joining me now on the phone to help break all this down, fox news senior judicial analyst andrew napolitano. judge, we really up prescient you being with us tonight on short notice. let me start by asking you to give your legal take on one of the elements of this that people are really focusing on which is the fact that it was all such a long time ago. that cavanaugh, at the time of the alleged incident was 17 years old. what does that mean from a legal perspective? >> good evening. it's a pleasure to be with you. i'm sorry that i'm unable to be with you in studio. i don't think his age is significant, but legally that is to the prosecutorial mind if this was presented as a case because 17 is certainly above the age of reason, and if this happened as doctor ford claims it did, it would be worthy of investigating but where this significance is is the passage of time between the alleged event and the present. bret cavanaugh has undergone six fbi investigations, for his work at the white house and three for various level of security clearance, one for the judicial position he now has it which

implications from these allegations, we are joined by fox news senior judiciary analyst, judge andrew napolitano. what's your take? >> on the political side, i agree with everything that bret baier just said. let me tell you what's going on is to speak. their republican members of the committee -- of the senate judiciary committee -- lobbying chuck grassley for a closed-door hearing for their public is her saying "well, that's insane. these allegations are so incendiary, the public needs to see them. the public needs to see and hear dr. ford. the public needs to see and hear judge kavanaugh and his denials." and they will make up their mind. democrats are saying, as bret pointed out, there is more than just her allegations. there is what she says she told her therapist, there's the therapist's notes, there is the polygraph. all of this needs to be examined by the fbi. and the fbi needs to interrogate judge kavanaugh. there is the jewish day of atonement starting tomorrow night at sundown. how can we possibly get all this done in three or four days? scheduled public hearings, and scheduled next w

judge andrew napolitano, help me with this. he's tempting, go ahead, kick me out.t did you make of what he's doing and whether it had in effect? >> i think -- good afternoon, neil. a pleasure to be with you. i think what he was saying is this a sham rule and the rule to which he was referring was a procedure whereby a senate judiciary committee staff member on her or his own can designate documents as confidential when and after they're designated confidential, the members of the committee can see them but not refer to them in public. as it turns out, the documents in question which were some e-mails by brett kavanaugh when he was in the white house and talking about scholarly opinions of roe v. wade and how aggressive police could be in the months after 9-11 had been marked confidential by a senate staff member. but through negotiations between republicans and democrats in which senator booker did not take part, the confidentiality was lifted. so at the time he made his grand display at the judicialry committee hearing, judge kavanaugh sitting there waiting to be

judge andrew napolitano joining us. judge, this is not a court case, but it is the court of public opinion. >> the court of public opinion. if our colleague is an adequate sample of it, it's that she is extremely credible and rachel mitchell not only is not laying a glove on her, but, in my view, is actually helping her credibility by the gentility with which these questions are being asked. and the open-ended answers that the witness is being permitted to give. the president cannot be happy with this. the white house team that has advised judge kavanaugh for two months now cannot be happy with this. judge kavanaugh is an academic jurist. the court room in which he operates is not one like you see on television with lawyers shouting at each other and trying to intimidate witnesses and juries. they engage in academic arguments. he's got to show that mantle. he's got to become a person inflicted with the most righteous examination in order to overcome the extraordinarily credible performance that his accuser has made so f

john: joining me is fox news senior judicial analyst, judge andrew napolitano. judge, dr.ford, who made these allegations 36 years ago, seemed they had these allegations for some time, they came out after the hearing. they had the judge there for 32 hours in congress. now it looks like they will have to reconvene. not talking about the veracity of these comments, that's almost impossible to tell. why did they wait so long? >> who knows. one argument is senator feinstein, a fierce opponent of judge kavanaugh's confirmation, kept this to herself as sort of a hail mary pass. she had known about it since july and that argument says she should have told the chair of the committee, senator grassley, and should have told the white house so they could discuss it with the nominee. the other argument is the letter that she got said do not tell anybody, do not reveal my name, i'm not prepared to go public on this and she was honoring that person's, we now know who it is, dr. ford's wishes, until some website got ahold of this and revealed the existence of the letter. we will probably

judge andrew napolitano wrapping up some thoughts here and obviously we said this was a roller coaster judge. your thoughts on the end of it? >> i'm in general agreement with all of my colleagues. i had characterized the position of the nomination as a very perilous at 3:00 this afternoon, and as judge kavanaugh, being at the bottom of the hole, he has dug himself out of the hole and came back swinging about as effectively as any human could. if you are looking for an excuse or reason to vote for him, you have it. if you are looking for an excuse to vote against him, you have it because dr. ford was also credible. i do commend of the republican majority for recognizing about halfway through the afternoon session that the prosecutor from arizona was doing them no good and that the senators should be free to make their own statements and their own interrogations and i'm glad they did it. i don't know how this affects the outcome, i think it's pretty much a wash in terms of the credibility of each of the principles. >> bret: judge, as always, thank you. final thought. does he get through?

judge andrew napolitano to talk about this based on what we think we know right now.. >> federal law requires that the department of justice be run by a person who has been nominated by the president and confirmed by the senate. jeff sessions runs the department of justice except for all things mueller. that means another human being, if rod rosenstein leaves, who has been confirmed by the senate, would be in charge of bob mueller. now the next person down the line as kathryn nicely report is noel francisco, a former clerk to justice scalia, a person very well-known in the federalist society of conservative lawyers in d.c. from which brett kavanaugh has sprung would be the person who would be mueller's boss. but mueller's boss must be a human being confirmed by the senate. the president perhaps is firing rosenstein and perhaps wants to advance someone to replace him. it is inconceivable that person would be confirmed before the mid-terms. if the democrats advance on their agenda in the congress it's inconceivable that person would be confirmed in 2018. we'll see where
