one of the authors of this time story, katie benner standing by to join us in a moment. the times is also out with another breaking story, a new yet to be released reports on the insurrection. january six, from the capital police inspector general. quote, capitol police had clear advanced warnings about the january 6th attack, then were previously known. including the potential for violence, in which congress itself is the target. but officers were instructed by their leaders not to use their most aggressive tactics to hold off the mob. this report is going to be the subject of a capitol hill hearing on thursday of this week. as you know, one capital police officer died as a result of injuries sustained during the riot. today, the president, members of congress gathered on capitol hill to honor another officer who lost his life defending the u.s. capital. william billy evans served on the hill for 18 years. he was killed april 2nd when a driver rammed his vehicle into a barricade, slamming into evans and another officer. with that, and before we bring in our other guests

joining me now, katie benner, justice department reporter for "the new york times," and katie phang,egal contributor. the katies are here for us tonight. i'm going to start with katie benner. let's talk about this. these two, mr. greenberg and mr. gaetz, reportedly shared girlfriends, at least one. gaetz called him his wingman. three greenberg friends told politico that they personally heard him boast about his 2017 relationship with a then-17-year-old they claim went on to work in pornography. it's pretty seamy. how much trouble does it appear that mr. gaetz might be in because if mr. greenberg talks, he's going to be talking about him? >> i think one of the big issues for mr. gaetz is whether or not joel greenberg gives investigators information about that 17-year-old girl you mentioned. we've heard allegations that both men had sex with her and that, you know, she was given free hotel. basically if you give an underage person anything of value, it is considered child sex trafficking under the law. that comes with a mandatory ten years in prison. and so to the extent that mr. green

joining us now, katie benner. katie, good evening. you've been covering a lot of stories, including matt gaetz. but this is one you've been on for a while. 379 people charged, and the first plea agreement. how significant is this? because many people have seen the video that people posted, the selfies, the social media postings. one assumes it may not be the hardest prosecution. but the justice department says these are actually complicated prosecutions. >> right, so to your point, the justice department has actually gone through and they have charged more than 400 people with pretty straightforward crimes, entering the capitol building when they weren't supposed to, assaulting police officers. in order to build more complicated charges like conspiracy or sedition, they need to start getting people who might have information on any plot to speak and cooperate and have their testimony and words used against their peers. so this is a really big deal for the government. >> talk to me about what's involved in this, because we've known the

katy benner, reporting on the gaetz controversy since the times first broke the story. jonathan le mere, white house reporter for the associated press. cynthia ox lee. katy, we've been hearing from you since the night you broke this story. tell us the latest news on matt gaetz. >> what we saw today in the trial of his friend joel green beerg who's accused of many crimes, including child sex trafficking, mr. greenberg's lawyer and the prosecutors in the case said they're working toward a plea deal. clearly mr. greenberg faces a lot of jail time, a mandatory of 12 years, many decades more if he's not given a break. looking at the facts all sides agree it would be best for him to come to an agreement, to plead guilty, and to cooperate in the investigation. this is really difficult for mr. gaetz because joel greenberg is uniquely situated as his lawyer said, providing information particularly about a 17 #-year-old girl who both men are thought to have had sex with and provided hotels and other things. that's child sex trafficking, a mandatory ten years in jail. >> cynthia, t

here with the latest is katy benner of "the new york times." ations a lot. and i guess my takeaway from the reporting is like, this is some real serious stuff, doesn't mean he's guilty, doesn't mean there will be charges, but if there were your best friend telling you this, you would be worried for them. >> it's a worrisome investigation to be sure. i think one of the things we should be looking at is the timeline. we know investigators have been to go mr. greenberg for about four months, learning as much as they can from him. he's not what you would call a truthful person, as you can see from the indictment. he's lied before, there's no reason for investigators to believe anything he's ever said. so they start to gather evidence, including at least two key cellphones we know of, one from mr. gaetz and one from mr. gaetz's girlfriend. they did that at the end of last year. they can verify some of the things that greenberg told them. they can see whether or not they discuss it and whether or not they had any worries about that investigation. >> s

with me now, one of "the new york times" journalists behind this in-depth reporting datie benn -- katie bennerrt with you first, katie. you have seen the cash app and apple pay receipts as well as evidence of congressman gaetz telling women where and when to meet and how much money he was willing to pay. how detailed are the discussions? what do they tell us? >> i think what you would want to look at is the receipts wind up next to the messages asking women to come meet at a hotel that say where and when to meet with the message also saying, and there will be, you know, $1,000 for you, whatever dollar figure there was in the message. i thing investigators will look at that as well to see if they can prove using those types of receipts and testimony from the women involved, that the cash was, indeed, in exchange for sex. because if they cannot prove that, they can't prove prostitution. it is not illegal to give gifts. it is not illegal to rent hotel rooms for people. what they want to do is actually prove that causal link. also, what we found in our reporting is women told their friends and inv

. >> and "new york times" reporter katy benner, who shares the byline on the story, she joins us now.olleagues at "the times" said this former associate joel greenberg who is an interesting character in his own right has been talking to investigators since last year. what else have you learned? >> one of the reasons he's a person of interest is because his lawyer indicated very recently, as did the prosecutors that he would begin the process of a cooperation agreement and pleaing to plead guilty and get some sort of leniency from the government. what we learned is he's actually been cooperating with investigators since december giving information about people including mr. gaetz. what's interesting about this is it remains to be seen whether the information he has given is good or not, whether the prosecutors can trust him. and that trust is going to go a long way to determining whether this deal actually finally comes together in the end and gets anything from the government. >> so, does he have a plea deal or has this cooperation not yet a plea deal? >> the cooperation is not yet a

also joining us is katie benner, justice department reporter for "the new york times." it's nice to see both of you. thank you both for being here. andrew, let me start with you. the execution of the search warrants today at mr. giuliani's home and business, a lot of observers are telling us that an overt act like that, which is not something you're trying to hide from the person who is the subject of these warrants, can sometimes tell you at what stage the investigation is. is it fair to read into those actions today by fbi agents in terms of telling us where we are in the investigation? >> yes and no, rachel. the question is, in order to have the authority to do what happened today, a court had to find that there was probable cause to believe that there was evidence on those devices of a crime. so that means that they're certainly further than just issuing a grand jury subpoena for which there is no showing at all other than relevance. but it's also important to know that there really is no way for the government to get this data other than through a search warrant. i

joined by two people tonight with great insight into this case new york times justice reporter katie benner and former reporter cynthia oxny who specialized in sex crime cases. thank you both for your time tonight. what have your learned since your initial shocking report yesterday? >> what we've learned in the last 24 hours is really more detail about the alleged extortion plot let's keep in mind the alleged extortion plot is different from the allegations against congressman gaetz about child sex trafficking. that's an investigation going on for more than a half a year. what happened a couple weeks ago two men approached the congressman's father don gaetz they said in a document gaetz did provide to new york city, these men said we're aware your son might have legal issues, he might be under investigation by the fbi. we're aware this hurt him, we're also aware you have money we could use in order to do something great, bring back robert levinson, a man who diserpood in iraq, somebody who the government has declared deceased but people had been searching for a long time. they felt they had

. >> let me ask you about the other part of the story that you, the katie benner story that we read in "new york times" yesterday came out late last night. there's a second story about, gaetz having a connection to a ghost candidate, running a sort of fake candidate. it's amazing. but given the context of everything that is going on in the level of il-legality that is alleged with his friend joel greenberg. what do you make of that part of the story? >> it's completely bizarre. and i live in florida and there's another case going on just like it and another couple of people were indicted last month. it's not out of the realm of possibility in this crazy state. especially if you look at the fact that the woman who ran is now disappeared to sweden and the other person involved in it has suddenly lost his job. here's what it tells me, the fact that they are looking at it and that is the investigation is expanding not contracting it starts out with identity fraud and now to sex trafficking and now in to money pay for play on this marijuana legislation, it's moved in to prosecution and drug

. >> and katie benner, there was some reporting, you did a lot of it, others at "the new york times" did report that some people in the circle did note there was something going on. these pro-russian, ukrainian, some of them were sanctioned by the treasury department. but nobody ever took their -- you know, both hands around it and seemed to have taught to stop rudy or trump. and i think what you think the tentacles of the criminal investigation are. what you think those contacts that "the times" reported last night, that they're looking for between trump and trump administration officials are seeking in terms of behavior and departments and individuals. >> it's clear that the justice department wants to cast a wide net. you can see that in the warrant to search the devices of another russian oligarch who was being investigated for crimes by the justice department and was also involved with rudy giuliani. you can see a wider net being cast. and. and one of the things that the giuliani investigation has shown us is that people inside of the justice department also truly understand mor

michael, this new reporting by "the new york times" tonight that you have done along with katie bennerhis story to a new level. what are the important elements of it? >> it sort of gives a broader understanding of what was going on here. and how joel greenberg was going online to these websites and finding women who, you know, they were bringing in, and he was connecting with gaetz. it -- also in our story, we report that there is a florida associate of gaetz and greenberg, in republican politics in florida, who is also connected to one of these women. and it just gives you a sense of, you know, we are just trying to peel back the onion here, little bit by bit on this thing. we -- we certainly do not have full visibility into this federal investigation. it seems like, you know, a fair amount has gone on. that at least some of the women have spoken with federal authorities. and that this is a particularly serious crime because if you are convicted of sex trafficking someone under the age of 18, it is a minimum ten-year prison sentence. and that is obviously, you know, a humongous deal.
