in orinda, pete suratos nbc bay area news. new at 11. it's official the santa clara county school board has appointed an interim superintendent during a closed session tonight. the board named charles hinman as the interim superintendent. he's replacing this woman, mary ann dewane, who was removed without cause. two weeks ago. the board has yet to give a reason for her firing, but the move does come a few months after our nbc bay area investigation. we first investigated complaints that the office of education misused some federal head start funds while dewane was in charge. today, a judge denied dugan's request to get her job back, stating that the board had the authority to terminate her. they want him to resign. that's the call from san jose's mayor and the city council to councilman omar torres. torres is facing a sexual misconduct investigation. mayor matt mahan saying today while torres hasn't been charged, the councilman has lost the faith of his colleagues and his constituents to do the job. here's nbc bay area's audrey asistio.

heather holmes is at the orinda station now where she spoke with bart and passengers about tonight'smergency. heather. >> reporter: julie, we are here as our firefighters, i'm told the fire is out. crews remain here on the scene, as does the train itself. there it is on the elevated tracks. i've learned that this fire started right smack-dab in the middle of the train in the fifth car of the ten-car train. i want to show you what it looked like by those passing by. take a look at this video. you can see all of that smoke billowing from underneath this train. it has not been a good couple of days for bart riders. they were just heading home when suddenly they were told they needed to evacuate. listen to what one passenger told us. >> they told us to get out. and yeah, we smelt the smoke, but seemed to get progressively worse. >> reporter: now, a few minutes ago i spoke with a bart spokeswoman. she tells me that at this time, they have determined that this was some sort of equipment malfunction, an electrical shortage. the fire chief tells me indeed this fire was a bit of a challenge.

in orinda, pete suratos nbc bay area news. new at 11.s official the santa clara county school board has appointed an interim superintendent during a closed session tonight. the board named charles hinman as the interim superintendent. he's replacing this woman, mary ann dewane, who was removed without cause. two weeks ago. the board has yet to give a reason for her firing, but the move does come a few months after our nbc bay area investigation. we first investigated complaints that the office of education misused some federal head start funds while dewane was in charge. today, a judge denied dugan's request to get her job back, stating that the board had the authority to terminate her. they want him to resign. that's the call from san jose's mayor and the city council to councilman omar torres. torres is facing a sexual misconduct investigation. mayor matt mahan saying today while torres hasn't been charged, the councilman has lost the faith of his colleagues and his constituents to do the job. here's nbc bay area's audrey asistio. new

we're talking about orinda officials with the orinda moraga fire district are considering a new ordinance that would require homeowners to get rid of all flammable vegetation and material within five feet of their homes. that includes plants and grass, wood fencing and any other combustible materials. joining us now is the mayor of orinda, darlene gee. mayor gee, thanks for being with us. how widespread is this problem in your city of orinda in terms of homeowners being dropped by their insurance companies? well, raj, we were the absolute most affected community in the state of california for insurance. non-renewals. and considering that we're only 19,000 people, we had a huge impact, perhaps as much as a third of our residents received non-renewal this year. that is a huge number. all right. so the idea here is to protect the homes in orinda from wildfire and get insurance carriers back. madam mayor, will this work to get those companies back? well, that's not guaranteed. raj. so that is going to be something that's going to be a big matter of discussion in terms of whether this ordinanc
