president, after spending -- this on ndaa. after spending months insisting that the senate should take swift action on our annual defense bill, last night, republicans mounted a partisan filibuster blocking this chamber from moving forward on the ndaa. for the information of all, before the vote closed last night, i changed my vote to no and then entered a motion to reconsider the cloture vote so we could find a path forward on this important bill. now, we've heard over and over and over again from republicans in some form or another that the senate must act on ndaa, it must act quickly. our republican colleague -- one republican colleague called it a core duty, a bare minimum. yet another colleague said it was, quote, the best way to thank our soldiers and sailors for their service. but last evening, republicans blocked legislation to support our troops, support their families, keep americans safe, and support jobs across the entire country. republican dysfunction has again derailed even bipartisan progress on our annual defe

now, on ndaa, the defense act. madam president, we begin an important week for what will be an important final month of 2021. later today the senate will vote on cloture on the substitute amendment to the ndaa. ndaa has been passed by this chamber for over 60 years, and there's no good reason why this year should be any different. before thanksgiving, the senate worked in as bipartisan way as it could to lay the groundwork for advancing the defense bill. the senate armed services committee chairman and rank member reached a agreement, a bipartisan agreement on a package of 18 amendments. let me repeat that had 18 amendments votes for the senate to hold roll call votes on. nearly half of those amendments were led by a republican. that would be more amendments to the ndaa receiving roll call votes than in the last four years combined. we also agreed to the substitute amendment which included at least 50 amendments, 27 of which were led by a republican. senator inhofe, the ranking member of the armed services committe

yet we have not seen the ndaa brought forward on the floor of the senate. the senate armed services committee passed our version of the bill 3 months ago. one of the most important legislative items that we are responsible for and our nation is responsible for is to provide for arm when and women and uniform --our men and women in uniform and yet this administration and senator schumer are advocate -- abdicating our authority. let's take a look around the globe at what is going on. china is testing hypersonic missiles. russia is exerting pressure on ukraine. iran is exerting influence across the region, as is north korea. the taliban has control of afghanistan, providing safe harbor for terrorist organizations. our southern border is wide open, folks. who was providing for our national securi and how will we get that donety if we are not able to get the ndaa over the finish? i am calling on leader schumer to set aside floor time instead of doing this low level nominations. let's make sure our federal government is providing the authorities necessary for our

one way to that is ndaa, that vehicle, bite sized chunks of legislation that can be put into the ndaa bill and have real meaning. to start with sticky, is the foundation approach to what we need to start doing on critical infrastructure. start with that and build upon it slowly. if you try to do everything at once and don't take the incremental approach, there will be more divergence of opinion but generally speaking, if we are all on the same page. one of the best examples is we all agree that cisa needs to be a $5 billion agency in the next years. looking at the long-term needs, they need to be beefed up significantly. we all agreed. there is a lot of areas where we agreed we will continue to agree going forward. i'm not trying to blow 80 smoke to my friend but having good leaders at cisa we have good leaders that are collaborative minded and that can be important. when we see them doing that, we do better ourselves. >> it's not fair when you answer my next question before i can ask it. i will try to salvage it stop people want to know your views on resources for cisa also want to k

5% increase is based on the funding level included in the national defense authorization act, the ndaa. now, the senate armed services committee voted on that, and you know what the vote was? 25-1. -- in favor of that 5% increase. every single senate republican on the committee supported this level of funding. the house bill contains the same 5% increase, and it passed the house chamber 316-113. in order to increase the defense number and stay within the top-line established in the fy 2022 budget resolution, i reduced the amount for nondefense programs from president biden's proposed 16% increase, which i would have preferred, but i reduced it to a 13% increase. that's how negotiations work, each side has to give some. now, having offered the republican-endorsed spending level for defense, have they taken yes for an answer? no. have they taken time for a counteroffer? no. instead, they seem intent on driving us toward a full-year continuing resolution. if i had been here a long time and was a cynical person, which i'm not, i'd be worried that delay was a political calculation to tie th

letter, this new way to address sexual assault and other serious crimes in the military included in the ndaally at risk of being left out. why? >> well, at first i want to thank senator gillibrand who's really been the leader on this in the armed services committee. and with her leadership and the support of many of us, this has been included in the senate version of the national defense authorization act. so, we have a comprehensive approach that's been developed that's in the senate bill. there's a different approach. it's more narrow in the house bill. so, the letter you're referring to is a group on a bipartisan basis who want to make sure that when they're negotiating the final bill between the house and the senate that they use the stronger, more comprehensive version of addressing these issues. >> so, is the ndaa officially getting punted now to the end of the month? >> well, we're waiting to hear from mitch mcconnell about that. i know that the leaders of the legislation worked together as always. i mean, this is probably one of those bipartisan bills that is done every single year i

the first thing they're going to do is to finish taking up the ndaa.s that defense authorization. it's a military funding bill they pass on a bipartisan manner every year. that's already been started on the floor before they left. they have to finish that up. that's how the process here works. next we have our first deadline next friday, and that's essentially when the government will run out sort of funding in their checking account. they can't spend any more money. we expect them to pass a short-term funding measure to basically fund the government and keep it open for a certain number of weeks or months. that's yet to be determined. the next deadline here is december 15th. you see that there second to the left. that's essentially when the country will run out of money to borrow. they'll hit their credit card limit. that's something that i unfortunately face every year around the holiday season, but it will be the first time the country would default on its debt, and we already know that both republicans and democrats said that can't happen. we know

the ndaa, the military portion of this seems to be getting worked out, and then it's just this matter of the month of manchin that we're about to all be in here as joe manchin finally gets his hands on the house passed version of the build back better act and makes the changes he wants to see to it. that's the reality that is likely facing democrats, what manchin agrees to is what they will have a chance to send back to the house for final passage, december or january. >> peter, what's the white house strategy in terms of trying to get joe manchin over the finish line and how much coordination or i guess pressure is there from the white house to get the build back better bill over the finish line this year? >> well, look, this is obviously the president's top domestic priority other than getting hands on, you know, the covid crisis more generally, and i think that, you know, they have seen if you push joe manchin too hard that can backfire. they're not twisting arms in the way that lbj did back in the '60s and other presidents have in the past. they want to try to, you know, sweet tal

after a disastrous withdrawal from afghanistan and the end of our nation's longest war, this ndaa could have been, should have been an opportunity to debate, rethink, and reform our nation's defenses. the national defense authorization act, u.s. defense and security broadly, is one of the few items this body regularly considers that's explicitly, unambiguously within the enumerated powers of congress. consequently, something deserves due consideration and significant debate on the floor in order for members to be able to raise issues like those that i've described today. yesterday this body attempted to close debate on this bill without consideration of a single amendment. not a single one. while this bill does make key progress in limited areas, it does not get to the heart of many of our national defense problems. it does not restore congress' role in our national defense. it does not provide a holistic strategy to defend the united states or the people of utah or the people of any other state. this bill and the floor process yet remain missed opportunities. and i'm going to continue

appreciate congress's support since this effort was enabled by authorities granted in last year's ndaa. rep. maloney: in the interest of time, i now want to move to assistant director vorndran. last week, the department of announced -- the department of justice announced charges against two foreign nationals for their role in the ransomware attack against the florida based software company kc a. -- kaseya. one of the people indicted as a russian national who is reportedly responsible for over 3000 ransomware attacks. i commend the justice department and our international partners for bringing to justice these attackers. but to hold these cyber criminals accountable, russia has to play by the rules. can the charges against the russian national be viewed as a test case for russia's willingness to crack down on cyber criminals? earlier, mr. english has testified publicly -- made public statements that because of the biden administration's active engagement on combatting cyber that some of the activities in russia seemed to be more mild. but you said you don't know if this is going to be s

most of you know that the 2019 ndaa require that usaid and other agencies develop joint strategy for reconstruction efforts. there was a report that was due in 2018, over three years ago. and we have yet to receive it. yet to receive it. this has been highlighted by the special inspector for afghanistan reconstruction. but we are still awaiting this. and corruption is undermining our efforts. secretary, you also made an observation that one of the reasons we fail to leave afghanistan, perhaps sooner, was the result of political theater, losing a war. and the instinct to keep up the fight one over the need to critically review our interest. and we would have benefited from more intense oversight, and quote. i agree with you. so with that in mind, mister secretary, what do you think congress should have done, to address that political cost, especially among those campaigning to be in national security, and why should congress be pursuing prospectively as we move forward? >> i might not be a victim of my past, but i am sure i -- i worked on the senate side for bob dole. i want to mentio
