what do you make of roberts bucking the trump administration and siding with the liberal justices on ses, especially in an election year? >> it's a very big deal, and frankly, jake, very surprising to me. john roberts has had a handful of liberal rulings in the 15 years as chief justice, most famously, cast the deciding vote to keep obamacare alive back in president obama's first term. but these are three very consequential decisions that effect real people's lives and they were hotly debated at the court. the fact that he joined with liberals on all three indicative of an evolution of his views. you know, i think it does signal that john roberts is not going to be the fifth vote to overturn roe vs wade, and that's a big deal. that was not at all clear from his prior jurisprudence. i think we're seeing the evolution of a justice. he is not going to turn into some big liberal, but he is certainly not as conservative as the other four republican appointees on the court. >> and mary, in this world of the coronavirus pandemic some states have suggested that abortion is an elective surgery

trump, 2020. siding with the four liberal justices today was chief justice john robert as i said and this is the second time this week that he has sided in a ruling against the trump administration. in the majority opinion today, the chief justice wrote, quote, the dispute before the court is not whether dhs may rescind daca. get ready for this. all parties agree that it may. the dispute is instead primarily about the procedure, the procedure that the agency followed in doing so. well, the procedure chief justice roberts is referring to came in the form of a 2017 memorandum, written by former dhs acting deputy secretary elaine duke. her memo called the program illegal because it allows daca recipients to have benefits like social security and medicare. and allows them to legally work in the united states despite their status. chief justice roberts in his opinion says the duke memo doesn't get into the heart of daca. his words. the legal protections against deport is a. and in his majority opinion, roberts concluded that dhs must somehow offer a better explanation if it is to reconsider rescinding daca,

roberts. he continues to play an interesting role during the trump administration. >> what chief justice roberts did in his incredibly important decision, siding with justice gorsuch and the liberals in the lgbtq case and also in refusing to allow the trump administration to repeal daca is insisting that the president follow proper administrative procedures. this is what chief roberts did insidi in siding with the liberals last year talking about the immigrant status on the census. chief justice in case after case -- we're seeing this in the obamacare case and cases this we week, he'll vote with the liberals when the constitution reminds us. in institutional liists like roberts, it's really important for listeners to be like constitutional law students and understand the methodologies because you can understand the courts as the justices themselves understand it. it's a remind that, although there will be plenty of conservative decisions coming up, we have the trump subpoena cases and religious liberty cases, those could be 5-4 splits. we don't know. it's not like this has become a liberal court
