's a decent calculation. look, t

the left, we'll, quote, lose our country to tyranny. addressing a group of conservative activists in 2014, he said the left increasingly elects ideological storm troopers to congress. after he was nominated, the american civil liberties union criticized his nomination because he had previously claimed that muslims had a deficient theology and flatly stated that all muslims stand condemned. when i met with mr. vought, i asked him to clarify his inflammatory rhetoric. i always think it's important to give somebody a chance to break from the past, and i hope to hear a softer approach. he chose to stand by what he said and in fact he doubled down. so i want to close with this. in my view, nothing should have changed in the time continues mr. higbie, reverend johnson, and mr. bradfor bradford -- this incendiary, vitriolic is disqualifying. one of the first requirements of nominees for public office is to respect americans from all walks of life. this is true when you're talking about a position like the budget deputy director which holds enormous influence over the federal budget. mr. vought has a claire documented record -- clear, documented record of disrespecting and demonizing those who think differently than he does. he co
