joining us now, garrett haake and andrew weissmann. garrett, what goes with the grand jury?i know it's secret, we don't know. now that they heard from david pecker, potentially a rebuttal witness to shore up testimony of michael cohen about what actually happened with that payment, do we think we're getting closer to a resolution one way or the other? >> reporter: let's review why we know what we think we know. this is a grand jury where the prosecutors reached out to mr. trump and his attorneys a couple weeks ago to offer him the opportunity to come and testify or provide a witness that's a relatively unique in new york law that's typically done near the end of an investigation. trump provided that witness in the form of bob costello, a lawyer who worked with michael cohen. he testified last monday. yesterday we had a second round of testimony from david pecker, the former publisher of "the national enquirer." he was brought back to clear up testimony or perhaps rebut elements of what costello said. that's to say, every indication we have is that this grand jury could be cl

i want to bring in our chief washington correspondent, cbs's major garrett.an president trump has survived two impeachments, other charges against him. what happens now he's a candidate for president of the united states? >> so in theory the former president has been trying this case in the public sphere for about the last nine days. national polls indicate he has prosper the as a result of that. many republicans have rallied to his defense on capitol hill just hours after this indictment, having never seen the indictment. we still don't know what the underlying charges are and how they line up with new york law. having not seen that, there's a rallying effect around the former president. but to your point opening this broadcast, norah, new york police are beefing up. if this becomes a traumatic event for the country, that in no way benefits former president trump because that deepens a sense of national trauma about his underlying conduct. and though republicans will rally around him, this has a long way to go on the facts, the law, and the politics. and the

from west palm beach near mar-a-lago, and former chief attorney also here in new york, garrett haake for the reporting. all right, laura. i'm going to begin with you. let's talk about what you've learned about former vice president mike pence. what did the judge say about why he is compelling him and ordering him to testify? >> the headline is that pence will have to testify in front of the special counsel grand jury there in washington, d.c. about his interactions with the former president leading up to january 6th. all of their conversations, some of which he laid out in his book in a wall street op-ed, those are fair game according to this new ruling from the judge issued on monday. the former president trump also has tried to make some arguments about executive privilege, potentially shielding their conversations. we've seen him do that with a number of his aides in the past. those efforts have failed. you mentioned that the judge conceded something to pence, which is important here because pence tried to make the argument that because of his role as president of the senate on ja

also joining us, nbc's garrett haake, both on set. a former u.s.msnbc legal analyst, good to have you here. laura, what can you tell us? >> a big victory for the special counsel team here. as i understand it, a two-part ruling. the first part has to do with pence and all of his interactions with the former president leading up to january 6. we have known for quite some time that he had planned to resist the subpoena, the novel interpretation. pence was not a senator or member of the house but says given his role on january 6th, his ministerial role -- >> as head of the senate. >> that should provide him with a shield from having to testify in front of the grand jury. as we understand it, the judge who heard this in washington, d.c., just last week has decided pence is not protected from general conversations with the former president about his efforts to subvert the election but is protected in a very narrow, limited sense as to his duties on january 6. how all that have will play out, what exactly the question might look like, what he'll object to

so garrett, what do we know about what we can expect to play out in the building behind you today?eporter: jose, new york law allows for a targeted grand jury investigation or a witness recommended by that target to get a chance to talk to a grand jury before any decisions on an indictment will be made. and that's who robert costello will be for the trump attorneys today. costello's sole mission appears to be to try to undermine the credibility of michael cohen. everything we know centers around michael cohen at the center of those hush money payments in 2016. costello as a former legal advisory to cohen is expected to testify about michael cohen and about why he believes cohen's not credible. that's why the d.a. has cohen essentially in his back pocket able to respond to costello today and defend the testimony that he's already given this grand jury including over five hours just last week. so i think what this tells us is we're very near to the end of this process. trump's attorneys are going to take one last swing at undermining the prosecution's primary witness behind closed do

what can you tell us, garrett? >> it's always the case.on behind closed doors is a little bit more interesting when it comes to security planning. we know in this case, even secret service is involved and has been for some time, trying to figure out how they could get the former president in and out with the minimal risk to him, figuring out how they could keep him largely out of sight, and get through crowded, narrow, lower manhattan streets if and when it becomes time to do that. as for the broader security situation, the question of protest is an open one. you mentioned the original post, calling for protests, he had another broad call for protests later in the day. there seems to be a live debate in trump world about whether that's something they want or not. kevin mccarthy last night urged folks to stay home. even marjorie taylor greene suggested protests may not be the way to go here. the trump campaign may feel like calling people out in the streets steps on the political backlash that they would otherwise like to be the lead story
