others point to the prison term already served by trump's former personal attorney, michael cohen, as a precedent for punishing trump himself. it is very rare for a subordinate in a conspiracy to receive a prison term , no. donald trump. was at the head of this criminal conspiracy and michael cohen served a serious term of months behind bars, so the judge who chooses the punishment in mr. trump's case has some precedent. an alternative to prison. there could be probation, house arrest or a fine, but most likely none the sentence will not be carried out until the end of the appeals process, which may end as soon as the november 5 election. whatever sentence is handed down next month will affect the other three criminal cases against donald trump. the fact of this conviction, if it remains on the record, could lead to a potentially longer prison term in future cases. so there will be consequences, after all. now he will have a criminal record, his criminal history is taken into account when sentencing. speaking of the other allegations against trump made at at the federal and state leve

trump hadn't been face to face with michael cohen since last year. heard and was like, "twinsies." [ laughter ] that's right. today, michael cohen testified at trump's trial, and you could -- the whole outcome could hinge on what he has to say. here's what happened this morning when the defense learned that cohen was appearing. trump's attorney said, "sir, your disgruntled ex-lawyer is testifying today." trump said, "you're gonna have to be more specific." [ laughter ] then he said, "it's the one whose life was ruined after working for you." then trump said, "you're gonna have to be more specific." [ laughter ] and then, he said, "the one who got disbarred, put on trial, and thrown in jail." trump said, "be more specific." not one of them, but the totality of decisions that they made to surround michael cohen as sort of ae this case succeeded. because not withstanding what todd blanche will say about this case resting on the shoulders of michael cohen, nothing could be further from the truth. if you ask me which decision was critical, let's start with the beginning. starting with david pecker and multiple days of testimony. david pecker is still a person who considers donald trump a friend and yet his testimony may have been more critical than anyone else's in driving home to the jury that there was a conspiracy, executed by unlawful means and ultimately covered up by the falsification of business records caused by donald trump. that all started with david pecker and just continued. when i think about is there one moment? no, there is a series of moments every day that was two years in the making with alvin bragg's team thinking about how do you construct this case in a way that no one can say it is solely because of that guy who is disgruntled and upset because he served time in prison and that guy, t

michael cohen was sentenced to three years in jail. granted, he was also sentenced for other crimes as part of that prison sentence, but at his sentencing, the judge was very clear that this federal campaign finance violation had real consequences for democracy, that it threatened the electoral process and undermined the voters' faith in the electoral process. and so, you heard the prosecutor in the closing hit on those same themes, about how serious this was, about how this was really a subversion of democracy, because the entire scheme here was designed to defraud voters, prevent them from getting accurate information before the 2016 election. so, it is incredibly serious, it is far more standard -- serious [ inaudible ] this is a felony, and you have someone else who has already been involved in the same scheme who has already been sentenced to jail time, and michael cohen was less culpable than donald trump. remember, donald trump was directing this game, he was giving the directions to michael cohen, so he is more culpable, the pr
