that's up from 2020 joining me now cnn's sara murray, and zach cohen. sara, many election officials and voting rights activist say tactics that jack smith's outlines in his brief against donald trump are similar to what they're seeing. now, tell us more. >> i mean, if you look to this filing, it feels very familiar to what we're living at this point. i mean, we're seeing these claims that they're all he's non-citizens who vote in elections which again, experts say is very rare in federal elections. we're seeing some of the same people who pratt, who pushed lies about the 2020 election spreading these lies now about 20:20 and before we are seeing this avalanche of lawsuits and they're challenging things like the voter rolls saying that states are not monitoring their voter rolls, that there are dead people on the voter rolls. there are people who have moved on the voter rolls well, we saw in 2020 it was a lot of these lawsuits came after the election. this time, we're seeing them on the front end and, you know, the whole certification process is very mund

cnn's paula reid and sara murray join me now on ballot watch. ladies. thank you. you so much for being here. so let me ask you policy very significant ruling from the u.s. supreme court siding with youngkin on these 1,600 voters. what does it mean so close to the election? >> well, as you noted, we're talking about about 1,600 voters here. and it was a bit of a surprise that the supreme court weighed in at all, and also that they sided with republicans because what trial court and the appellate court actually sided with the biden administration that said, you cannot implement a systemic removal of suspected noncitizens with a 90 days of an election pursuant to federal law. let's supreme court divided along partisan lines, a disagree, but i will note there are we know that there are some citizens two were impacted potentially by this. but if you were improperly removed from the voter rolls because you did check a box, didn't check a box, one of the clerical error is in virginia. they do have same-day registration. so if you're someone who is impacted by this, you c

the judge tossed those counts out earlier this year, cnn's sara murray is joining me now. sara, tell me what happened here and what the expectation is on her part, as well as what the judge might say yeah. >> i mean, this is all pretrial wrangling a lower court judge threw out six of these counts out again, three related to trump that have to do with solicitation of violation of oath by a public officer. essentially, these are counts related to the efforts to have state in officials put forward this slate of fake electors. and so fani willis is trying to get these counts reinstated before this thing goes to trial in a court filing, she said the indictment included an abundance of context and factual allegations about the solicitations at issue, including requests that were made to whom they were made, the manner they were made. one of the things that the judge said when he tossed the counts was that there just wasn't enough information about the potential underlying crime for these counts to go forward and fani willis is disputing that her filing saying, look, defendants ha

shermichael, whilst you've been and was gone, sara murray reports tonight. he did have this voice. they would set the agenda for how people on the right would respond to certain moments are what they would say out on the campaign trail. what does it make for him coming a week before the election? >> this is our noise from a campaign perspective. you're going to be focused on what your ultimate objectives which are to win. on. the last thing you want, are messages, are message jean coming from out. i mean, i see curious shaking her head. you've worked on enough campaigns if you disagree, please tell the audience why what i'm saying. logical or wrong from a campaign perspective. but with that said, you don't want people outside giving outside messages or talking points, or even trying to strategize. that's literally gone against the very objectives or goals or aims of the individuals that are advising the king candidate, then a man is joining the campaign. so i don't think this is going to be helpful if he interferes with that process. he has a right to say whatever you want. but fro

so what exactly are state officials doing to safeguard this election cnn sara murray is here to explain as part of our regular check-in about election threats, which is getting even more important because we're getting even closer it is. >> and i think one of the big changes this time around is we have so many more elections skeptics who are going to be a part of this process in a way that they weren't necessarily in previous presidential elections. and so when you look across the battleground states, whether it's michigan, arizona, pencil playing in north carolina, you see these instances where there were officials who refuse to certify the results and believed in some cases there was voter fraud. problems with the machine, that kind of thing. and our colleague fredricka skeleton has some really interesting examples of that in our digital story on cnn.com. and i think that what election officials are doing is they're trying to be really aggressive to head off these threats this time around. so that means going to judges and their communities and explaining, if you have an election chal

cnn sara murray is following this decision. explain the significance. >> well, the significance is that this was a rule that was going to be coming into place in late october, and the judge basically said, look, this is too much too late. he said this would cause administrative chaos and he's putting it on pause while it's being litigated on a number of fronts, including as you pointed out in a hearing today, he also pointed out there's no training in place, there's no protocols on how to implement this. for now that seems have paused. it may be appealed, but we are just getting so close to actual election day that it's hard to imagine you could move forward with something like this. again, without me training, without any rules in place around so close to election day and they're voting right now on electron, not counting them, but actually voting. i want to show you and interesting marist poll about when americans will vote 56% of voters who plan to vote in-person on election day say they will vote for trump on the other hand

last election, raising fears about what's to come in swing states, especially this election cnn's sara murray is joining us, has been looking into this what kind of challenges are election officials kind of preparing themselves for? >> well, kate, i think one of the big things is that we have so many more election skeptics who are now serving on these local election board, boards. and my colleague, fredricka scout and found a really prime example of this in arizona. but it's really, if you look across all these different battleground states, whether it's arizona, whether its pennsylvania, whether it's michigan, whether it's it's north carolina. since the 2020 election across the country, there have been 35 officials in these various states who have refused to certify the election results. and that has the top election officials in these battleground states really on guard for the possibility that we could see more certification fights refusals to sign off on the winter, going into the november election. and so they've really tried to prepare in part by going to judges and saying, look, we hav

cnn's sara murray and paula reid joins us now, paula, one republican case study in virginia were the case in virginia, i should say has now virginia calling on the u.s. supreme court to intervene, tell us more. >> yeah, one of the first big cases to make it to the supreme court before election day at issue. here is an order from the virginia governor's saying that a group of voters who identified as noncitizens should be purged from the voter rolls and the biden administration sued because they said some us citizens were actually caught up in that group and what the trial court and the appellate court has sided with the biden administration because there was a federal law that says you can't do systemic purges to voter rolls with a 90 days he's of an election, but there's nothing preventing them from going individual by individual and making assessments. so look, i talked to some trump align sources earlier today there are optimistic that maybe the justices will at least order the ballots in question to be set aside. but most supreme court experts are skeptical. the high court's goin
