>> joining me now, nbc news capitol hill reporter leigh ann caldwell and jacob soboroff who was withe in north carolina at this hearing just the other day. to leigh ann, harris has taken the stand, i know harris' lawyer says he knew nothing about this and even if it's found that these ballots were improperly changed, that's not going to change the outcome of the election. how significant is it that harris' son took the stand yesterday and said that he warned his father? and does that mean we're more likely to hear the board say that this election was tainted? >> reporter: katy, it was extremely significant, that testimony yesterday by john harris. it really undercut mark harris' entire defense. so yesterday, while we had this riveting testimony, emotional testimony from john harris, today, we have this day of uncertainty. mark harris took the stand, insisting that he still was not aware of any illegal activity that could have taken place in his campaign. he was saying that dowless assured him that he worked within the confines of the law. but then at the very end of this section of h

. >> nbc's leann caldwell is there for us.alk us through what we've learned so far and any evidence that the republican candidate in this race knew about the operation that was being run. >> reporter: what we've learned so far is there are significant election fraud regarding these absentee ballots in the ninth congressional district. the man at the center of all this refused to testify. but it didn't matter because state investigators and his own step daughter clearly implicated him in conducting this illegal ballot harvesting scheme, including collecting people's ballots and sometimes tampering with them before he would turn them into the state board of elections. they're currently in the second day of hearing, talking to poll workers at the election board to determine if there was any corroboration between them and dallas. as far as the republican candidate is concerned, mark harris, there's been testimony that they clearly knew each other. harris and dallas. but there's been nothing connecting harris to this operation yet.

. >> lyanne caldwell is down in north carolina, has covered all of this. lyanne joins us by phone.ll this happened. the father/son drama. for mark harris to say he believes there should be a new election was pretty stunning. >> andrea, it was incredible. it was an unexpected turn throughout this entire situation. i mean, the first unexpected moment was when his son took the stand to testify really against him. and the second was when mark harris, he took the stand and continued to try to defend himself. and then he almost perjured himself until his attorney stood up and had to intervene. they went to a break. two-hour-long break. they came back, and mark harris said that he wanted to retract the statement that he made that was going to possibly give him some perjury problems, and then he said he wanted to call for a new election. it was just stunning. and especially since mark harris, throughout this entire -- since the election, he has been pushing the board to certify this race, to distance himself from any illegal activity that happened. and for him to be really the one to say,

nbc's leighann caldwell has been on the story since the beginning. yesterday was a surprise.visibly upset to watch his son go through that. walk us through where we are now. >> reporter: steph, it was incredible. no one knew except for the state investigators who called jn harris, the son, to the stand. no one else knew he was going to testify. he testified against his father. john hair sbis marris and mark not spoken since december to protect each other. it really blew a hole in mark harris' entire defense. mark harris has been maintaining throughout this entire time that he was not aware of the illegal tactics that mccray dallas used with these absentee ballots to overperform but john harris takes the stand and says i warned my father and he had e-mails to prove it. and so while we're waiting for mark harris to take the stand, which could happen any minute, it's going to be super interesting to see how he defends himself now, steph. >> it sure is. i need to bring my panel in to walk through this. guys, quickly, what's your take on this? >> i mean, for those of us with child

republicans were behind closed doors at lunch and my colleague leigh ann caldwell reported several came out and indicated they wanted this assurance from the president before they voted on it. others were prepared to just go forward and seemed to think an overwhelming vote could sway the president in favor but really deep concern about being embarrassed yet again that this president might say one thing or indicate one thing and do something else that would embarrass his republican colleagues in the u.s. senate so this again overall positive news for keeping the government open. an indication there won't be a shutdown over the weekend because congress can move expeditiously to get this done. what you just saw and heard it was senate speak for getting the process rolling, mitch mcconnell filing what's called a cloture motion, that sets up the vote that has the 60-vote threshold to get this moving and then there, of course, will be a final vote. now moving through those steps quickly takes all 100 members of the u.s. senate. they have to sign off and say it's okay for the leader to take th

. >> joining me reporter lee ann caldwell who was in the hearings yesterday.al offenses. >> reporter: yes, yesterday was quite an explosive day in this hearing. i think it was more so than what was expected. it was clearly laid out that there was fraudulent, unlawful activity regarding these absentee ballots in the north carolina ninth congress an district. there was this explosive comment from the investigators right at the start of the hearing where they said there was a coordinated, unlawful, substantially resourced scheme they called it. then we hear from lisa britt, who is the step daughter of mcrae dallas, the person at the center of this plot here, and she really turned on her stepfather saying -- implicating him saying that what he knew what he was doing was wrong and that he did violate the law and that they tampered with ballots. so that was just day one. and then we're starting day two in just a little bit. >> lee ann caldwell, thank you very much. >> wow. >> and this is still undecided. >> still undecided. tom, republicans complain about vote tampe
