brinkman: thank you, mr. oliver. next speaker, please. consensus hands, please. >> [reading of names] >> i have 23 seconds on it. thank you. i started taxi drivers in 1968 when i came to the united states and i was a single father. so it was a good job for me. and about 10 years later i got a medallion. now forget all of that, the thing is that when the m.t.a. took over they have done nothing for the taxi industry because there is no communication between the drivers and you. we have a bar in the middle. it's called the townhall meetings and this and that and many good ideas get put out there and you never get to hear them. the most important idea that you can understand is we need more taxis in this city and the thing that you have neglected is an app. we have been asking for at least 10 years for one app. and you have got to knock the taxi companies' heads together and say, within one month or whatever, we want one app out there. we want faster response. we want every cab taking a credit card. and not messi

brinkman: you are, okay. director rubke. >> commissioner rubke: i wonder if you could clarify the extent to we as an agency are allowed to regulate the t.n.c.s. >> well, that's a great question and we certainly have weighed on that multiple times with the california public utilities commission rulemaking proceedings. so the m.t.a. has limited jurisdiction and right now because the cpuc has jurisdiction, it is not something that's within the m.t.a. jurisdiction. >> if i could just clarify, so we have general jurisdiction over parking and traffic, the general parking and traffic rules in the city. so to the extent that a t.n.c. or any other vehicle is in violation of those, we have an enforcement authority, no different than we have over any vehicles. so it's not that we have limited jurisdiction with respect to the t.n.c.s. we have no special jurisdiction with respect to the t.n.c.s. we have been fully been preempted by the state of california through the california public utilities commission in terms of our

board of directors kristina rubke is here, but i also want to recognize the chair, cheryl brinkman, is here. i did have a question for our city attorney because i know there is an appeal pending the scooter permit program and that that is a quasi judicial decision, i just wanted an answer from the city attorney what members of the board of supervisors can discuss or how we should talk about this, given that there's an appeal pending? >> mr. givner: sure. deputy city attorney jon givner. as you mentioned, supervisor kim, there is an appeal or appeals pending this program. hearing officer at the m.t.a. will decide those matters. i don't believe, although the staff can correct me if i'm wrong, that the hearing -- a hearing date has been scheduled, but a number of process issues are at issue in those appeals, and those -- those process issues may overlap some with the process questions that the m.t.a. will discuss today. the parties in those appeals, including the m.t.a., will have a chance to fully brief the issues before the hearing and hearing officer makes a decision. as you said, the

. >> andrew son, president brinkman, members of the commission, thank you for spending all afternoonlistening to these issues. these are complex and emotional. let me mention two things. one, i think commissioner tory mentioned a letter from five of the members, three additional members have endorsed the concept, so you may have eight members of the board of supervisors asking you to consider delaying the implementation of that. i think that's important because regardless of where we find ourselves today in the decisions that we've made in the past that may have led us there, i don't think we ought to be casting blame either at the people here, you folks there, or the situation that happened. 2010, san francisco mta decided to put 1800 medallions up for sale, value their 1800 at $250,000 a piece. that represented the fact that you at the agency were creating a $450 million enterprise fund. and i think it's important to look at it as a business. we essentially created in san francisco an asset that was valued at $450 million. and we were going to then allow people to buy into that ass
