joining us live now to discuss this is san francisco city attorney david chu. >> david, thank you so much for your time today. i know it's a busy day for you. thanks for having me on. so can you briefly explain to our viewers the injunction that's in place as a result? i guess, of the lawsuit by the coalition on homelessness against the city? >> sure. so last fall, homeless advocates led by the coalition on homelessness filed a lawsuit against san francisco challenging our practices regarding homeless encampments and a few months later, a judge, donna ryu, issued a preliminary injunction, an emergency order preventing our city from enforcing against, quote, invol monetarily homeless individuals. a half a dozen laws that otherwise would prohibit sitting lying or sleeping on our streets or public spaces. and this order is to remain in place as long as the number of homeless individuals exceeds the number of shelter beds until, fortunately, it's in the context of the fact that in recent years, san francisco has spent billions of dollars providing services and shelter to homeless individ

i'm dom chu in for frank holland. let's check in on stock futures. losing steam we are sitting at or near session lows for the futures market s&p is implied lower by 15 points dow jones industrial average lower by 100 nasdaq down by 60. you can see a sharp leg lower right around when europe just started trading and it has been drifting lower since here. we currently stand at 4,520 for the s&p. this was all after a rough day for wall street on the heels of the fitch downgrade. nasdaq posting the worst day since february right now, .50% to the downside. s&p down 1%. some conviction in the move lower based on volume. by the close yesterday, spy closed at 1.933million shares which is below 71 million. that is a huge amount of volume. similar for the qqq. tracking 20 million more shares yesterday than its average over that time span checking the bond market yeel yields across the board highest since november of last year. the 10-year treasury yield is below 4.15 the 2-year treasury is 4.2 in energy, oil prices contributing to the story. you think some of

cnbc's dominic chu is with us this morning. dom, good morning. we got numbers of new home sales?is that if you really want to buy a home and can't find a preowned one for sale, you find one in new construction. we got more evidence of that. new home sales data shows 4.4% increase in sales between last month and this month, july, for single family homes, which would, by the way, put the numbers at 31.5% higher in terms of new home sales than in july of last year. that's how much demand there is for new home construction. by the way, that translates into an annualized rate of 714,000 homes. in other words, if you take the number of new home sales in july, and then made some assumptions about that pace carrying all year long, you would hypothetically see 714,000 new homes sold in a year. i mention that stat because it is important for context. sales of new homes are a very small part of the overall residential real estate market. preowned homes or existing home sales are much bigger. but what this further reinforces is there is still a lot of demand for housing. what is interesting

cnbc's dom chu joins us for cnbc on msnbc. his name is michael bury, he got famous for the big short. he's at it again. what can you tell us? >> it's not exactly a vote of confidence on where the stock market is headed but it's not entirely clear just how negative he is on the future direction f the markets. by the way, that ultimately led to the biggest financial crisis in america back in '08 and '09, since the great depression, but also because of the vast amount of money he made betting on that downturn. when a person like that, who called the last major financial meltdown is calling for another one, folks pay attention. this is according to regulatory filings. they have to be made by america's biggest investors. burry bought financial instruments that profit, make money, if the s&p 500 and nasdaq 100 fall in value. now, it's unclear what those so-call put options are valued at currently or what he paid for them in the first place, but the notional value of the combined negative bets covers a jaw dropping $1.6 billion in ma

cnbc's dominic chu is joining us. >> the key takeaway, according to the mortgage bankers association,ge fell 3% for the week. that led to a 27% drop over the same week last year. it's even more dramatic when it comes to refinancing a home mortgage. applications there fell 4% for the week leading to a 37% drop from the same time last year. for context around that drop-off, the average rate for a 30-year fixed rate conforming mortgage and a jumbo mortgage, they both rose above 7% for the week. federal housing authorities or fha loans which are more popular amongst first-time home buyers, also lower to middle income families, they saw interest rates rise to 7.0% which is important because it marks the highest fha loan rate since 2002. the bottom line, jose, higher interest rates aren't just making homes less affordable, they're also incentivizing existing homeowners to stay in their homes which in many cases have mortgages at much lower rates. >> dom, we're also learning americans are putting more and more on their credit cards. >> according to researchers at the federal reserve bank, cr
