they set up a nonprofit for which they moved money through and paid colfax and prosecutors said that bannon benefited and hi personal expenses were paid for out of the money for those donations. so it is not clear what specific conduct bannon will be charged with today or the specific state statutes so we have no idea what potential penalties bannon could face if he is convicted. bannon pleaded not guilty at the time to the federal charges. case never went to trial because as we all know he was pardoned by former president trump before trump left office. so we never got to see bannon in court and examine the evidence in this case and now we'll figure out what state prosecutors want to do here. bannon pleaded not guilty and issued a statement first to nbc news and our colleague kristen welker two days ago directly addressing this indictment that is expected today saying he'll essentially fight to the death and that he also raised questions that this came up so close to the midterms. i would note, state prosecutors are not guided by any guidance as to when they can or cannot, or should

a temporary evacuation center is now being set up in the town of colfax.ito fire west of lake tahoe, cal fire says that fire is now 18% contained. that's of course. good news from 10% at this time yesterday, but it was just looking on twitter and appears as though this fire too. is exploding now and leading to some new evacuations. fire has burned more than 77 square miles of land and at least 46 homes and other buildings. the flames are still threatening 5800 homes and as i just mentioned new evacuation orders have been put into place. firefighters from up and down the state working to fully contain the fire as cruiser. still facing many challenges the rugged terrain, making it hard to create fire breaks. the mosquito fire started just one week ago there in plaster county as well as el dorado county. the flames then jumped the american river and spread into el dorado county. come here on the four giving undocumented students the support they need to succeed in college and in life here from the head of an organization that's oing great w k in san the choic
