andrew weissmann, first your reaction. i also want to get tim heaphy's reaction. >> sure.ted by the fact that vaughn is reporting there's redacted names. and i wonder if vaughn could speak to -- it sounds like they were able to serve people who were local who might be arizona people. from that, would it be fair to infer that there maybe people who, you know, because the scheme as alleged elsewhere in various indictments is that people at the trump campaign were orchestrating this. in other words, this didn't come from the bottom up. this was coming from d.c. down. is there -- from that, could you infer that at least some of the redacted names may be people who are in the trump campaign? >> right. andrew, i'm looking at the same screen i have my camera on here, one, two, three, four, five, six, seven names are redacted. so there were the 11 electors, fake electors out of arizona and seven additional names that are redacted here. when we are looking at multiple counts, nine different counts, count one conspiracy, count two fraudulent schemes, count three, fraudulent schemes

and we are back with neal katyal and andrew weissmann.not give you some trauma. i'm sure you remember that moment from 2018. but -- present day, the whole immunity argument is contrived solely so trump could evade justice. i mean, what does it say in your view about the court that they are considering it? it makes it a open question. >> that's true. i think though that something that you said in the opening and neal alluded to, the timeline that the court set makes it really clear to me that they took this case to delay the trial. and stay with me here, because i think there are sort of two things to keep an eye on. one is the timeline for deciding the sole issue that's before the supreme court, which is this immunity question. what is not before the court, what was not supposed to be before the court is the trial date. >> mm-hmm. >> on the immunity issue, both parties should have an interest in having that decided as quickly as possible. the government of course, because they've an interest in going to trial quickly and keeping the date

back with me are lisa reuben and andrew weissmann. that is the case basically for it being an illegal sort of scheme. i want to hit you with just really quickly before you react to that, somewhat breaking news. i don't know why trump's truth social is breaking news, but he tweeted out judge merchan refused to put a gag order on the truly out of control people. only the president, the presidential candidate, me, mistrial. thoughts? >> well, one of those people is a criminal defendant. and judge merchan made that point when this was raised saying, i don't have power over all of the united states. you are a defendant. that is why there is a gag order. and so that is the critical difference. also, just to be clear, nothing about that gag order prevents donald trump from making any and all claims about joseph biden, his administration, talking about politics. he can even and has attacked the judge and the lead prosecutor. the d.a. so this idea that it's like, you can run for office and not engage in attacking jurors and witnesses. shocker.

andrew weissmann tweeted this about that filing. any normal person would lead this brief by saying, i did not engage an insurrection. since trump is not condemning it, he relegate that to a later aside. that is exactly the point. this may leave him on the ballot. we don't know. is not even denying the core argument against him. he'snot running from the insurrecon he is embracing it. he has called january 6th a beautiful day. he has referred to the rioters as patriots. he has said he will powered in many of them. just this weekend, three years to the day since he incited that violent mob, he called on president biden to release the january 6th hostages, as he called them. that is exactly the point that president biden made in his speech on friday, that this race is between someone who supports what happened that day and someone who does not. that is what it is about. that contrasts should tell the american people what kind of precedent each of them would be. >> donald trump's campaign is about him, not america, not you. donald trump'

andrew weissmann, bradley moss, joining me now. andrew weissmann, if the charges against you are politically motivated, is that a defense in a criminal prosecution? >> it is something that with additional evidence, assuming you can support it, is an argument that you can make to the judge or something called selective prosecution or vindictive prosecution. it is decided by the court, not by a jury. so you would need to show that people who are similarly situated have not been charged and that the reason that the person went forward, that you went forward and charged that person, was for impermissible reasons. it is a very very hard thing to show and prove. obviously i think none of us have had a chance to really study the allegations here, but i think it's useful to separate them into two buckets. there is a press release function of this document, as you said, starting with, talking about how he's doing in the polls, referencing all sorts of collusion and claims that are really just for his base. and if you are in front of a serio

and andrew weissmann is back with us.the bigger the judgment, the more likely it is, that the judgment will be reduced this. is an indication that possibly the appeals court might have in mind, in the end, possibly a lower judgment? or not? >> well, yeah. we don't know the answer to that. and there are things that trump won on. there are things that trump lost on. certainly the schedule that was set for hearing the appeal is much faster than normal the fact that there will be these two sort of overseers and monitors in place even during the appeal. that is honestly a good thing. but my disappointment in this ruling has nothing to do with the merits of it. it has to do with the fact that there was no explanation by the court as to why it was doing what it was doing. and i just think in this age, where we're seeing donald trump and so many people attack the judiciary, it is so incumbent on judges to give their reasoning. it is so easy for people to be cynical about what happened here, to think of this as a sign of two syste
