attorney, michael moore.ant to start with you on the threats and the arrests related to the federal case. what does this tell you about the trajectory of things going forward? >> it is predictable. you know, you have mr. trump himself, saying that if you come after us, we come after you . he has made statements about the judge in the manhattan case. he has made statements about the prosecution in washington, the judge in washington, and so, he has set the table for his constituents. so, when a phone call comes into the federal judge, starting off with racist comments, hey, you stupid slave, threatening to kill her, saying that if donald trump is not present in 2024 we are coming for you, putting you on a pike. this is part of these atmospherics that has the sheriff in georgia, who was receiving his own threats, the d.a., the manhattan d.a., increasing security details. the key here, in this case, is an example of the threat to the judge of the washington case. but, let's look at the chance with the grand juro

also michael moore, former u.s. attorney for the middle district of georgia. michael, why would witnesses scheduled to appear tomorrow suddenly be showing up at the courthouse today? >> well, i'm glad to be with all of you. there's nothing particularly unusual about a prosecutor having their schedule wrong. and it can shift. it can be that maybe the grand jury didn't have questions for somebody in as much detail as the district attorney may have expected. so, moving that schedule around, having the ability to be fluid a little bit, there is nothing unusual about that. it is getting a little unusual, frankly, now that it's well past the typical work day and closing time of the courthouse. the indictments are going to be returned in open court, meaning it has to be an open forum there in the courtroom and the courthouse has to be open. i don't know if she's anticipating asking for an indictment today, or if they're trying to close up the evidence, get the information, and move forward with the presentment tomorrow. zblf michael, as you know, according to reuters,

let's go to my next guest, michael moore.t these charges dismissed. what do you think about that? >> well, i'm glad to be with you this afternoon. there's nothing surprising in the filings that meadows has made thus far. i mean, we expected that he was going to file to have the case transferred from the state to the federal court. and now he's asking the judge to dismiss the indictment against him, at least, because of the supremacy clause of the constitution. that really is just sort of in layman's terms says that the states can't enact or enforce laws that deal with a federal official performing their duties. so he's making that argument that he was doing as he was told in his role as the presidential chief of staff, making calls, making appointments, reaching out, doing the things he was directed to do. the judge has set a hearing on august 28th, and we'll know more then. but these filings were expected i think by anyone who thought much about the case. so we'll see what the judge does with it later. >> you're there in atl

let's get more insight on this from michael moore. he is a former u.s. for the middle district of georgia, so the perfect person to take our questions on this. i mean, michael, given the fact that when you look at the landscape here this effort from republicans on impeachment doesn't seem likely to work, what do you make of this new effort with the new law on potentially ousting or sanctioning prosecutors? do you think it's going -- could it work? >> well, i'm glad to be with you. i really think this is just an effort to get some press by a young senator from the north georgia area. he shares the area with a certain representative from the state who likes to sort of throw some bombs like this. this is going nowhere. there is a law now on the books that the republicans passed and the republican governor signed that creates an independent commission to look at prosecutors' duties. and interestingly enough, the law requires actually prosecutors to consider every case for which there is probable cause. well, the grand jury in the trump case has determined by

i'm with -- michael moore and david urban. elie, what do you make of what we just heard?> what we just saw was very much by the book as it should have been. prosecutors really cannot say and should not say anything beyond what they alleged in the indictment. of course, the indictment here is extraordinarily detailed so she had plenty of room to talk there. but the dea was very much by the book. she essentially said here are the names of the people we charged here, the charges a couple of things. a couple of things that jumped out at me is number one, i believe the dea said she is going to give everyone an opportunity until friday afternoon to voluntarily surrender. what that means is that each of these defendants, 19 defendants, is going to have a chance to come in and walk into the courthouse. it will have to arrange it in advance with the and staff and do it the easy way and, presumably, if they do not make that deadline then the dea will have the option, if the show chooses, of sending somebody out to make an arrest. now, donald trump is going to present extenuating ci

. >> i want to bring in michael moore, former u.s. attorney in georgia. there are a number of codefendants who have not waived their court appearance, or entered a plea. any benefit for them to physically go to the arraignment versus entering a plea through a court filing as so many others have done? >> i'm glad to be with you. there's really no benefit at all to going to court. the courts have gotten lax especially since covid in allowing defendants who are represented at least, to be able to wave arraignment. that's a time when defendants are told what they are being charged with, what the ramifications of the proceedings may be, given some of their rights and protection for those people that don't have a lawyer, they are told at that time they have a right to a lawyer and they usually fill out forms to have a public defender or someone else appointed to represent them. in this case, this is to the benefit of the state and that from, the state because it sort of keep some of the circuits that we saw with the surrender down, and doesn't disrupt the city

attorney michael moore, who is also joining us. michael, i want to go out to you really quickly first and talk about what trump's vender might possibly look like. you're down there and know how all that works. this is both ordinary and extraordinary in a lot of ways. >> it is. i'm glad to be with you. typically when somebody surrenders, they go to the jail and there's a process and give background information. there's the usual fingerprints. you have seen it on tv. a mug shot is taken. i really think probably the sheriffs bravado is misplaced. i hope he will rethink how he's doing this idea we're going to treat a former president because of all the security can concerns and everything else, we're going to treat the former president like everybody else. they are not many times the courthouse has been cordoned off. he's already being treated different ily. the mug shot, there are more pictures of the president you could want, so there would be nothing compelling him to have a mug shot. i would also have some concern given the leak and

i'm joined tonight by michael moore, the former u.s. attorney for the middle district of georgia and cnn legal analyst carrie cordero. michael, let me start with you. sidney powell is now asking for this speedy trial. trump has been pushing back when others have asked for that. obviously they each have a right to when they want to have those trials happen. how could this entire case be affected if kenneth chesebro and sidney powell both get these speedy trials? >> i'm glad to be with you tonight. georgia has a unique statute. it's called the speedy trial act. it essentially holds the prosecutors' feet to the fire when a defendant asks their case be tried. when they're indicted, the state gets one additional term of court. in town fulton county, that means they get an additional two months. the prosecutor had no choice but to schedule it and the court had no choice but to schedule it. if the trial is not held by then, the case is judged an acquittal. so, that's a problem for the state in this case. i don't think there's a possible way the

with us now at this point, is michael moore, attorney at moore and hall, and to the point that we are hearing there, donald trump has received a target letter, and donald trump's lawyers are saying that they believe they will be indicted and they have met with prosecutors, and we don't believe many or any crucial witnesses to testify before that grand jury. at this point, what's the holdup if there is one for an indictment? >> well, i am glad to be with both of you, and i am telling you that he, being the special counsel, he is using the belt and suspenders method to make sure that he has everything covered and anything that he may not have anticipated that anybody else has thought of, that he is covered that as well, and i believe that you are likely to see the indictment today or thursday as the grand jury that has been hearing the case meets. it is important that they consider frankly, the evidence that has been presented and the grand jury is either going to have a summary of the information or have heard some of it originally, but all that matter has been placed before them, and

michael moore and geoff duncan, lieutenant governor before burt jones, and a key witness in this case. what do you make when you look at that board? this is your home state. you know a lot of those faces. >> it's not surprising really at all. and i think, you know, they're using this idea of unindicted coconspirators to tell a story and put some context on it. but it also lets a prosecutor reach a little deeper into the whole of the enterprise and pull the noose a little bit tighter around the group. and it's a valuable tool. it also helps keep cooperators and witnesses in line because they can recognize that if they do try to do something against the story, against what they've told maybe under oath at some point, that they could end up on the opposite side of -- with trump. so, it's a good tool, and i'm not surprised to see these folks in it. >> you think it could be potentially used to help flip other people? >> sure. >> we'll see what that looks like for these 30 other people. burt jones, he's the current lieutenant governor of the state of georgia. the only reason he couldn't be

georgia's former lieutenant governor, who testified before the georgia grand jury, jen jordan, and michael moore.s. attorney from georgia. michael, let me start with you because what did you make of meadows taking the stand under oath? how risky is this potentially? >> well, it's a pleasure to be with all of you tonight. you know, it's unusual to see a criminal defendant get on the stand and give any testimony under oath. most lawyers shy away from that. what it tells me is his legal team, at least in this case, is thinking about making a complete record that would likely find its way before an appellate court and that they needed to get evidence out from him that would be unique to him. so, in other words, they wanted to hear him talk about his job, how he perceived his duties, how he perceived the functions he was doing to find out if he could meet that standard, even if it's a low standard and a low bar, to have his case removed to the federal court. so, i really think it was a strategic move. we'll see if it hurts him down the road. but at this point, he's now created a record where he has,
