jena griswold, thank you for coming on "the beat" tonight. >> of course. thanks for having me on, ari. >> your reaction to the supreme court taking this colorado case tonight? >> i think it's a good thing for the united states supreme court to look at this case. ultimately, the american people deserve to know whether someone who engages in insurrection can then serve in the highest position that we have in the united states. >> yeah, and you've said some of that before. you've referred to the idea that he has engaged in insurrection. and yet there's so many important due process questions here, no matter what one thinks about that particular candidate. and so just confirming up top, donald trump hasn't been convicted of insurrection by a jury, right? >> that's right. and something that i disagree with you on was your assertion that a criminal prosecution was necessary. because historically, that is not how section 3 of the 14th amendment has worked. hundreds of confederate soldiers and officials were removed from office after the civil war under this proce

and joining me now is colorado secretary of state jena griswold.retary, thank you for being here. walk us through what happens and what the timeline looks like for you? because i understand tomorrow is actually the deadline for you all to decide who is on the ballot. so how does what the supreme court does tomorrow impact colorado? >> well, first off, always great to be on your show. thank you for having me. >> of course. >> so tomorrow is the day i certify the ballot. so that's the day that i'll tell all the counties hao can be on the ballots that they subsequently will print. we have this big appeal in front of us. but before we get to the united states supreme court, the colorado supreme court, while it did say that donald trump was disqualified, and that he engaged in insurrection, it also said that if an appeal was filed, that he should be put back on the ballot. so tomorrow, if we don't hear anything from the united states supreme court, i will certify trump's name on the ballot. and then we will wait to see whether the u.s. supreme court tak

. >>> joining us, colorado's secretary of state jena griswold. thank you for being with us today. are you confident the supreme court will weigh in this week? >> thanks for having me on, brianna. i'm confident colorado will have great elections no matter what happens. obviously this is a case that has taken lots of twists and turns. we've expected an appeal from the former president and hope the court acts with urgency. i certified the names onto the ballot for the presidential primary this friday. so we do hope that the court understands that presidential primaries are rapidly approaching and gives us a definitive answer whether or not the former president is disqualified from the ballot. >> if the colorado supreme court gets this way, if the ruling is held up, it's possible the mail-in ballots would be going out soon -- you have military ballots going out the end of this month, regular mail ballots going out in february, mid february. it's possible that those in and in-person ballots could be different in your state. are you prepared for the chaos that could create? >> colorado'

joining me now to discuss is colorado's secretary of state jena griswold. great to see you. happy new year. can you talk to us about yesterday's certification? >> happy new year to you. absolutely 2024 is off to a quick start. so yesterday i certified the ballot. that included certifying donald trump to the ballot. the reason for that is actually the colorado sproert'upreme cou decision. the colorado supreme court said he did engage in insurrection and he was disqualified. because there was an appeal, he is on the ballot and, of course, will await as the supreme court starts to really delve into this case. >> if the supreme court renders a decision and says that he should stay off the ballot, will it be an issue of when voters look at that ballot for the primary, they'll see a line drawn through the name or the name donald trump will be removed all together? what will that look like if it is upheld that he should not be on the ballot in colorado? >> it really depends on timing, when that decision comes down. but the more likely scenario and i think the scenario you're asking

joining us now is jena griswold. f state of colorado, the chair of the democratic association of secretaries of state. secretary griswold, thank you very much for joining us tonight in what appears to be clearly a historic situation for you as a secretary of state. i just want to go through some dates before we get to the merits of what's being considered by the supreme court. january 5th, the end of this week, friday, is -- that, as i understand it, is your deadline for, in effect, deciding what names will be on the primary ballot. >> that's right. >> and so, what does this situation mean, given that this appeal process is underway? does that mean, because the appeal process, donald trump's -- many will be on the ballot? >> that is exactly right. the colorado supreme court determined that trump did engaged in insurrection, and because of that, he is disqualified from the ballot. but, their decision stated that if an appeal was filed before today, he would be on the ballot until the supreme court took some type of act
