is this going to go anywhere, what we're hearing from josh hawley and lindsey graham?reporter: is it does not appear likely to go anywhere. there is difficult to change rules in the u.s. senate. to do it under the normal order, you need 67 senators to vote to change the rules and certainly that's not going to happen with 53 republicans. but they could also do something called the nuclear option, which is to change the rules by a simple majority, which requires 51 senators. so you think that republicans could be in line to vote to change the rules, but most likely not because there are a number of republicans who are concerned about the precedence being set in changing the rules. they have done that, already changed the rules for judicial confirmations, but dealing with the senate impeachment trial is a whole other level that a lot of senators simply just don't want to go. one senator not eager to go that way also is mitch mcconnell, the senate majority leader, who made clear in the floor of the senate last week he's content in moving along with regular senate business,

josh hawley of missouri yesterday introduced legislation to dismiss the articles of impeachment for lack of prosecution, saying the house needs to transmit them within 25 days or they can be dismissed. i wonder your thoughts on the senate's ability to do that in a process that is actually laid out in the constitution. >> well, the senate, it seems, and as senator majority leader mcconnell said as well, the senate can't hold a trial of impeaching the president if it does not have the articles of impeachment from the house, right? that's not spelled out in the constitution, and it's not spelled out in the senate's rules except indirectly. but there is no impeachment case if the house doesn't send them over. and so senator hawley wants to find a way to get around that so that they can dismiss the articles and acquit the president. but that would require basically -- even if it happened, they would have to make it up, right? they would have to create a rule that allowed them to have a trial. because under the senate's impeachment trial rules, that trial begins -- its provoked, it's precipita

you mentioned it josh hawley. he indicated that he wants to move to dismiss the articles. will take you down the rabbit holes here, neil. there are 26 senate impeachment rules. if you're going to end a filibuster on changing a standing rule of the senate, you need 67 votes. that's going to be pretty hard to do because they treat as impeachment rules as the same as the senate standing rules of the senate. we don't know that they can get 51 votes to adopt what he's talking about here letter own 67. if they are going to get anywhere, they have to get a lot more people on board. that will be a far cry. we should know more tomorrow because they meet for the weekly lunches. i talked to the republican senator from texas. he said right now there's not a whole lot more for senators to do until they get the articles of impeachment from the house of representatives. >> neil: it takes 51 votes to get her approval for witnesses. they are open to the idea. all 47 democrats were in lockstep to push that. could you get four republicans to do that? unless that happens, this goes nowhere. >
