yeah, look, there's nothing in the constitution that prevents somebody under indictment, somebody on trial, or even somebody convicted from running for and holding office in this country. the only thing that would prevent donald from, from taking office or remaining an office would be if he was impeached by the congress. so, you know, i think trump's legal strategy here because he knows and his attorneys know that the evidence is overwhelming. is it so his legal defense strategy is to be elected president and or, you know, either either himself or in part of himself, excuse me, or, you know, hopefully uh in his mind, uh, a republican that's uh, you know, favorable to him will get elected and pardoned him like for did with nixon, but it is defense strategy at this point is exclusively winning the presidency and part of himself. because barring that in all likelihood, he would be convicted based on the evidence in these case. okay. anything is convicted, the owner of saying that the charges for the faces he could face present time but, but he could also just be fined instead of any but, but how would you put a full, the president in prison? a look, you know? no one's above the law that's, you know, one of the bedrock principles in this country. you hear a lot about these charges and they talked about statutory, maximum prison terms. those are kind of, you know, do not see numbers in reality. but they're not really how, how sentences or fashion sentences or fashion by what are called the united states sentencing guidelines. they kind of informed the judge of, of the appropriate sentence based on a whole host of factors about the case and the defendant's background. and then on top of that, the judge has a pretty broad degree of discretion in fashioning and appropriate sentence. they can succeed with the statutory maximum sentences are under the, under the, the criminal laws that the defendants convicted of. and in this case, you know, they're consecutive and when you add them up, you know, you're talking to tens of decades of years. but again, that's not how does it have an incentive, just going to be under the guidelines and the discretion of the judge. but when you look at the cases here, the crime is that he's charged with an a conduct that he's a list to have committed in all likelihood, if he is convicted of either of these 2 cases, he will be sentenced to some term of imprisonment. that's, you know, it would be extraordinary if he wasn't then it would probably be very appealable by the government if, if he wasn't sentenced to a terminal imprisonment. how's he done it? how, how does, how do you sentence a formal present to present the answer your question? just like the sentence, any other defendant? right now you had us talking to our white house correspondent that we're back at the beginning of the program and she was making the point. so do you have you dialed republicans who have you, if you died in the, will the democrats, but it is the motor and an independent versus who, who going to the site the next presidential election? i mean, if it is a trump biking free match and that then not faced with much of a choice all day, i mean what, what are they going to do to? well, we'd like to think we have a multi party system here. but truly we have a 2 party system and so people do choose the major party when it comes time to elect the president and they get behind it. but more and more americans are feeling like these parties don't represent them. look at our congressional approval ratings . they continue to go down year after year. we even feel like are elected representative sitting and congress don't represent us so partisan stripes aside a by then trump 3 matchers release like those. one thing for the country is that we're in truly charter territory to have octogenarian serving the white house when the retirement age on coast to coast in the country is anywhere between $61.00 to $67.00 is just, i believe, nonsensical. i'm an advocate of term limits, but again, i'm also a really big believer in, in following the constitution. i don't believe in a lot abolishing the electoral college. i believe our founding fathers didn't think we would have leaders this old, but it's where we are. so it's incumbent upon the parties to do better, and i see the r n c. doing something unique. this time, the art teacher wanted, mcdaniel has introduced at plat. she's introduced criteria in the form of money or polls. and in certain polls you have to pull it a certain percent. she doesn't want these vanity tendencies to become really part and parcel with how we do politics politically, from the republican side today. so i think that's quite unique. on the democrats side, you see biden's the guy, but who is 100 feet away from the presidency? and as kamala here, she still has record high levels of disapproval. there are many americans who are very nervous about hairs presidency, again, a heartbeat away. so i think what we'll see leading up to next year is biting, and trump are on the ballot. you will see americans vote against one or the other. out of we, we thought that the january 6th was a, was an incredibly dangerous moment to for the, the us things don't seem to go much, much better since then. even though they are a little comma, how dangerous some of it is. this for us democracy do you think? and i think it's a very dangerous moment. we're living and you know, very dangerous times to the in particular, you know, given the kind of reactionary tribalism on both sides. but, but, you know, you see this was from supporters. is you know, his core base day after day is like, fast, just don't get through right. there is a point of view about what is going on in this country and about this indictment. that is, it's just immutable and is truck is convicted. and if they believe, you know those, if they're not persuaded by evidence that is presented at trial and it doesn't look like anything would persuade them if he so he's convicted and you're going to have a lot of angry people and you know, a good chunk of these people have hardly shown a proclivity towards violence. so i think that, you know, following a conviction, we are very likely to see at least the types of violence, of our government has been prepared for it. and if the, if the, if the media explains it and, and, uh, you know, with the internet today and what can be, uh, you know, broadcast on that and the ability to the, to assemble and all those things, it just creates a very combustible situation. so, you know, i think it's a, i think it's frightening time, right? adam parker adam, its one of these times where if you look at the message of the market and try to figure out how it's behaving, you give a lot of credit to saying that we have a pretty bright outlook, right, in terms of the broadening out of the market, the fact that we haven't went down in a while. it feels like we're scaling the wall of worry. volatility has dropped if you try to figure out the fundamental inputs that substantiate the behavior, maybe it's tougher in terms of valuation. so where does that bring you >> i mean, i think what's in my mind the rally earlier this year, i thought part of the reason we're up is the bear case doesn't seem as likely, consumer real income is doing okay, you can get a job if you need one. so that explains to me some of the market rally, just a lack of the bear case. but i think in the last five or six weeks the lack of the bear case isn't the only explanation. now it's a more plausible 2024 or 2025 bull case, which comes down to, you know, fiscal stimulus for decarbonization and deindustrialization of america and maybe election year and china. there's an emerging number of possibilities that seems to make people think, maybe 2024 earnings could represent a new multi-year trend, so that, i think, is gaining steam among investors i talk to. all the while, i talked about the bear and the bull case i didn't mention the base case, which is kind of the same for me as it was on january 1st, i think earnings are eroding but not imploding and that's what you're seeing. so it's a kind of kind of bear/bull change but not a base change. >> so, yeah, in sort of hedge fund speak you've kind of chopped off one of the tails to some degree. >> yeah, asymmetry, yeah. >> to your point about maybe not that much has changed in terms of the earnings picture, if you go back several months to the beginning of this year, just looking at 12 month forward s&p 500 earnings, 230 bucks and change, still 230 and change we went like this. a dip and a comeback so the point being, people seem to be more certain or confident that we can get there on a 12 month forward basis. then to your point, 2024 is when you start to resume growth but do you think it's all of those individual threads that you mentioned in terms of these themes of in the economy, long-term investment type activity, or is it just we're back-fitting the story to say, you know, maybe we have a bull market that's acting like one and we've got to figure out why? >> look, people always feel excited after a rally. if you're honest with yourself, you've liked stocks, i've liked stocks at higher prices than i used to hate them at it just happens because the market leads the economy, not the other way around what the market is telling you is that the earnings outlook is going to be better than people think or it's the beginning of a multi-year run if one or both turn out to be true, we're going to get a big correction in the market i think right now it's definitely some human behavior and psychology, it's definitely part of it to answer your question part of it is how plausible is the fact we're going to have a beginning of multi-year run earnings i think it's got some teeth to it the other thing that's important, if you look at the year ahead outlook from all the major firms and the economists and strategists into this year, zero of the major documents mentioned a.i. so while we know a.i. is probably a little frothy in terms of what people expect and the actual -- the truth is there are some companies benefiting now and that was an upside surprise versus, say, last november so there's some reasons that the market should be up, the emergence of a.i., and i think some are sfpeculative i think people struggle with the valuation of the equity market versus bonds people say it looks more attractive to buy two years. that works in years three through ten. it has never been a good predictor in a shorter horizon everyone is trying to figure out is this the last wave of optimism or not. my suspicion is maybe it isn't, because i think you can still believe the dream that we're at the bottom for a little while longer. >> yeah, i mean, i do think we need to scrutinize that relationship a bit because if you look at the history of when the stock market has traded at, let's say, near 20 times earnings and say what were bond yields, it's not consistent we were at 6, we were at 2 so it's an interesting one to figure out >> usually when yields are extreme the world is a risky place and you should pay a lower multiple the other pushback you'll get from people more bullish is this s&p multiple thing is not what's happening for the average stock, the median stock, which is at 15, 16 times forward earnings. i think you're at the biggest gap on cap versus equal weighted valuation. so the case for the broadening is margins expand for more companies. that's a good-looking chart. nice. >> we got the source. >> so people are saying margins are going to expand because commodity headwinds turn into tailwinds, labor is going up at a less rapid rate. so all of a sudden there's some hi hi higher plauzibility and stocks go up when gross margins going up that's basically the number one thing you've got to look at. >> let's broaden the conversation and bring in cameron dawson of new edge wealth and marcy mcgregor of bank of america. how does this sound? we're trying to parse out whether, in fact, the market has overshot what we can expect from the economy. you've pointed out the equal weight s&p is not necessarily parallel to the market cap in terms of valuation and performance. >> yeah, i think one of the other things to add to the conversation is about positioning, because that does explain a fair amount of the move that we've had and that positioning tends to be the bigger driver in the short term. and to adam's point, valuations don't really kick as a headwind if they're head, really until you look out two plus years. they're not good timing tools. so when we look at the positioning standpoint, what we can see is that positioning has gone from being deeply underweight to being closer to overweight but not to the extreme like we saw at the beginning of 2022, because history suggests that the point that valuations matter is when you are at very long positioning, meaning that that's when people start choosing between bonds and stocks that's where you start having that question about the incremental buyer. so there's still likely room for people to get drawn into this market, which means that valuations could get more stretched. but that's where we have to start thinking about two years plus and wanting to be disciplined. >> that makes sense. marcy, what about the risk/reward to you it seems like you're not in the mood to chase things how would you with fresh money treat this market? adam johnson. adam, we're talking oughted morning about markets being down after fitch downgraded the u.s. debt. so look at where we are. dow industrials down 107, nasdaq down 113. fitch rating service's downgrading the u.s. credit rating to double a plus after growing concerns of the u.s. debt and deficit. they are saying it's a wakeup call. the $32 trillion in debt, your reaction to the teeth of this downgrade. >> maya mcginnis is right, it is a wakeup call. 8% of the money that the u.s. spends every year goes to just interest and that's on its way to 14 over the next several years, not to mention social security medicare and medicaid which are roughly half and are running out of money. number one, yes, it's a wakeup call. we have a problem. number two, what took so long. standard and poor's downgraded the u.s. for the same reasons in 2010. here we are 13 years later. point number three and this is actually what i think is most relevant for me as an investor and i think for many of our listeners, moody's still rates the third rating agency still rates the u.s. at triple a. in other words, there's this belief that somehow we'll muddle through, that once again when the debt needs to be -- debt ceiling needs to be raised, congress will figure it out and we'll keep kicking out down the road. i'm not going to sell any stocks today because of this headline and that's -- so it's kind of a complicated stew. maria: janet yellen tried to attack fitch, saying they have under counted and their data is wrong, talking about the years 2018 to 2020. one analyst wrote about the fact that president trump was president during that time so it's an easy way for janet yellen to blame trump. >> yeah, yeah. maria: there you go. but we're watching the broader macro story and expectations getting better. you guys were already there. you were not expecting a recession but ryan, we've got another busy day of second quarter earnings, cvs reported a double beat earlier despite the wide restructuring plan. t kraft heinz reported a double beat. spirit airlines and pay pal out after the bell tonight. we're looking ahead to apple and amazon tomorrow, apple is expected to post its third consecutive quarterly revenue decline. analysts are focused on the company's forecast for september. ryan, how do you deal with amazon and apple coming out tomorrow? apple, the largest market value of any company, $3 trillion. >> i think at this point it's a little frothy. for apple to get to $4 trillion you need the equivalent of ibm and oracle's revenue combined to get there. that's a lot of growth. it trades at 30 times forward earnings which is well above historical averages and you mentioned their sales are slowing. so your multiple's going up but your sales are slowing. i think that's going to be a problem longer term. it's the number holding s&p 500. furthermore, bicker shir berksh, 25% of that stock is apple as well. i think there's over concentration in that stock. i think there's a point where it's over mature from a growth perspective, how much further can it go from here. maria: it's amazing how it far and away distanced itself from everybody else with the $3 trillion market value. microsoft is 2 and-a-half trillion. how is it possible that this stock has gotten as strong as it is, apple shares up 50% year-to-date. would you sell into it or just hold? >> i would trim back on it. maria: you would. >> my belief this year is tech has been hot. kudos to adamone so well. bottom line is, tech is over valued here. you have to start to broaden out your exposure. we've seen energy stocks are moving now, financial stocks are moving, material stocks, small cap stocks are starting to move, emerging markets up 6% last month so broad exposure is the key here. that's what i tell my clients. i have one of the best growing investment firms in the country. we have to make the decisions every day. maria: are you going to come back on any of your apple holdings? >> no, i'm not. but i look at some of the names that have run and they pull back. maria: what about nvidia, you own nvidia, are you going to cut back on nvidia. >> do it. >> i already sold some. i bought nvidia, 175, that's when i wrote it up for my clients. that was less than a year ago. my first target was 475 t. it got there, i sold half. if you set a target, it gets there, sell a portion. my next target is 600. maria: don't get greedy, right. thanks so much. ryan, always a pleasure. adam, you

adam klotz, adam do tell. >> this is the storm as we see it off the baja peninsula that we've been talking about it is running over a little bit colder water. it is so interacting with land a little bit so still a tropical storm winds now down to 65 miles per hour moving to the north at 25 miles per hour so moving quickly about give or take 100 miles currently south of the border but as you can see so much of the rain and so much of the activity is front loaded on this storm so all out ahead of it and seeing heavy rounds of showers taking los angeles area this green box that is los angeles county and they're currently under a flash-flood warning. they have seen a couple of inches of rain really quickly particularly there in northern mountains just north of the city, all of that rain being quite a few squeezed out of higher altitudes -- and moisture coming down relatively quickly and this is a fairly big concern and continue to be a concern now how much more rain is still to come many this particular part of the country well we're looking really across los angeles, another two to three inches and again we've seen some reports there and maybe 2 inches los angeles it does not rain in august. .001 and more to come and even heavy rain further off towards the north and off towards east and actually we do suspect that the heaviest rein will be interior portions of the state. all of those oranges you're seeing here as this continues to track itself in, those are talking about -- maybe 5 to 6 inches of rain but definitely isolated areas with 8 to 10 inches that's higher elevation that's when you start to think about mudslides all of this water then rushes its way down into the valleys -- and flooding becomes major concern now this entire -- system then will ultimately as you look towards more like monday and tuesday, even bring some fairly serious rain up into portions of idaho. so this is a large storm that has so much moisture with it, it is beginning to bring a flooding risk to really large area now the flood risk today is at its greatest wech an extreme risk there l e way until tomorrow morning but you're looking at areas like palm springs, death valley, death valley could see a couple of years worth of rain just over the course of the weekend into monday all from this one system. absolutely unharled for these areas to see as much rain as we're talking about. this is our forecast model and it is kind of timing out. it is tough to see where the center of circulation is, but as i was playing it it was spinning into the united states -- here -- around 4 to 5 p.m. that's pacific time and then lifting its way all of that moisture dragging further and further to the north you start to see that heavy rain in california back across portions of nevada. when does it start to lighten up and clear off in portions of southern california? well i'm now taking you to 5 a.m. still lingering rain -- it is not probably until midday that you're truly beginning to dry off you see northern california dealing with a backside of that system. and then some more rain across four corners region pumping in a lot of moisture so rain unfortunately is here around for a little bit. i will leave you with this because as i said, the system ultimately does track further to the north we could be talking arthel about flooding -- eric in portions of the pacific northwest, idaho, oregon, up towards washington. montana, this system has a lot of impacts and preem going to be feeling across big swath of the country. >> and then adam said this is is front loaded if you will so that means it is going to come in and you're going to feel brunt of it when it starts and not going to trickle in. >> but all of the these folks have already been seeing a lot of rain because so much of the action is ahead of where we're seeing eye is. the eye of the storm at this point all out in front of it. >> yep. yep. all right, adam klotz thank you very much 237. we'll check back in with you. eric. >> more for on hilary and flooding in turn let's bring in jeremy national hurricane center director welcome we see you with the screen next to you. we have a meteorologist adam talk about the path where do you think hilary is going? >> if you look at this latest radar, hilary is way down here but you're seeing the rain spread all out in front of it and in last couple of minutes you're seeing much anticipated flash-flood warnings start to pop in and fill this screen. this is only a thing of what's to come and worst over the next few hours. se
