last week a gunman, an employee of vta walk into the vta rail yard, opened fire killing 8 people.basically right away. a 9th died later at the hospital. a tragedy that has absolutely shaken vta to its core and the community. vta rail service still has not resumed and we don't have a start date yet for when the commuter service will continue because they are giving employees time to mourn, seek counseling, take some time. what you're looking at now is file footage of the incident last week. police response, emergency pled cal response. this was a person, this gunman who was clearly disturbed had been angry for some time and had a large number of weapons at his home and a few with them at the scene. let's go back and take a look. >> we believe that shot that went through the window casing was the first of the three shots. that's preliminary because at the crime scene things are not done. we believe that's first and the next two shots where he shot himself once under the chin. it wasn't fatal and in the side of the head. >> at this time i'm going to open this up to any questions. >>

the vta supervisor provides is the contact team. his shikhar to allow them to get into the building. the deputies guide. the employee to the rear, the team while the deputy says get behind me. at 6.43. '09, the contact he makes entry into the 3rd floor. at 6 4321 the contact he makes entry into the d dispatch center. so they went into one room clear depth and moved into the second center to the second room, which is the vta dispatch center and they start clearing the room. the purpose of clearing the rooms to find victims find people hiding and to locate any suspects. the room is also clear to any rescue task force can come behind the initial contact team to assist any victims if they're located. as the contact team is moving through that dispatch center. one shot is heard. another worker shot of stimulus. and you'll actually hear one of the officers say their stimulus and that shot is heard at 6 4356. team immediately recognizes the situation is still dynamic and they drive towards the area of the gunshot. the contact team bypassed

the vta, what would you say? >> i would want to ask them why they let it go on, what they were doing to protect families. i talked with others who lost their spouses too. he was disgruntled. i always wanted to work alone, never wanted to work with anybody. >> reporter: that day really haunts a lot of us. investigators say the shooter samuel cassidy was a vta employee, had a long history of instability with co-workers and management. he opened fire last month. he killed nine of his colleagues before turning the gun on himself. today's meeting is with vta leadership and state legislators to decide how this will be allocated. they'll meet at 8:30. we'll keep you posted on what happens. >> what are some other areas of vta where this money can be used? >> reporter: a really good question. some workers say after what they witnessed they would like to be retrained or even be relocated from this facility. a lot of the money will go to that. overall it is looking at repairs, at rebuilding and really just overall looking a

vta light-rail service may be getting closer to rolling again. but an important funding decision still hangs in the balance. >>> good morning and thanks for joining us. i'm laura garcia. >> and i'm marcus washington. well, more than a month after the vta rail yard mass shooting, rail yard service is still halted. but today it could move forward, this is through funding package in sacramento. this is aimed at assisting workers, riders and the agency who depend on mass transit. looking at the possible money involved and that impact. kris? >> reporter: well, hi there. we're talking about $20 million in state funding to help the vta start to move forward. it will help repair the infrastructure so that those trains can once again start running up and down the rails. the state assembly bill and senate bill will be voted on today. in total they are $20 million. this would mean mental health support funding for the hundred employees who witnessed the mass shooting in person as well as the other vta workers who have continued to show up for work day after

tonight we are learning more about the gunman's history with the vta.we will use his name sparingly. sam cassidy, seen here walking between buildings in the midst of the massacre at the rail yard in san jose. today, they are releasing some of his personnel file. during his 20 years at vta, there were four incidents that resulted in discipline. all of them happened in the last two years.july 2019, sent home days without pay for insubordination. them he refused to follow company policy when he signed out with a two-way radio for his job. january 2020. cassidy and a co-worker got into a verbal altercation. an unnamed co-worker said they were scared of cassidy and if someone was to go postal, it would be him. the investigati found nothing else in back to his department manager. october 2020. he refused to attend classes citing covid concerns. wasn't resolved. and the final incident last november. he inappropriately used that two-way radio. he then left work without permission. that's what the press release outlined for us but our investigative unit dug even

just seconds after sheriff's deputies and officers enter this vta building, the gunshot that pierceds window could be heard, possibly directed toward law enforcement according to investigators. it is then followed by two other shots now believed to be the gun man taking his own life. >> i believe he either heard us or saw the lush lights through the windows. >> reporter: the law enforcement officers got there just two minutes after the first 911 call as they go up the stairs, a vta worker comes out of the building and hence the deputies and officers his key card, giving them access to the building eight minutes after they arrive. seconds later, that's when gunshots rang out, and the team, part of two agencies that team together discover the suspect, just 10 minutes after being dispatched to what is now known as one of the worst mass shootings in the bay area. >> by the size of this building, the fact that they were able to go into the office area where he was located, is amazing. they did it right. they went to the sound of gunfire. i've trained in these scenarios a number of times.
