[laughter] i knew if i could get a job i'm never leaving. what you teach there? i could teach a wide variety i teach constitutional law, separation of powers, federalism, judicial review i also teach courses related to national security, foreign policy, i also did sometimes sometimes theyteach things aboul philosophy. critical theory. natural law or law and economics. i'm allowed to teach. i trench the poor students had to join on the inaugural voyage. john yoo, former law clerk to clarence thomas. great to have this outstanding panel with us. first let's go to chad pergram and get the latest on the breaking news this hour on a friday afternoon on capitol hill. hi, chad. >> march that good afternoon. jack smith has lost his effort to speed up consideration as to whether the former president was immune from prosecution for interfering with the 2020 presidential election. now, this first goes to an appeals court likely in washington d.c. only then would it later go to the supreme court. this likely upends the chances of a march 4 trial date for the former president. jack smith wanted quick action by the supreme court effectively by passing the appellate court. listen. >> a special counsel was asking effectively to leap frog over the d.c. circuit in order to get a judgment as quickly as possible. jack smith has made very clear that he wants this case tried before the election. >> this upends the potential political calendar. it's unclear if the case by special counsel jack smith can be wrapped up before the election. the trump

john yoo joins us, former deputy assistant attorney general. john, what does this mean?jack smith wanted to rush this. first off, why did he want to go over the appeals court and go right to the supreme court? the supreme court obviously felt the rush was not necessary and there is a process here, but explain what happened. >> happy holidays, neil, sorry i cannot join you on camera. what happened here is the special counsel jack smith and the trial judge here, judge chutkan, wanted to accelerate the trial, get the trial started in early march, the day before the super tuesday primaries, so they can claim that they can get the trial done before it can affect the general election, before we get to the summer, so this is a big victory for the trump team, and a big, big call for the stocking of jack smith for christmas because this effectively slows down the trial and makes it very hard to see how the trial is going to start in early march now because the d.c. circuit, i clerked there and also clerked at the supreme court, they are going to want to take it with due deliberat

i want to go to john yoo. he's done it all. we're honored to have him. john, was doing research because i always have to do research when you come on. i can't fake it. i try. anyway, there's 15 or 16 states kicking around this idea of removing donald trump from the ballot. you know, obviously colorado was the first out the gate through its supreme court doing so. but what other states use as the trigger mechanism? >> neil, you're research has done well as always. in this case, it's the second supreme court that has heard this issue. the minnesota supreme court turned away this challenge. there's other courts, other secretaries of state are also considering this. for example, in california, out here, the secretary state is considering whether to bar trump from the ballot. i think the supreme court will intervene and will overturn this ruling. the last thing the supreme court wants is 30, 40 different standards about who gets to be on the ballot, who doesn't get to be under the ballot, when the u.s. constitution actually sits out. you have to be a natural-b

let's go to john yoo right now. we're hitting you with this just on this breaking news, john. what do you think? >> it's an astounding verdict. this is almost i think seven times to ten times more than the plaintiffs asked for. they had to though that guliani made false statements, that he did it recklessly and caused them damages to their reputation. the interesting thing here that people should realize is there was never a trial on the actual facts. guliani basically refused to contest the claims and that the judge entered here a default judgment against him. guliani basically didn't show up. guliani is going to tried to go on appeal and say all of my speech was protected by the first amendment. i had a right even if it was wrong to say these things because of my right to free speech. but this is a strong signal by this jury to impose so much money and damages. i'm sure money that mayor guliani doesn't have. i'm sure it meant to send a signal to other defendants involved in the trump re-election campaign that what

the read from john yoo. thanks for joining us. the cases will start to pour in. feels like obviously this is all going to head to the supreme court, but there's the issue of timing. the issue of urgency. is there a chance that the supreme court could hear this sooner rather than later? >> good to be with you. the answer is yes. because of the colorado decision, they will get a decision to get trump back on the ball lot. if the supreme court were to take that case, it could resolve the issue nationwide. none of the other state supreme courts will go forward while the u.s. supreme court is hearing this case. this decision by michigan points out why the u.s. supreme court should hear. you have three supreme courts now. minnesota and michigan on one side say trump can be on the ballot. and you have colorado on the other side saying trump can't be on the ballot. we can't have 50 different rules throughout the country, 50 different ballots. this is the perfect reason why there is a u.s. supreme court to make sure that the u.s. constitution is interpreted and applied in

welcome back former assistant deputy general and uc berkeley law professor john yoo. wild stuff. what do you make of all this about getting the trial started, the fight over that. it's supposed to start march 4, 2024. the special council wants to start it immediately. he's asking the supreme court to rule on that against the president's immunity claim. trump's saying, no, you're interfering with the election for 2024. >> liz, this is an example of how the special council and judge want to take this decision. what do people think of what president trump did back on january 6, 2021, take it out of the ballot box and try to decide it in the courtroom. this is a prime example. what the special council is doing is unprecedented and only really important time this has ever happened before was in the nixon watergate tapes case. what the special council wants here is for the supreme court to reach down and intervene in the trial proceedings of the court here and review prematurely whether president trump is immune from prosecution for the events of january 6. now, this is an
