back with me tonight, former federal prosecutor renato mariotti. a legal affairs columnist for politico magazine. i'm sorry, renato, why with this gag order be lifted? trump was talking smack about the judge and the clerk. they hit him with a gag order. you know he's going to do it again. why would they lift it? >> well, you have to remember that the first amendment and its protections are very broad. and ultimately, what a gag order is as what's called a prior restraint on speech. it's the government telling you before you start talking that you can't talk. and so, courts very heavily disfavor those. obviously, this is an extreme situation. i do think on appeal, i would expect this gag order to ultimately be upheld when it's considered by the full court because it's really trump attacking a member of the court staff. but that said, courts generally trying to err in favor of more speech rather than less. that's why this is happening, but i agree with andrew, very poor strategy by trump. i think it's fair to say this isn't the legal strategy at all.

renato mariotti, former federal prosecutor -- and michelle goldberg, msnbc political analyst and a columnist the new york times. great to have all three of you with us. eddie, let me start with you. i'm curious to hear your thoughts on your colleagues put a friend of this network, someone we speak to frequently and what his take was that trump's threats -- it's not about politics. they don't help his case -- he's courting violence solely for the sake of violence. >> i understand what's behind kelly's formulation, but i think he's a little bit more strategic. i think trump according violence, as actually trying to force those who are trying to prosecute him to pause, to think twice. so there's always the calculation what will it mean for that nation for us to hold this man accountable? and if his second amendment people, remember he described his people as second amendment people when he was running against hillary clinton. if those people pose a genuine, violent threat maybe they will pause. so i understand what the guy saying but i also think there are some strategic dimension to what trump

coming back to us, maya wiley and renato mariotti to break this down. maya, what can we expect to see when donald trump takes the stand next week? >> i think we're going to see candidate donald trump. as we've already talked about, donald trump -- there's already been a finding that the financial statements were fraudulent. we're already seeing behavior from donald trump and from his team not taking seriously the fact that this is a judge who's going to make the decision about the penalties. and donald trump is a candidate for public office. and so he understands the scrutiny and the news coverage that is going to come with his testimony. that means he's going to sit there playing to the benches, not to the bench. playing to the public, not to the judge. and so i expect to see a lot of talk about how much he's worth, how valuable his brand. won't help him legally, but i think that's not the court he's playing to. i think it's the court of public opinion. >> do you agree, renato? is this going to be testimony for the peanut gallery, not necessarily for j
