i'm stephanie ruhle. and we are now 216 days away from the election. jack smith has basically had it with judge cannon and the way she has handled donald trump's classified documents case. now smith is taking action to protect his prosecution. in a new filing, smith said judge cannon's legal premise was quote wrong and called trump's claim about the presidential records act a fundamentally flawed premise. the idea that he should not be charged because he had declared the documents personal. smith calls that pure fiction. he also pointed out it has been nearly six weeks since trump moved to have the case thrown out. he wants the judge to get on with it and make a ruling asap. smith has signaled he will appeal if he loses and of course trump will likely do the same if he loses, there is news in the hush money case. the judge has denied trump's attempt to delay the trial. jury selection in that case will begin right around the corner. april 15th. that is 12 days away. mark your calendar and let's get smarter with the help of our leadoff panel. lisa rubin.

i am stephanie ruhle, live from new york city. we are now 211 days away from the election.unsel jack smith filed his brief to the supreme court as it prepares to hear arguments about donald trump's claims of presidential immunity. smith argues that even if the justices decide presidents do have some level of immunity for certain official acts, the prosecution should still go ahead. meanwhile, the new york case is set to begin one week from today. can you believe that? you will believe trump's lawyers are pulling out all the stops to try and make sure that does not happen. trump's team argued today that the case should be delayed while they fight for a change of venue and against trumps gag order. i was after they made those arguments, the judge denied the motion to delay. we've seen this last-minute long shot before from his team. his attorneys tried the same light change of venue tactic last year to delay the civil fraud trial. an appeals court refused to delay the trial. meanwhile, there are huge questions tonight surrounding the $175 million bond trump posted to appeal t

stephanie ruhle has joined us.was trying to say it's because republicans are being prevented from going to that part of lower manhattan. what do you make of how this is happening in new york? >> that's the story for me, the arc of donald trump in new york. the boy who grew up in queens who dreamt of being king of new york. think about the 1980s and every tabloid with donald trump in a limousine, trump tower, right in the middle of fifth avenue. now here he is, a criminal defendant, an old man sitting there slumped over, and even this idea he's got these scores of fans, and yeah, they might not live in lower manhattan but there must be 2 million in the tristate area in staten island, in new jersey, in long island. such a few number of people in the court outside court, protesting on his behalf today. >> almost really nobody. >> who wasn't inside court with him? a single member of his family. the argument that he was protecting his family, that's why this whole thing happened. he's a familyman. not a son, not a daugh

i'm stephanie ruhle. >>> we are now officially 195 days away from the election. tonight donald trump is now unindicted co-conspirator number one in a sprawling criminal case, another one, involving our elections. 11 so-called fake electors who supported trump in the 2020 election have been indicted by an arizona grand jury. it comes after a year long investigation by the state's attorney general. one month after the election 11 trump supporters sign a certificate claiming to be arizona's electors, but president biden won the state by more than 10,000 votes and his electors were certified. among the people facing charges, kelli ward, former head of the arizona gop, and two state lawmakers, key trump allies also indicted, including rudy giuliani and mark meadows. donald trump is, of course, already facing 88 criminal charges in four separate jurisdictions. in less than 12 hours he'll be back in court for another day of testimony in his new york criminal trial. at the very same time some of his other attorneys will appear in front of the supreme court on his behalf.
