i remind people that another officer in the minneapolis area just a couple years ago, muhammad noor,with second degree manslaughter but they also had a third-degree murder charge attached to it based on the same unreasonable risk that was taken. and the unreasonable risk is when you created an opportunity where you could actually consciously cause somebody to die or have grave bodily harm. is it fact that the taser is so markedly different from the service weapon going to be enough to infer that there was consciousness? were, the words we choose in a statute are very deliberate, and they have meaning. they're not just terms you throw out there. we'll have to go develop the case and figure out if they're going to be able to prove beyond a reasonable doubt even if it was an intentional act, if all the circumstances show it was a consciously taken, unreasonable risk, you could elevate the charges. now, i'll just say this, anderson. remember, one of the things that's very disturbing about officers when they are involved in these cases is they get the opportunity to preempt a lot of this.
