what chuck berman describes is not that. just to be clear, saying that you are going to open investigation into john kerry based on the logan act which is not prosecuted, and by the way republicans were the ones who were flipping out when they thought that the obama administration was looking at the logan act for michael flynn, which they weren't. so he's describing something that is really not a question of main justice getting involved, its main justice getting involved in a political way. >> what struck me was the john kerry story. we had pretty good examples, and tangible evidence of using the department of justice to put pressure on people with trump silent. but even more dangerous, we see this in turkey, we see it in russia obviously. the prosecutor prosecutorial power as one of the ultimate powers that state wields, and it's used to go after people who don't like politically, then you're not really living in a free society anymore. so to say to go after greg craig puts you on the edge of something that is pretty dark?

berman writes, mr.trict that had just prosecuted mr. collins and mr. cohen. after being told by the "times" of the statements, he called them categorically false." he goes on to say that craig never should have been prosecuted when doj moved it from sdny to another office that acquiesced with main doj's request. frank figliuzzi, would you assume that doj ig is looking into the greg craig prosecution? >> well, i assume nothing anymore, but they ought to open a case if they don't have one open right now. and look, there may have to be cases reversed, decisions reversed here. there's legal liability. there will be lawsuits from this. this will go on for quite some time, but it is worthy of investigation, and this notion that there's some kind of evening out that takes place, my god, it's not -- you know, prosecutive decisions are not some baseball game on some child's rec league where we have to make things fair, you know, got to -- we have to give them a few runs. no. there's -- that's not how it works. t

i'm john berman live in tampa this morning. brianna keilar is in washington. this is cnn's special live coverage of a storm that is getting more powerful by the minute. the national hurricane center just reported it had a plane flying through the center of this storm measuring sustained winds, sustained of 155 miles per hour. that is just 2 miles per hour short of a category 5 storm and it could still strengthen before it makes impact over the next few hours. expected to make landfall, direct landfall southwest of where i am -- south of where i am near the fort myers area. the wind speed just one of the major concerns here. the storm surge, which the wind speed only exacerbates, could be devastating. here in tampa could be anywhere 4 to 6 feet. further south where the storm is expected to make landfall could be up to 12 feet. so many thousands of structures are in low lying areas along the coast. so the wind, the surge and then there's the rain. it's not raining that hard here now but it's been pouring for most of the night here and it is expected to pour for
