mr. marstellar? >> regarding the idea of writing miss pelosi about the -- essentially or problems with the bankrupt ski -- our problems with the bankruptcy law and regarding public financing, the thought is that with ab -- i'm sorry, hr-1 before the congress in such a robust and visible way, which is the major reform for essentially campaign finance and all other related ethics matters, it's a very large bill put forth. in any event, that -- that was my thinking, that ms. pelosi would be probably interested in amending her own -- the bill hr-1, which she had helped to craft, and adding at this timely phase this mechanism to make sure that the public -- the governments in local level have the ability to recover lost funds that were absconded from the public finance campaign fund, which was the case in one particular instance in san francisco in 2010, when i think about 68,000 or something was not recovered. so this is very timely, this letter we're going to send, i hope. thank you. >> chair chiu: than

mr. marstellar. >> yesterday. for the record, marstellar again. did have a question regarding miss wheat's case which looks hopeless when she filed for bankruptcy. but i'm one to learn from mistakes, and i'm wondering if given the fact that miss pelosi is the speaker of the house of representatives, if the commission were to send her a letter suggesting that in the bankruptcy court system, the -- it seems that public financing funds should be a protected class so that we would have a right in the final settlements of whatever bankruptcy prose she's in for a share of our funds. it's possible that -- that we could, in fact, recover those public funds. that case was quite egregious, even though most of you missed it. but there were ten -- many cases where this person with a credit card -- i mean, an a.t.m. card -- i'm assuming it was miss sweet or her treasurer, would go to the a.t.m. and withdraw $40. and that was done 100 times. so it was clear they were using public funds as a cash cow. and now, it's essentially -- we have no rights in bankruptcy

mr. marstellar, i think the word "acted" should be inserted after "department." so it reads, "he was pleased to see the planning department acted on the issue." >> chair chiu: okay. >> vice chair kopp: i'll move approval as amended. >> commissioner renne: i'll second. >> chair chiu: there's a second. all in favor? mr. marstellar. >> yes. for the record, charles marstellar again. i was wondering if the press in particular, but i guess members of the public have called in and tried to factor what percentage of an individual's contributions would constitute spending in a ballot measure race. so that you take prop c, for example, and if you see mr. benioff, just to pick a name, i should say, mr. smith was a major donor, then, you -- the press is able to quickly ascertain what percentage of total spending or fund raising was donated by that particular individual and constitutes what percentage of the total budget to date of the committee's spending or the committee's contributions, whatever you choose to look at. that was the question. >> i would say currently, you would -- someone looking to answer that question would have to do a little bit of math on their own, but i appreciate the suggestion and we'll certainly take it into consideration for the next round for the upcoming elections. >> chair chiu: thank you. >> good afternoon, chair chiu, and members of the c
