>> thanks for having me on, ari.here's a couple of things that come from the lead that's happening right now in terms of the early vote and how that's breaking down. the first is that having a lead in the polls is currently a good thing to be happening, when early vote is going on. you never want to be behind, when the early voting is going on. so the clinton campaign lead in battleground states that are in particular significant parts of the campaign and how the -- if she's going to win, are super important. places where she's getting a big boost early from latino turnout, for example, in florida, has spiked dramatically. and when you look at places like that, and you have the ability to invest the time and the organizational resources into developing and culling those votes, it's a significant advantage. i know for a fact that during the 2012 campaign in iowa, for example, a battleground state forever, it seems like, the obama campaign had a lead in the absentee voting and the early votes, and in fact, they had rou

ari, thank you for being here. i want to start where we ended. judge ordering wisconsin to investigate itself. how in the world would that work? >> so basically what a federal judge said is that wisconsin needs to investigate itself own dmv and report back immediately on why people are not getting the voter i.d.s as required by law because the big picture here, joy, is that 300,000 registered voters in wisconsin, 9% of the electorate, do not have strict forms of voter i.d. and the court specifically relax it had voter i.d. law in that state to say that anyone who doesn't have a birth certificate or that kind of documentation, if they go to the dmv to get a voter i.d. they're supposed to get a certificate for voting within six business days but we interviewed multiple black voters, we obtained tapes from the dmv that showed people are not being offered the certificate for voting, they're not being given voter i.d. and being told that this might take until eight weeks when the election is already over for them to get the i.d.s they need to vote. >>

ari melber, chief legal correspondent. anything that's really stopping that would really stop mark burnett from putting this out? >> legally, maybe. with so many other stories about donald trump, he has not proven to be very transparent or provided much evidence. the claim is that they have standing contracts, mgm basically with mark burnett that might prevent them. you might sign a confidentiality agreement with mr. trump, of course, the star and executive involved in the show that wouldn't allow you to release that. this goes to a bigger question with donald trump as he runs for president, craig, something often called the jay-z test who famously said, i'm not a businessman. i'm a business, man. and that's certainly the case with donald trump. he is a businessman but he has the trump organization. it's business activities. it's tax structure. it's corporate subsidies. it's dealings for decades have been intermingled with his personal life, his personal tax status and in this case, the personal candidacy for president. >>

nbc's hallie jackson and kelly o'donnell along with msnbc chief legal correspondent ari melber. thank you all for being here. hallie, i want to start with you. we spent yesterday trying to sort through all of these comments from donald trump and his surrogates and mike pence. they're not on the same page. i've been talking to republicans who say, they're concerned about the fact he's trying to set up this as a rigged election. any sense they'll get on the same page today. >> a lot of the concern echoed in my conversations, kristen. i think people, especially in the republican side, members of the elected officials, people who support these folks say this is dangerous. what donald trump saying without evidence and continuing to push this could be hugely problematic come november 9th if he ends up losing. so i think there's a concern and it's evidenced by what you just played. that montage there. donald trump pushing this line that he said it's a rigged election. voters say he's not talking about voter fraud at polling places but that's exactly what donald trump is talking about.
