announced it was deadlocked on a first degree murder charge against florida software developer michael dunn, the question so many have asked is what happened? yes, dunn was convicted of three counts of attempted murder for firing at a car with fourteens inside after an argument over loud music, but on the most serious charge, alleging the murder of 17-year-old jordan davis, the jurors could not agree. tonight in an abc news exclusive, we know why. abc's byron pitts has just finished the very first interview with one of those jurors for our series "crime and punishment." >> do you think michael dunn got away with murder? >> at this point, i do. myself personally, yes. >> reporter: she was juror number four. valerie is her first name. home care nurse administrator, she asked we not give her full name. for the first time tonight, we're hearing what happened inside the deadlocked jury room where 12 people struggled to decide the fate of admitted killer michael dunn. >> when you went to the deliberating room, you thought michael dunn was guilty? >> yes, sir. >> reporter: of killing a 17-year-old

that's what many are asking about the trial of michael dunn. the only testimony supporting dunn's self-defense claim was his own. and even that was contradicted by other witnesses. dunn was convicted on four other counts. but the jury deadlocked on the charge related to killing jordan davis. and for davis' parents, that's not an abstract legal issue. it's very personal. abc's byron pitts sat down with them for our series "crime and punishment." >> it has been an incredibly long 15 months for you two. it was his father ron davis who got the call. his boy had been shot outside a suburban convenience store the day after thanksgiving. >> all i remember hearing the doctor say is mr. davis, i'm so sorry, we were unable to revive -- >> and then he made that long walk a parent would rather die than ever take. >> and i asked to see my son. they said wait a minute, we don't want you to see him like that. and so they pulled a sheet up to his neck like that. when i saw him, he was laying there peacefully. had a little blood on his nose and his eye was open

[ gunshots ] >> reporter: it was over in moments. a life gone, lives ruined. jordan's mom tried to cope with her heartache by clinging to the last conversation she had with her beloved son, less than 24 hours before he died. i just want to tell you thank you thank you for loving me. >> tell me about your boy. >> he was not a perfect child by any means, but he was a good young man. always the life of the party. people would say when jordan walks in the room the room lights up. he was humorous. very sensitiv

the gas station wrote down the license plate and went to michael dunn's home and then brought him out the issue of race was largely ignored in the trial. dunn wrote to family members that he thinks the justice system is unfair and biased to african-americans. he wrote -- but that was never brought up in court. >> there is great sensitivity to bring up race in the zimmerman case and in this case, we have to ask questions why. are notthe south, they ready to talk about these issues . i think the state prosecution is concerned to bring it up. these statements and michael dunn's actions show that he was a threat. that he willthing serve at least 60 years in prison. of these statements, it is clear he is a threat. >> the attorney for jordan davis's family released a video formerael dunn's neighbor. he said he had a history of violent behavior and cocaine use and insurance fraud and even bragged about once putting a hit out on someone. his first wife said that he had held a gun to her head and threatened to kill her. this is an interview of his former neighbor. >> he acted like he was smart

it was just after michael dunn left the reception that the shooting happened. himself has not commented publicly on his side of the story. but since being in jail he has written many letters. they've now been submitted as evidence. in a letter dated july 14th, presumably to his fiancee, he writes, "i just got off the phone with you and we were talking about how racist the blacks are up here. the more time i am exposed to these people the more prejudiced against them i become." in another letter to his grandmother he complains, "the blacks seem to be calling the shots in the media and the courts." in yet another letter he acknowledges comparisons to the trayvon martin shooting. that is the issue, and did he represent a threat to michael dunn? they evaluated that and they were torn as to whether or not he was justified in shooting and killing him. that is going to represent a hung jury, but as paul said, he had a volley of the shots, and we heard throughout the course of the case, the surveillance tape, and you heard the surveillance tape, and the pop, pop, pop, and you heard it, additional shots. as to the other shots, there was a continuous course of conduct, but clearly some break there where the jury perhaps in the initial volley may or may not have been justified, but as to the second volley of shots, they did not apparently think that he was justified at all, and that what led to the attempted murder charges sticking and ultimately a declaration of guilt and to the firing into the car. >> and you to also look at the potential serious sentence that he will face under these laws. under florida law, because it is gun charges and very serious charges as i am calculating it, if the sentences are consecutively, there is a r

. >> with michael dunn. let's move forward, martin. you mentioned earlier there are protests planned for the week ahead. what do you know about these protests. >> reporter: well, i think right now they're just sort of being loosely organized. some talked about wearing black bands or wearing black arm bands or black ribbons. this is something that would be organized both here in jacksonville and they're trying to encourage it across the country. these are protests always designed to be peaceful. in fact, when i was talking to protesters as people were awaiting verdict, i said, well, if it doesn't go your way what do you predict is going to happen? no one ever suggested anything along the lines of violence. what they said is there would be protests. there would be a very forceful message said that this would not be tolerated and that laws need to change in the state of florida. but always, always it was peaceful and it was always to be within the laws of florida. don? >> all right. martin, thank you very much.

the state might try and go after dunn's character using a letter michael dunn wrote from jail. quote, this jail is full of blacks and they all act like thugs. in is dunn writing. another. this may sound a bit radical, but if more people would arm themselves and kill these idiots when they're threatening you, eventually they may take the hint and change their behavior. i mean, if this were presented in front of this jury, it might have not only changed this juror's feeling, it might have changed others. >> this is toxic, explicit racism of the kind that you rarely get in courtrooms today. you know, a lot of times we're guessing. is this guy racist or not based on his conduct? well, here we have in writing very clear language from michael dunn himself just months after the shooting where he is clearly a racist with the capital r. that evidence should have come in. but i do not blame these jurors, as you say. they were not given the evidence. they were instructed to follow the law. they did follow the law. stand your ground was a great big problem for them. that's not their fault.

. >> you didn't think michael dunn had to kill jordan davis? >> i don't think so. >> stand your ground is part of the consciousness in florida and the other stand your ground states. >> even if we don't ever receive the verdict for jordan, he will still pay because he will spend the rest of his life in jail. and i feel sorry for him for that. >>> today, prosecutors announced that michael dunn will be retried for the first degree murder of jordan davis in may. and today, we heard from a second member of the jury, juror number eight, a 21-year-old who says she thinks michael dunn is a good guy, but she also thinks he is guilty of murder. >> i honestly think he was a good guy. i think he is a good guy. i don't think he hates everybody. i don't think he wants around wanting to shoot everybody. i think that he made a bad decision. >> the first juror to speak, juror number four, known only as valerie says race was not a factor in their deliberations. >> for a lot of folk in america, they would say white man shoots and kills a 17-year-old black boy. h

the jury in the michael dunn case deliberated for more than 30 hours over 4 days before returning itsnd guilty on four of five counts and faces up to 75 years in prison if not more. but the jury could not reach a verdict on the most significant charge, first-degree murder, and dunn is to be retried on that count. it was a mistrial on that count. 17-year-old jordan davis was shot and killed in november of 2012 after a confrontation over a loud music in jacksonville, florida. i want to get now to cnn's nancy grace who has been paying close attention to this. i told our audience, nancy, before the break, you want real, here it is. hln's nancy grace. nancy, what do you make of this? >> thank you for inviting me on. i've been literally on pins and needles as we all have waiting for this outcome. this is what i think happened. i think somebody was torn up on self-defense. even if it was not a legitimate self-defense, because there clearly was no gun in that car. in fact, michael dunn under police questioning even admitted seeing the gun, may have been in his imagination. so obviously it was

>> we did, michael dunn. >> besides michael dunn. >> here we go, the only two people that know what happened, every single state's witness outside of the kids in the car indicate they were not looking over in that area until after they heard the gunshot being fired. as a matter of fact, the one witness who claims he heard mr. dunn say something, he even said, i only looked at the gun, i never looked at the suv, so not one single witness can talk about jordan davis being out of the car and even the kids in the car admitted he could have threatened michael dunn, but they didn't hear him. >> the prosecution has said it's going to retry on this top count. are you going to represent michael dunn in the retrial? >> as it stands right now, yes. there are things that come into play, we talked about the defense budget. >> what would having more money, what difference would that have made for the defense? >> we'd be able to bring in experts to show that when you are in a life and death fight or flight situation, what the mind goes through, what somebody may go through, and we get it. from day one we u
