acting secretary of homeland security kevin mcaleenan is essentially saying that this new rule that they're putting into place will replace what is known as the flores settlement agreement. that, as you said, allowed migrant children to be held for no longer than 20 days. as a result, mcaleenan said, that created an incentive for migrant families to come to the u.s. illegally because they know that they could then get released after 20 days. so what this new rule will do, if and when it goes into effect, would mean families will be held for much longer period of time. as you say, it could be indefinitely, but essentially it's as long as the immigration proceedings will last. the second core component to this new rule is that it sets a higher standard for the way that children are kept, the way that they are held. obviously we've seen these horrific scenes of children being separated from their parents, held in dark and dirty centers. so he laid out at length the elements they're putting into place to make sure there's a higher standard of care for these children. let's take a quick listen t

that time back then, here is what the acting dhs secretary kevin mcaleenan says about the rule. >> this of the reinterpretation of the agreement, an agreement that's more than two decades old by federal district judge. new rule eliminating the factor of fuelling the crisis. >> here is how the administration plans to close the loophole. there are currently 945,711 pending immigration cases and fewer than 350 immigration judges. all of this results in an average wait time of 713 days. some people waiting more than a thousand days. so you can see the implications of this rule that they can hold the family, the kids with the family until the court case is adjudicated. you are talking about keeping them in prison for 713 days or more than 1,000 days. joining us is julia ainsley. what currently happens if people are held until their court date and where do they go and what's the rational for this? >> it certainly caused a lot of money. >> they are released oftentimes or at least the obama administration, they would give the parent ankle monitor so they can check in and show up for their court

julia, just put this in context for me because kevin mcaleenan. >> where he's getting that from is because they used the flores justification last summer when they started to separate families. they said if the courts won't let us hold children for longer than 20 days we will just separate them and hold the parents until their court process comes over. and they said, look, we are still hampered by flores. they said we'll keep them together but hold them indefinitely. and the thing that's really hard to figure out is how long indefinitely really means. because right now if you're in detention, it averages about two to three months until youet get asylum or you're deported to your home country. but it's not clear how long it could take. but bottom line is there is no timeline. there's no day written in the calendar where it says you've been there long enough, but now you're out on parole or bond or whatever. you have to stay there. so it really is indefinite detention. that is why we expect it to come up in court to be challenged. >> let me just ask you about the time it takes. we've heard f
