at least some of the justices and there's certainly a judicial minimalism in the writings of amy coney barrettwell. she may be a conservative on something like -- but i think it would be judicial minimalism in our jurisprudence that we will see which i agree that there's going to be a sort of mental block that a flank block in these sorts of cases. it's sort of an old-school fear of the judges notwithstanding the original constitution in its original conception would have i think sharply curtailed some of these congressional powers and talking about the doctrine of constitutional avoidance and fear cannot be out running the democratically-elected branches and will limit the chords to some of these more outer bound decisions. that's just the reality we face. >> there is intellectual tension if you go back to the founding and many cases revealed this. this debate that we had at the cato institute in 1984 but they have proven in some degree to being compatible. subject to the kinds of exceptions police power for example and on the other hand it deals with the judicial restraints of the chords don
