let's go to knoxville where we find nbc's liz mclaughlin. liz, talk to me about the situation there when you think about some of these astounding numbers, how hospitals really they're buckling under the pressure of these high covid numbers. >> reporter: absolutely. it's nothing short of a dire situation. and here in eastern tennessee they're being hit especially hard. we're looking at icu beds as one of the biggest challenges here in this region of eastern tennessee. they have these community calls three times a week where they kind of talk about the capacity. and sometimes there are zero icu beds for adults available, zero. other times statewide there's between 2 and 6% available. so really dwindling, and resources are very much stretched thin. this surge is even higher. some numbers even higher than the winter surge we saw before the vaccine was widely available to the population. we're seeing more patients not only in volume, but they're sicker. so more patients on ventilators, more patients that need icu beds, and of course that's putting

joining us in knoxville, tennessee w the latest is liz mclaughlin. >> reporter: it just goes to show reporting really grim numbers. here in tennessee the recent steep surge is putting a strain on hospitals. we're in knoxville in the eastern part of tennessee where it's been hitting especially hard. we're at the university of tennessee medical center, the only academic medical center in this region, and we're going to speak to a doctor here with an update in a few moments but a couple of days ago as you mentioned only six icu beds left in the entire east part of the region. those icu numbers change constantly, but it's a low number and it's putting some stress on this system. now part of when icu beds free up, some of that is because someone might die from covid-19 and we're seeing a majority of those deaths a steep increase in mortality are with unvaccinated patients and the vast majority, talking like 97%, sometimes more, that's a trend we're seeing nationwide so there is a parallel here and this surge is some higher averages than we've seen since the winter surge, with a largely un

. >> nbc news correspondent liz mclaughlin is in austin, texas and nbc news white house reporter lauren egan is traveling. what can you tell us about this new restraining order, liz, that was filed by planned parenthood and what this means going forward? >> reporter: so travis county district judge did grant this restraining order but for planned parenthood it may be a step forward but there's still a long road ahead. it's very limited in scope. specifically protecting planned parenthood from being sued by texas right to life and its associates. that's an anti-abortion group that helped pass this law. so anyone else -- so any other abortion providers are still liable and anyone else can still sue planned parenthood or any other providers or any private citizens who counsel, finance or otherwise transport patients. so it's still very limited and planned parenthood said make no mistake there needs to be more relief for the women in texas. as of now, abortion clinics have no -- have no choice but to comply with this rule. so women between 6 and 22 weeks of pregnancy about still in texas do

joining me from austin, nbc's liz mclaughlin. big welcome to you. what has been the reaction to this very latest ruling? >> reporter: the reaction from both sides has been to continue this battle over abortion rights. frankly, this ruling doesn't change much for women in texas. a travis county district court judge granted this temporary restraining order, and it is temporary, ending on september 17th, to bar texas right to life, which is an anti-abortion group that helped pass s.b. 8. it's a narrow ruling limited the scope of those suing limitations. but anyone else, private citizens, can still sue planned parenthood and other abortion providers and anyone who helps anyone get an abortion after six weeks. and texas right to life is doing just that, encouraging private citizens to submit anonymous tips through an online portal and there's been a reaction on social media to try to crash this site, telling people who are women's reproductive rights advocates to send in false information. and as of last look, the site is down. that may be because of the

nbc's liz mclaughlin has more now on how texas hospitals are handling the crisis. >> reporter: phillip, i was talking to a nurse in kyle, texas just 30 minutes south of austin and she said that the situation at the hospital she works at is very bleak, that doctors and nurses are overwhelmed and overworked in fact, they were crying because they just couldn't handle the case load they're near capacity with almost all covid cases 32 beds on one floor 27 of them covid cases and serious ones at that preliminary data shows 99.5% of deaths, covid-related deaths here are with unvaccinated people, and less than half of the state of texas is currently vaccinated >> all right, liz, thank you >>> jacqueline jackson, the wife of civil rights icon the reverend jesse jackson has been released from the hospital after battling covid-19. she was released on friday after weeks of of care it comes after both she and her husband, 79-year-old husband were hospitalized last month after a breakthrough case. reverend jackson has tested negative for the virus this according to their son jonathan jackson he has

let's go to nbc's liz mclaughlin outside the texas state capital in austin. some activists are fighting back. what about in court? there was a new ruling from a state judge last night. what more can you tell us about it? >> reporter: a texas judge granted a restraining order but this is a narrow ruling specifically protecting planned parenthood from texas right to life, an anti-abortion group that helped pass this law. other anti-abortion groups and private citizens of any kind in texas can still sue planned parenthood and other abortion providers and other people who are helping patients get abortions. alex. >> so this decision is likely to have some sort of affect on the texas economy. what do you know about that? >> reporter: there are calls on social media to boycott texas. a recent survey showed that skilled workers may be hesitant to come here. 66% of college educated workers say they would not move to texas to take a job because of this law. two-thirds of women say that. but governor greg abbott says he's not concerned about an exodus of economic activi

liz mclaughlin is outside a planned parenthood clinic in austin, texas. i'll tell you, providers and others are on edge because of the wide scope of liability involved in this law. it is not just providers. anyone that finances, counsels, transports patients can be sued for $10,000 or more. we are here at a planned parenthood clinic. i had to get here from my hotel. i tried uber, lift. the ride was cancelled three times. finally i changed it to the address instead of planned parenthood, i was able to get a ride. that just shows you the fear that this is spurring and impact of the law. now, providers feel threatened, harassed. they were able to get a restraining order from a district judge friday that's granting limited protection for planned parenthood. they can't be sued by an anti-abortion group called texas right to life. anyone else can sue and their hands are just tied. women are feeling desperate and distressed who need this service. waiting rooms are turning into crisis centers. there's a lot of tears. one woman found out she was pregnant five and
