operations chief edward gallagher is set to describe two navy seals that served alongside him as cowardsrs. jonathan is live at the proceedings in san diego. jonathan? >> shep, good afternoon. it has so far been a tough day for the defense with testimony from a navy seal who served alongside chief gallagher. dylan delay who has left the navy testified in court that even before seal team 7 deployed to iraq in 2017, chief gallagher had talked about capturing an isis fighter. delay said "chief gallagher said if we ever get a wounded enemy, the medics know what to do to nurse him to death." that is significant. prosecutors say chief gallagher killed an isis fighter brought to him in may 2017, stabbing the fightner the next under the guise of performing surgery. the navy seal, dillon delay testified today, shep, that after the death of the fighter, chief gallagher posed for photos. the jury was shown some of those photos including one in which gallagher is seen holding the fighter by the hair with his knife in his hand. dylan dille said the isis fighter looked about 12 years old. shep? >> she

what they are attempting to do criminalize cowardness.want to, especially when it comes to our policent officer, but that is what they are doing. there is no precedent for it. i do think he will be convicted by any jury in florida. but i suspect on an appeal, cooler heads will prevail. they will say if legislature wants police officers to be criminally liable for inaction, they got to put that in the law specifically. >> tucker: it's not. and it's not. i guess that's the other question is, there's some indication that he was acting -- where were his superiors? why would this even be a question? why wouldn't his training compel him immediately to run inside? >> that's a great question. i suspect we'll get the answer.g since columbine, police officers and agents around the world have been training on the principle that you got to go in, you got to go in fast and you got to go in deadly in order to protect kids. he did not do that. i don't know if it was a failure of his own moral character, his own cowardice. or whether it was a policy. we
