let's bring in jeff brown. explain what the court said about this inmate and this intellectual disability. what does that really mean? >> we used to call that somebody mentally retarded. what happened they had a case of 2014 which basically did away with the law in florida and said that the florida test whether someone is intellectually disabled was too rigid. in the us supreme court said you can't have a fine line like that. you may have people that have iqs a 75 more but with other factors are intellectually disabled. after that case came about, florida had to look at this particular case and decided whether or not the judge should a given a hearing. in this case, the judge did not allow him to go forward because his iq, at least at the time that he was under 18, was higher than 70. this case says the florida supreme court is acknowledging th case is retroactive and they are saying that he now needs to have a hearing with the judge to determine whether or not he is actually intellectually disabled. >>mark: it

jeff brown: let me applaud what judge hornby is saying. i've never been a trial judge. that is not a question i can speak to very directly. but i do know that the cases that come up to me when those suppression motions get denied, and you are sometimes looking at them -- you can see that those judges are doing the same things that the judges on my court will do, which is to look at some precedent and to say, well, boy, this looks bad, really kind of shady, but what can i do? one of the things that makes me crazy is they get segmented in a way that allows you to look at one part. when they stopped them, we say, that was just assistant-police interaction -- just a citizen-police interaction. then after they were stopped, police said they looked nervous. that rolls on into some kind of articulable suspicion. so, i agree with him that one of the things that courts have to do is just look at things realistically and try to figure out what is really going on. try to think through how things really work in a practical sense and don't pass over it at 30,000 feet. get in there a

jeff brown, you were there at the celebration last night and toot you were at the trump tower. did you see and who did you talk to? >> brown: i was at trump tower. things calmed down this afternoon. last night, was more dramatic. this afternoon was a classic new york scene, lots of people gawking across the street. we were all held across the street. some demonstrators anti-trump, a few trump supporters were there. cops say, you know, take your photos and move on, folks, that kind of situation. the most dramatic thing was, in front of the trump tower where i think i counted seven or eight very large dump trucks filled with sand, those are obviously for protection against explosives. something tells you about the world we live in today. i can't help but reflect as i was there again going back to thinking about last night, the surreal nature of much of this, to be looking at trump tower, the wealth of fifth avenue, gucci is in the bottom floor of trump tower, to think about how this wealthy new york businessman somehow managed to connect with so many americans and is now our pres
