would move the court to the right but that has less to do with him and everything to do with anthony kennedy's the seat that's being vacanted just as kennedy often voted with the liberals giving them some of their biggest victories, those days are over. that's why he's talking about. if it's not brett kavanaugh, if it's some other trump nominee substituting a republican nominee for anthony kennedy, that's what will move the court to the right. we're off to a bit of a slow start here at the court. this was the first day of the new term. a case, an environmental case, involving an endangered species. there are no real hot button issues for the first couple months, but when the court does move to the right as it will with any trump nominee, in the coming months or years, we'll see new restrictions on access to abortion, greater tolerance on religion in public life. that's the kind of momentum that will be under way for at least the next couple years whether its brett kavanaugh or some other nominee from donald trump. >> what about the concerns of partisanship? the way in which brett kavanaugh o

after neal gorsuch went on and you saw anthony kennedy there. when he leaves and if brett kavanaugh is confirmed, moving the court over to the right. he is much more with justices alito, clarence thomas than towards the center. there are four worth looking at not just with ideology and how their face might change, but their relationships with him. let's take the chief justice. he worked with brett kavanaugh in the 90s. he has known brett kavanaugh for many years and brett kavanaugh even had a hand in george w. bush choosing john roberts for the supreme court, but he is also very concerned about the reputation of the court. wondering how this will all shake out. bottom line, wolf, brett kavanaugh would give him a solid fifth vote for his side of the court. then we go to clarence thomas. we have invoked so many times during this ordeal because back in 1991, he face said sexual allegations in his case. it was sexual harassment alleged bee anita hill, a former colleague of his. he has been feeling some sympathy for what brett kavanaugh is going thro

brett kavanaugh succeeded anthony kennedy who was the sentist swing vote justice. judge kavanaugh is much further to the right, so we can expect this court to be much more conservative. some people, brooke, are casting chief justice roberts at the center now, the middle justice, but he will be no swing vote. he will probably, at best for the liberal side, inch a little bit over to their side, because of his interest in trying to steady the court. that's -- he will be the man to watch, more so than justice kavanaugh, as we go forward. and another thing about the biography of the justices that people have pointed out, talk about their pedigrees. justice kavanaugh's addition to the court reinforces the harvard, yale, ivy league makeup of these justices. we have five justices who attended harvard, four who graduated from there. justice ginsburg, as you probably remember, attended harvard and finished up at columbia, when she moved to new york city with her husband. and with justice kavanaugh, we now have four who went to yale. and here's something new in terms of the s

a couple things to keep in mind, one is anthony kennedy was not the swing vote when he came on to the supreme court, he didn't become so until later on in his tenure. it does seem like now justices are chosen with so much more deliberation, there's a lot more vetting of their judicial philosophies, their court rulings, there's nothing in brett kavanaugh's past that would indicate that open -- being open to being that kind of a centrist. so certainly not in the short term, very doubtful in the long-te long-term, either. brett kavanaugh during his confirmation hearing praised anthony kennedy often, he was a former clerk, remember, but it doesn't seem likely that he will fill that role. >> pete williams, no one can fill your role about you with us. thank you. >>> let's bring in our panel. tessa and erin, good morning. the senate vote for justice kavanaugh the closest in history. does it matter? i mean, pete made the point he's got to vote just like the other eight of them, his vote is equal. is this basically a win is a simple win? >> i think pete is right that i'm not sure it will matte

the president will now put two conservatives on the supreme court and fill the seat of justice anthony kennedy. this is something that this white house has been waiting for. it's coming four before the midterm elections. yes, it has fired up democrats as you just saw there in maine. but it's also unified republicans. and there was a sense here over the last several weeks and certainly several days that republicans were wondering around the country, can this party govern? can this white house govern? this is something that they are now going to use as an achievement with the unemployment rate as well, the lowest since 1969, take it to the midterm voters. so now we will see which side actually is, you know, the strongest in their view, but kate, an interesting note. the president was a mere bystander today, not calling senators. one president was much more involved. i am told by people close to the process, president george w. bush was calling susan collins and other senators in recent days and weeks, but particularly senator collins, telling her that judge kavanaugh has the temperament to be on

is gone, and before anthony kennedy, justice sandra o'connor was the swing vote. and right now, it doesn't look like there is going to be a swing vote. and she says that is another concern. because it looks like one side, one side of the bench would be owned in a particular issue. they are very nervous. >> now, let's talk about what is happening on capitol hill. there is obviously an optics problem for republicans on the judiciary committee, which we saw chuck grassley attempt to explain, he kind of caught himself in a moment where he suggested that somehow women were not interested in serving on the judiciary committee because it was too much work. but we heard him state his position that he would like to see more women serve. but that both men and women don't want that opportunity. should republicans make a concerted effort to have a woman sit on this panel, this important senate committee? >> ryan, it wouldn't be a problem if you had more than 23 women in the senate. we are at an historic high now. and i don't remember the partisan divide, but most of the women

with the addition to kavanaugh to the court, the new role to play compared what anthony kennedy's been playing, how do you think this is -- how do you read john roberts and the moves he will make now? >> okay. i say there's two parts to the answer of that question. first of all, a lot of the cases, for example, gun control, the court shied away from gun control for eight years since saying there is a right to have a handgun in the home for self defense. they didn't want to take up any other cases and some other similar controversies because i think the people who believed in gun rights and expanding them did not know where justice kennedy comes out. having brett kavanaugh on the court voting on what cases to hear removes some uncertainty. so that's part "a." you're right. chief justice roberts may want to go slow, maybe concerned about the perception that this court has become partisan. for the first time in decades, all the conservatives were appointed by republican presidents. and all the liberals were appointed by democrats and that's something that concerns him and the other member

we noted earlier in the hour that he clerked for judge -- justice anthony kennedy and that kennedy was there for his swearing in. so would kavanaugh be likely to vote all that differently from the man he's replacing? >> well, good evening, jon. i think that's a really important question for americans to consider. what brett kavanaugh has shown throughout his confirmation process -- not only the original hearings, but throughout the democrats' very vicious process -- is that he is an originalist and a constitutional conservative. and what that means to americans not only on the current docket for how he will likely vote, but also i think what's even more important is what's fort coming. because -- forthcoming. because it only takes four of the justices to add to docket and to accept a case. we may be much more likely to hear cases at the supreme court that deal with religious liberty issues, freedom of speech issues and, ultimately, sanctity of life issues that are very important to conservative. we've seen over the past several decades, the past 40, 50 years that the democratic liberal
