what is the possible background to what is going on here? >> working on a lot of these cases there a number of different causes that can be divided into two broad categories. one category is people who have that trait of a loss of empathy and inability to connect to other people and a history of cruelty or what people talk about as sociopaths or antisocial personality. at the other end people with brain disorders and serious mental illnesses that are untreated or because of what's happening in their life, exacerbated by stress. it sounds like the little bit that is coming out, we are more in a direction that this is someone with a brain disorder and other parts of the story that it may take years to uncover it. there is nothing sudden about any of these stories. that's the headline for me. it's sudden for us that this happened. as you begin to understand the story, i assure you the warning signs were there. not that they were ignored, but they were not recognized. >> are people like this as likely to carry out what they end up doing if they didn't have easy access to firearms? >> look, there is no question that firearms play a role. i can tell you from experience if somebody wants to kill a number of people, there other weapons of destruction and ways to make bombs and at least one case i worked on. firearms are certainly an important part of the picture, but understanding when somebody has a mental illness if it played a and i don't know that it has, but it needs to be carefully considered before allowing that person to have a firearm. >> frank, you specialize in treating post traumatic stress and the effects of violence. a very particular problem here with so many young people at the school who have luckily survived. having to deal now with the horror of losing possible friends and people that they knew from the school and teachers and the head teacher and so on. where do you start with trying to counsel young children when this kind of appalling thing happens? >> i think the first thing is helping the parents. the children look to their parents and for the parents, some of them are stunned. they are grieving. they lost a precious 6-year-old. for the children themselves, sometimes children who go through this and do survive take a while to make sense out of it. they may regress and move backwards a year or two in terms of their normal development. some of them will figure out years later what actually happened. some are going to do relatively well. they will be sadder and wiser in a way. the most important thing is what i see happening right now. that community is coming together. people are loving each other. the president has come to remind us that we are a nation who cares and he came as a father. i am a father and a grandfather. i have called my children and i want to know how they are doing with their children. as we come together, we do the best that we can at a sad time like this. >> i suppose the big question is why would this shooter do what he did? go to a classroom and murder so many young children of such a young tender age, possibly the classroom that his mother was already killed at their home. can you try to piece from your experience the thought process here? why he would then having killed his mother go to the school and do what he did? >> i don't have a crystal ball and i haven't diagnosed or assessed him. people with mental illness are not more violent. that's not the case. simply not the data we have. if indeed mental illness is a part of this, there is a particular path that needs to be looked at. are they depressed and suicidally depressed. his roommate alexael said he preferred to stay alone. a symptom of asperger's and report that came out which may or may not be true, there is a capacity for empathy and social connection that leaves the person suffering for this condition. they are prone to serious depression and anxiety. if they are suicidally depressed, we don't know enough. what i am trying to do in agreeing to come here is to ask people to don't rush to judgment about who this young man is. if it was mental illness that played a role, it's an opportunity for us to do better. >> there is a school that you shouldn't give him attention and name him and so on because it brings attention to him. he's dead so he won't be able to bask in the appalling glory of what he did, but secondly these young men. >> you are making that assumption. we don't know that. i spend many hours with men like this who killed dozens of people. they don't necessarily want glory. they are seriously ill. others who do want glory. you are rushing to a particular i

alex talks with lester holt. they talk about his travels and the miracle stories that come from those places. but alex began by getting an update on the war in afghanistan. >> i've been there twice in the last two years, the second trip was interesting in the fact that everybody now talks about the mission, not going after terrorists per se, but training the afghan forces. that's the -- they all want to tell you how well they are doing, give you numbers and power points and flow charts. how many afghan police and army they have trained up. it's happening, we saw it there. but the reality is, a great fear of what happens after the u.s. leaves, a lot of the u.s. forces don't have the same technical capability. they don't have drones and night vision, don't have a lot of special weapons. >> but with our american forces there, how do they feel about leaving? do they feel they have accomplished what they want to do. do they feel good about leaving things in the afghan hands? >> they feel good that they have a mission that they feel they are accomplishing, and certainly when you look at numbers, this are accomplishing that. recently an attack thwarted and they credited the afghan forces. things are happening in that level. this is fear that it could evolve into a civil war, if there isn't a large u.s. and nato pressure. >> this picture depicts some very cool guys. >> this is a flight with u.s. air force, special operations, pararescuemen. they go off in helicopters and go into the battlefield to pick up wounded and bring them back for medical attention. the week we were with them was a really tough week. just come off major battles which there were a lot of u.s. casualties, and i remember the sergea sergeant, he said, look, it's fine to profile our guys, but, please, mr. holmes, be gentle. he said what do you mean? we just had a really, really rough couple of days here. we're talking about hosing blood out of the chopper because of the missions they were doing. things were very, very sensitive, and i certainly respected that. these guys are ten feet tall. you spend a few minutes with them, and you feel like are you this little bitty person. you think what have i done lately? that picture was taken in northern lebanon, several years ago when hezbollah and israel were going at it. hezbollah firing katyusha rockets into israel. the israeli has just hit a building here that they believe housed some hezbollah leaders. we rushed over there to get some pictures and to do an on-camera piece. i remember telling the camera person, i could hear the israeli drone overhead which means they were still checking it out. maybe they wanted a follow upstrike. i said one take and we're out of here, and i'll never forget. i nailed it, one take. dada dada da to the lighting. i didn't like the lighting, let's do it again. dude! three takes and we were out of there. you can't see the drones, but you can hear it as it's flying over. very freaky. >> are there stories where you walk away with your faith in humanity having been restored? >> all the time. sometimes when i give speeches, one of the things i say, none of us -- first of all, none of us knows we're capable of until we are trulli tested and i see that all the time when i cover disasters, and i see horrible things, man, i couldn't get out of bed the next day if that happened to me. put one foot in front of the other but you see people do it, and it restores your sense of we don't know what we are capable of, and you don't until you are thrust into a horrible situation. more often than not, people find a way to carry on. >> more of their conversation today at noon, when alexcal cliff. but opens up his pride as a parent, about a son that is no doubt a chip of the old block. >>> an expiring tax break nobody is talking about in the fiscal cliff negotiations that could cost you at least $1,000 a year. you're watching "weekends with alex witt." [growling] - that was the first episode i saw as a kid. big foot was an alien, and that we've been observed by aliens for-for centuries, and steve stumbles upon their complex, when he and osco are in the mountains. - i love how lindsay wagner, as the bionic woman, overtakes the entire animal kingdom. from sharks to big foot. you know, is big foot an animal? is this big foot? - so then, he hallucinates that she's somebody else. we have a hallucinating sasquatch. that was delicious back then, wasn't it? - sasquatch, trust me, please. - for jaime sommers, big foot had nothin' on fembots. - ah! - when you really think about it, it seems a little bit over the top for jaime to have that crazy reaction. i mean, she screams that blood-curdling scream. - ah! - it's like, "jaime, "is it that far-fetched that this woman might be a robot? alex savidge is at the scene. alex. >> reporter: i just got an update a couple minutes ago from a berkeley police spokesperson. she told me the victim in this shooting thatten had overnight was a woman in her late 40s or early 50s. she was shot while riding here bike. this is right outside of long fellow middle school. about 3:30 took away the woman's body. she has not been identified. i did touch base with a coroner this morning. berkeley police were called out here around 11:30 last night. a lieutenant on scene told me quickly came to realize the woman had been shot at least once. she was pronounced dead at here. they spent hours processing this crime scene. >> obviously a loss of life is a significant thing. we want to make sure we catch the person or persons responsible. >> the lieutenant told me this morning there is no information rob the shooter they are looking for in this case. also he says it's much too early to talk about a possible motive. the spokesperson i just spoke with told me this shooting that happened overnight fourth homicide of the year so far. live this morning in berkeley alex savidge ktvu channel 2 news. >>> time now 6:03. four people were shot last night near oakland lake merritt including one man who was walking to a liquor store. investigators are focusing on two crime scenes. around 10:30 last night police rushed to the 600 block of east 18th street. three people in their 20s have been shot. two men and a woman. also a stray bullet had wounded an apparent innocent bystander a man in his 50s. he was walking to a liquor store a couple weeks away. police haven't made any arrests yet but say they do have possible suspects. meantime police in palo alto were increasing patrols in the downtown area after two recent attacks on women. ktvu janine de la vega is in palo alto to tell us the very latest on what police are saying about a suspect. janine. >> reporter: i spoke to a woman who worked nearby and knew about the attacks she said she feels uneasy because she works an early morning shift. that sand the same time the attacks happened. now the first incident h

alex savage is live to explain, alex? >> reporter: the sergeant on scene told ktvu channel 2 morning news it all began as a fight between two sisters. inside, one of the units at the apartment complex, on the 400 block of willie avenue. the woman apparently grabbed a knife and began stabbing her sister who was visiting for the holiday. this is one of the victims and the stabbing began at 10:30. an officer said three other members were also stabbed trying to break up the fight. one of the other victims was a teenage girl. in the end they were all taken into the hospital and the woman behind the stabbing was taken into custody. they are trying to get additional information on this investigation and they are trying to get the names of the people taken into custody and to get an restore power to all but a few customers. it has been a blackout since a nissan altima hit a power pole. they say it started when a driver crashed into a vehicle near sunkist and that driver kept on driving and crashed into another vehicle closer to where we are standing near the freeway. the altima snapped the freeway in half and knocked out power to 6800 customers. they are hoping that person will come forward this morning and they say there is at least one pole which needs to be replaced out here and several down on the roadway. it takes hours to replace the power pole and most will be was over visiting. they tried to break up the original fight between the two women and one of those victims was a teenage girl. the woman behind the stabbing was eventually taken into custody, the woman who lives at this apartment complex. now i have put in calls this morning and so far we have not been able to get a name on that woman and their conditions and again, a stabbing following a alex savidge is live on walnut street. good morning, alex. >> reporter: good morning. the sergeant here on scene told me in this case a woman was found stabbed to death early this morning. officers are still out here on scene. you can see a couple patrol cars parked out here on this street. the stabbing happened inside this apartment building in a second floor unit. we'll show you video we shot a short time ago. this is all taking place in the 5800 block of walnut. neighbors called 911 just about two hours ago. around 2:30 this morning. when officers aryed here on scene they went inside this unit and found this woman with multiple stab wounds and she died here on scene. a sergeant told me a short time ago police do have a possible suspect. a man in custody at this point. they are not saying much about who this person is. and the motive at least at this point according to the sergeant remains unclear. in addition, oakland police also investigating a second deadly shooting. another crime scene. two people who were found dead shot to death. this all happened early this morning as well in the 800 block of immediate. right near san pablo. police there at that scene aren't saying a whole lot about what the motive may have been for that deadly shooting. or much about the victims. in both of these cases the victims remain unidentified. live this morning in oakland alex savidge. >>> the victim of a hit and run crash now has firsthand knowledge of the violent crimes crisis in oakland. he's been stranded since 7:00 last night. when he got here the truck slammed into his parked car. the hit and run driver left the scene. and he spent the entire night asking the oakland police department asking for help. >> they said they had no eta. no officers available. highway patrol officer came and said it's not his location. he left me here abandoned on this street which is not a good neighborhood. >> both the oakland fire department and aaa told them they could not help him because this was considered a crime scene. just hours ago we contacted oakland police. >>> the city of oakland says it has a new crime fighting strategy and comes after the department avoided a federal takeover. the big name being brought in from los angeles and what he's planning to do to lower the city's crime rate. >>> chp still at the scene of a deadly crash. it all began with a traffic st

>> well, yes. and thomas, it's great to see you. what the u.s. supreme court actually agreed to hear is one case that is rooted in the california constitution, the prop 8 case. then the so-called defensive marriage act that passed in 1996. when you cite those polls, what's so interesting to me is that this first burst on the national scene in 1996 popped up in conservative research when they were running out of issues and they suddenly went, my god, eureka. this gay marriage issue. this is an amazing weapon to use. the american public does not favor it and it can be used politically. karl rove called it the gift that keeps on giving. for many years, it did. one thing the conservatives did not count on are two things. one, most families have a gay son or daughter they love or a cousin or uncle they cherish. the other thing, thomas, is at the end of the day, they didn't anticipate that conservatives themselves would come to see this as a conservative issue. >> sure, it's a traditional value. >> absolutely. >> when you have vehicle dick cheney who has a daughter who wanted to get married and start a family. just not from individuals on the right. we have seen elizabeth now. we have nine states in washington d.c. area having legalized marriage equality. >> right. >> the initial issue with the court taking this issue up was met with relief by certain people, certain marriage equality. some worry having the court involved could stall the progress. do you think there's the possible likelihood of that? >> no. i mean, i think there's always a likelihood, but i think the u.s. supreme court has ended up time and time again in our history reaching up and out when it comes to a fundamental right. marriage has been determined to be a fundmental right many, many times by the supreme court. it may invite or somehow inspire some on the right but i hope not, to try to alter our constitution. the fact is that our constitution has been amended 17 times and always to expand rights and never to narrow them except prohibition that got repealed. what's the truth is that this is an issue that has taken hold. it's about civil marriage licenses. there's just been too many people that have now come out and, you know, thousands and millions of individual acts where the american public something the strategists did not anticipate back in 1996 is the american public shifts and as it has become comfortable, they have determined yes, these licenses should be extended. you know, the u.s. supreme court could determine this on narrower grounds, just on the california issue and just strike down doma. then we are left with nine states where you can marry and it would remain unresolved as to the other states. seasoning correct. >> if we are ever going to see civil marriage in alabama, it has to be the u.s. supreme court. i think we are living in an amazing era for gay people. hopefully the supreme court will understand its moment in history and like it has done before, come down on the side of justice and fairness. >> elizabeth, when we talk about the fact they had ten they could look at for consideration, i know they take it seriously, they were going to consider the eight doma cases and the two prop 8 cases and whether they would be raised up for further investigation. we have one and one. what do you think the odds are that this could be a draw? if we look at it, it's got to be either both are seen as a win for those in terms of expanding america's liberties or a failure. there couldn't be a draw. >> i think it's going to end up being great and historic or very good. i don't think the court would have taken the defensive marriage act, which frankly i'm a lawyer and i think any constitutional law student knows on the face it's constitutional. it bars some thousand and more basic privileges and benefits from flowing to people who have gotten legal civil marriage. that is very un-american. people are paying taxes, cannot take advantage. the other thing that doma proports to do is to tell a state that it doesn't have to recognize the gay civil marriage of another state. the fact is that, that's a little arrogant of congress. congress can decide, you know, to actually enforce a uniform approach among the states, but to tell one state they don't have to adhere to the law of another state, that's presumptuo presumptuous. on the prop 8 front, yes, it is about the california constitution. but, what the ninth circuit concluded is that in fact it was also a front to the u.s. constitution. while it didn't rule on that basis, the right to marry is pretty settled and it is constitutional, fundamental right. this is not unique. the united states is way behind other nations. there are many nations around the globe that allow for same gender civil marriage. >> elizabeth, great to see you. thanking for your time. >> good to see you. >>> the big three. how is john boehner performing as fiscal cliff negotiator. there's a petition drive demanding the president and lawmakers resolve the crisis or else. you are watching weekends with alexan soup spectacular? alex savidge has more on how a traffic stop turned into a much larger situation. alex? >> reporter: well, now that the sun is coming up, the team is going to resume searching for this team, somewhere in the cordova creek. the man is suspected of drunk driving and ran from officers during a traffic stop. it happened earlier in the morning. he jumped into the creek in an area where the water is moving very quickly. authorities put a boat in the water right away to search the bas ofthe creek but there was no sign of the man. this all began after midnight when ross police made a dui stop on the man's car near sir francis drake and college. but during the field sobriety test, this man took off running from officers. officers watched him go in the creek and eventually lost sight of him. >> they followed for about 100 yards trying to encourage the person to come out of the swift water. he swam away from the officers. the officers followed him as far as they could until they couldn't anymore. >> reporter: now, the ross police chief said he isn't going to release the name of the missing man at this point but police are very concerned about his well being since the water is cold and the current, especially in the air area where he went in, is -- in the area where he went in, is swift. it's possible a dive team could be called in to search for him. but we understand the search- and-rescue team will pick up the search at 7:00, the chief said. we have not seen them yet. we'll monitor the situation. we're live in green brain -- greenbrae this morning, alex savidge, ktvu channel 2 news. >> thank you, alex. >>> rising creek waters flooded roadways an temporarily closed highway 101. it happened on the peninsula in a creek that overflowed its banks. janine de la vega is live at the creek to show us some of the damage. >> reporter: well, we're right here on the border of palo alto and east palo alto. this is highway 101 and the creek flows right underneath it and the water was so high last night that it was flashing up over and onto the freeway. this is video of that same area of what it looked like last night. water was flooding on 101, north of the embarcadero. the highway patrol was helping motorists with traffic breaks. the creek crested at university avenue and woodland. the water spilled over and into the entrance of the four seasons hotel. fire officials say even though there was not massive damage, they remain worried about the creek. >> we need to work on these holes in this levy. can't leave it like this especially since we're earl

big batch of high clouds over the bay area this morning, early, those clouds have moved out, so today that dry weather forecast, mostly sunny skies, there is another weather system developing out here in the pa civic and this will be the source of more cloud cover as we do take this into your friday so an increase in the cloud cover and rainfall developing, i put a rough time window hire between 4:00 and 8:00, could be earlier in parts of the north bay as this system approaches during the early portion of the afternoon. but this will generate some rain showers, especially by friday night, lasting into early saturday morning. and the cold nature of this storm will drop our snow levels down to 3000 feet saturday morning but the rest of the weekend is dry so good news for a good portion moments ago i spoke with democratic congressman elijah cummings. listen to what he had to say about the standstill. >> there is a sense of urgency. the problem is that we've got a group of tea party folk over in the house who basically has pretty much dictated what mr. boehner can agree to. boehner, who's a good guy who wants to make a deal, he really wants to make a deal, but he can't. >> all right. head to capitol hill. there's mike viqueira standing by for us. you know something else that representative cummings said. i just said you're standing by. it seems like even when they come back to d.c. they're going to be standing by. they don't seem to have much to do in the house right now. >> reporter: that's absolutely right. don't have anything to do in the house. for now they don't have anything to do in the senate, t.j. that's the thing. harry reid, mitch mcconnell, the two democratic and republican leaders respectively in the senate got back from that big white house pow wow yesterday behind closed doors. timothy geithner, top aides, top house leaders as well renewed sense of optimism. they were going to get to it, negotiate, try to come up with something on a smaller scale anyway to get us past this fiscal cliff to make sure the average or typical american family of four's taxes don't go up by $2200 next week when you throw all of it together. we are tolded to that there have been telephone calls, e-mails back and forth at the staff level throughout the course of the evening and into this morning perhaps later today we will have a face-to-face meeting but with staff, not with the principals involved. not with the the senators involved. we don't expect to see them in the capitoled today at all. can they agree on a level here. and if mitch mcconnell the republican leader can bring along enough republicans to have it pass the senate and then really put the onus on john boehner. and that's one of the ifs and bus about this. of course we're talk about mud night new year's eve, monday into tuesday for the deadline here. the world is not going to come to an end, t.j., if they go into tuesday and have to do it then. but certainly they are under the gun. there's a lot at stake here. a lot of people are shake their heads at the dysfunction. anded to ina today inactivity a u.s. capitol. >> we'll get back to you. >>> i'm going to move onto a conversation about this topic. how much political capital has been lost over these negotiationegotiation negotiations. republican strategy is and democratic strategist and the former national press secretary for the democratic national campaign committee. gentlemen, thank you both for being here. let me start with you though, david. your guy, speaker boehner. >> yes. >> right now. you know what, how's he holding up? is he pretty much out of this thing at this point in terms of trying to hash out a deal? seems like it's in the hands of the senate. >> what the speaker had done, what the house had done back in august was basically pass all the -- extending all the tax cuts and dealt with the sequestration. the frustration what he was trying to manage was in fact that the senate hadn't taken up any of those bills. now he had sort of gotten to this point. having said that, given the meeting that happened on friday, now there's some optimism in the sense of senator reid and senator mcconnell being able to sit down and work through a lot of these issues and present those to both the senate and then that gives the speaker the chance to deal with it. but i have to tell you, one of the things that the speaker was dealing with in terms of the vote that he did about a week ago dealing with the $1 million and above was the fact that there was a lack of confidence the senate would do anything with it. so i think this really improves those chances. >> improves the chances. this sounds like as i bring you in, doug, the same back and forth, the blame game, well i tried this but they didn't do that. it's up to the senate. the speaker couldn't do this. this is the same old same old that i know a lot of viewers will listen to and sounds the same. i know you probably think the same and i hear it, i hear the same. so can we put that aside for just a second? are we going to get this thing done now? and is it the time pressure that's forcing this to happen versus just the sense of duty, quite frankly, is to go up there and get your jobs done. we shouldn't even be here right now. >> this is kind of like the "groundhog day" movie with bill murray where we've seen this movie over and over again with the debt ceiling, the government shutdown that occurred, that debate. here's the thing. i think what we need is some momentum. i think what needs to happen is if the senate can come to some sort of agreement, that gives speaker boehner a little more breathing room and there's more pressure on house republicans to take up a vote, even if it doesn't have the unanimous support of the republican conference. if they can pass a bill with republican support and democratic support, send it to the president, that's obviously what i think the thinking here is is to try to create some momentum here. we don't have any momentum. we're having some meetings. i think that's fine. but if the senate can get a deal done and then send it to the house, then i think obviously we're in a much better spot. we saw it with t.a.r.p. we've seen it before. that's the theory of this case here that mitch mcconnell and senator reid, dealmakers who love this sort of stuff can come together and work something out. >> and david, to bring you back in, a lot of people here at least the deal you referred to earlier was that $1 million threshold, raising taxes on those people, incomes over $1 million. a lot of people shake their heads. if you can't go for that deal what deal would you go for to raise taxes on anyone? i guess what is it? do you think that voters, do republicans think voters will hold it against them so much to raise taxes on the highest of the highest of the highest of income earners in this country? >> well i mean, let's sort of remember the speaker had over 90% of his caucus behind him in terms of that vote. and that particular situation none of the democrats were willing to support that particular move. so he had to rely completely on republicans. he had 90%. >> wait a minute. you're telling me he had the support he needed and the votes he needed to get that. >> i'm saying he had 90% of the republican conference behind him. without democratic votes that put him below 218. so obviously he couldn't get that through. having said that, when you get to this sort of -- in this situation where you get where if you get to a deal between reid and mcconnell, one, i think you'll see some democrats come across. but, two i think you're going to see republicans. the concern here was i'm going to have to take a vote as a republican that's going to go nowhere in the senate and could be used against me and it's not going to accomplish anything in this particular situation the idea we could move forward and get a lot of those tax cuts in place for so many americans now all of sudden and the reality that it could happen, now that becomes a much more attractive proposition. although again you're going to see a lot of republicans being just very unhappy. it's kind of our nature in terms of not being happy about tax increases. >> doug, you hit on something a second ago as well. you talked about this issue that we have no momentum. we don't have a lot of time to build up momentum. we just got to get it done now. is this just washington? a lot of people they get so turned off, they're being engaged and talking about going off the cliff a little bit so we can come back and vote. republicans say they voted for a tax cut. the public's not going to fall for that anymore. is this washington now? this is it? >> well, i think the house of representatives is totally dysfunctional. and it's been dysfunctional for two years. and you're seeing it was reported that it's the least productive congress in history. and what they're very good at is naming post offices. what they aren't very good at is doing big things like this. now, i think again i think that if speaker boehner decides to open up the vote, allow a vote for everyone democrats and republicans to vote on a package, even if there isn't a majority of the majority there or unanimous support within the republican conference, i think the outlook is a little bit brighter. but look, we're going to have to do big things next year with corporate tax reform, immigration reform. and this, i think, given where the stakes involved should be easier. and if we can't do this, it makes the prospects of doing those other big things dimmer, i think. >> big things. i just shake my head right now thinking we knew this was coming and here we are just a couple of days. one more thing to you here, david, are people -- i say people, members of congress, oftentimes people can't understand like why on a national level as we watch, why wouldn't they vote to raise taxes on the highest of the highest income earners. but do you sense this -- not sense this, it's fact is it not that many of these members of congress are concerned with their district and what happens in their little district and how they can get re-elected in a couple of years and what's happening down the road. they are voting what's going to work for them. it seems like there's no national consensus, a sense of a greater good for the country. people are just taking care of themselves. would you agree with that? >> well, i think there's an honest disagreement in terms of what this impact of the increases have. republicans look at this increase of those making over 250,000 and say gee you're going to raise taxes on 894,000 small businesses. we think that would have a very negative impact on the economy. the president looks at it differently in terms of saying gee these individuals can afford it. so there's a real difference here in terms of trying to resolve it. i do want to go back to one point that doug brought up to push back just a touch. we passed the extension of all the tax cuts, we dealt with the sequester, and there was a bill in the senate. and look, the speaker can't tell harry reid what to do. it's up to harry reid to do what he needs to do. so i would suggest that's been a point of frustration. hopefully we're now seeing that get resolved. >> last word. those bills aren't going anywhere in the senate. the voters were very clear they want a balanced approach. they believe the wealthy should pay a little bit more and that middle class families should get a tax increase. that's what they voted for, i believe, in the last election. that's not what the republicans are standing up for right now. >> david, doug, gentlemen, i appreciate you both being here. and it is. it's a shame we're to this point, just a few days out and americans are worried right now about what their paychecks are going to look like the first couple of weeks of january. but thank you both so much. hopefully this gets worked out. you all have a happy new year. >> happy new year. >> about 42 minutes past the hour now. >>> want to turn to number five on our first five web stories. beyonce' is looking for co-stars in her super bowl halftime show. pepsi is running a contest that i am going to sign up for during this commercial break where 50 fans and their friends can take the stage with beyonce' in new orleans. fan photos also will be incorporated into an introductory video and tv commercials.
