. >> i want to bring in chief legal analyst jeffrey toobin.the rub on this issue. it's a bit of a yo-yo. i thought earlier today they were emphasizing choice on mask use, and so how do you think this is going to play out? the idea of say, look, you want to have choice up to you and then trying to preserve the credibility of the cdc to have this authority? >> laura, i think the technical legal term for what's going on here is a mess. there are so many contradictory and puzzing things going on here. the -- to add yet more, you know, the biden administration is appealing this order, but they're not asking for a stay. so there is no way this case will be resolved before may -- >> we're not doing lawyers in the room but the same meeting they would ask for them to reinstate the mask mandate while the whole thing is pend. to say let's keep the status quo before the florida judge's ruling. >> exactly. if you really thought the cdc needed this order in place, you would ask for a stay, as you said to keep the mask mandate intact. but they're not asking

. >> let's get some perspective now on the congresswoman's testimony from jeffrey toobin, cnn chief legalr joins us. and david axelrod. jeff, given everything laid out do you think the case brought against greene would be successful? >> no, i don't. i think this is an embarrassment for congresswoman greene, but i think it's extremely remote she'll be barred from congress. this is deeply obscure provision of the constitution designed to keep confederate veterans out of -- out of office. i don't think there is basically any way she will be found to have violated this provision of the constitution and kept out of office. >> david, does this just help her with her base? >> yeah, i totally agree with jeff's analysis except for one point. he calls it an embarrassment to her. and perhaps it is to some, but for her it's an embarrassment of riches. this only strengthens her with her base. she will play the victim, and she will end up on top because they will -- they will dismiss this case. and meanwhile she'll raise a ton of money off of it, which is what she's been doing from the beginning. she's

joining me now for more on this, cnn chief legal analyst jeffrey toobin. what do you think the chances are for the administration and winning an appeal? >> it's a tough road because the courts are so politicized now. and i think we have to get used to that. we're used to thinking of the courts as very different from the legislative branch where you have democrats and republicans. i mean, because of how donald trump made appointments to the lower courts as well as the supreme court. biden as well, you have some very conservative members of the court like this judge who struck down the mandate and some liberal members of the court. so a lot of legal issues now, you are going to be able to predict the result based on which judge you get. the area of the country that this appeal would go to, the 11th circuit court of appeals is mostly conservative. so i think the biden administration is going to have a tough time with this appeal. if it even goes forward because, and again, this is where the complexity comes in, is the mask mandate only existed until may 3rd.

joining me now for more on this, jeffrey toobin and with us, she is the dean of the harvard radcliffend professor of constitutional law. let's start with the historic moment. a new opinion piece for cnn this. certainly cause to celebrate the change that jackson's confirmation to the court symbolizes, that celebration is not enough. what do you mean? >> well, first, i do want to say, kate, extraordinary historic moment. the supreme court was established in 1789, so it has taken 233 years to reach this moment. there is a barrier breaking moment that validates the principle of equal opportunity, the constitution and our laws. i say congratulations to justice jackson for an extraordinary accomplishment and also, to our country for reaching this milestone. at the same time, i do hope that we can both celebrate this individual accomplishment and think about whether we're doing enough as a country and our institutions to ensure that all students can thrive, can have access to the educational opportunities that set one up for success in life. >> and jeffrey, less than an hour, we'll see, also

. >>> also with me now, cnn legal analyst jeffrey toobin. >> it's a fascinating case.f how the court is moving. since 1962, it's been the law of the land and the supreme court that there is no prayer in schools. you can't have teachers directing prayers. but it is also true that teachers have first amendment and free exercise of religion rights. for example, every teacher can, in the school cafeteria say a prayer before he or she eats. nobody disputes that. the question in this case is, is this a private expression of religion on the part of the coach or is it a coercive act to pressure -- particularly the players on his team -- to participate and discriminate against those who choose not to discriminate. >> that's why this case is fascinating on so many levels. we were talking about -- by the time a case gets to the supreme court, the facts of what actually happened are generally established. and that seems to still be in -- a debate. >> and also what's at issue is what facts matter. one of the things that the school board is pointing out is look what happened in this
