vic lee, abc 7 news. >> our team coverage continues with abc 7 news reporter chris nguyen live at the regional medical center of san jose. chris? >> reporter: dan, one officer remains in critical condition, the second officer stable. he is conscious and able to talk. if you take a look behind me, you can see some of the police cars that have been out here in front of the hospital throughout the afternoon. that has been the common scene. he w as we take a look at video show, police officers from multiple agencies have been stopping by to had show their support for he fremont police department. we've so some of the officers may have been involved in the standoff overnight. now, about an hour ago, police released new details about the standoff on roberts avenue that led to the suspect's death. we learned gerald vilabrila shot out a lock on a random house to get inside. fortunately nobody was home. once inside, police tried to get the suspect to speak to them. he refused so they fired tear gas into the home. the suspect then called 911 and initially told police he had a hostage. however,

vic lee broke that story first on abc 7 news and is live in palo alto with the late details. vic in. >> reporter: well, abc 7 news has learned that judge aaron persky was taken off that sexual assault case this morning when the santa clara county district attorney took a rare step filing a motion to remove the judge from that case. they said -- and this is a statement from the d.a.'s office -- we lack confidence that judge persky can fairly participate in this upcoming hearing in which a male nurse sexually assaulted an anest asized female parent. on another front today, a judge in the brock turner case expressed his outrage by writing the judge a letter. i was a juror in the brock turner trial. the first words in his letter to judge aaron persky, a letter he also sent to the "palo alto weekly." he wrote, i was absolutely shocked and appalled at the judge's leniency. a six month sentence he gave former stanford swimmer brock turner for a sexual assault conviction. report a reporter spoke with the juror after she received the letter. >> you felt kp compelled to speak out about
