>> well, the way the payments were made in the stormy daniels case may whab we'be what we're about. but lanny davis would not be saying what john reported and others reported unless he figured there was something substantial there to make the case. but does it really matter to us whether the president of the united states committed crimes while he was running for president, in the run-up to his running for president or while he was in office? >> well, for impeachment it could matter hugely, right? >> it could matter hugely but there aren't enough votes of the senate to convict him. i think impeachment is unlikely given the current set of facts today. >> john, you're shaking your head. >> i was shaking my head. prior crimes can be impeached. it happened to a federal judge not too long ago. they reached back for criminal behavior before he went on the bench and impeached him. so there is a precedent. but i don't think michael is in an impeachment hearing at this point. i think these will be broad statements. what david mentions is the payments to stormy daniels and the reimbursements. some of those l

daniel, after his death, his seat is iowa. by samuel miller of they move things around to make ynepossible for davis and swa and finally, chase to be nominated and serve on the supreme court. so there is a postscript to all of this after the civil war. i will cover this briefly and then we will think about the bigger issues here. the postscript is also very interesting, very significant for the story. theasically is this -- republicans and lincoln have added a next seat, a 10th seat. they have reorganized the circuits. but after lincoln's death, andrew johnson as president. while johnsones was president. seaton tries to fill that and the senate takes no action on his nominee. not only that, what they do a few months later after they failed to act on johnson's , they pass the judiciary act of 1866 reducing the size of the court from 10 justices to seven justices by attrition. as individuals die or choose to retire, their seats will not be filled. partially, it is an effort to keep johnson from being able to nominate any justices to the supreme court. partially a measure supported by chief justice chase who is hoping that the n
